DeeWayne Jones. BACKGROUND On December 6, 2000, the City Council approved a request by the applicant for Commercial Planned Development No. 96 -03 and Conditional Use Permit No. 96 -02 for an extension of time beyond the initial three (3) year time limit, since approval of the project on September 17, 1997. The City Council approved an extension for an additional one (1) year period to September 17, 2001, and granted the Director of Community Development the discretion to grant an additional six (6) months extension, which if granted, would end on March 17, 2002. The action taken by the City Council on December 6, 2000, was contingent upon the outstanding project processing balance of approximately $20,000 being paid to the City by December 29, 2000. DISCUSSION The outstanding processing fees required by the City Council to be paid by December 29, 2000, were not received by this deadline. The applicant has requested an additional period of time in which to provide payment of the required fees. The attached letter received on January 2, 2001, requests the City Council establish June 30, 2001, as the final date for payment of the past due project processing fees. S: \Community Development \Everyone \City Council Agenda Reports \ce- 010117ce CPD96 -3 Extension.doc Honorable City Council January 8, 2001 Page 2 The applicant in the attached letter indicates that the potential buyer, Greenway Development, requested additional time of the seller in late December 2000, to determine the feasibility of the project and therefore did not deliver monies to the applicant that could have been used to address the payment issue with the City. Should the City Council conclude that granting additional time to June 2001, is desirable, the date selected for payment should be June 29, 2001, as June 30, 2001, is a Saturday or be established as July 2, 2001 (Monday) . STAFF RECOMMENDATION Approve applicant's request to allow the payment of past due fees by not later than June 29, 2001. Attachment A. DeeWayne Jones letter, dated 12- 31 -00. "l The Honorable Pat Hunter, Mayor Members of the City Council City of Moorpark 799 Moorpark Avenue Moorpark, California 93021 Re: Westgate Plaza - Time extension for S20K owed to the City Dear Mayor Hunter: In late October, Greenway Development Company of Agoura Hills made an offer on Westgate Plaza. Their Feasibility Period ended on December 28, 2000, at which time they were to release $20K to the City per our agreement. Larry Green, one of the Principals, called on the 27`' and asked for an extension of 2 -3 weeks. He stated that because of the Holidays some key people were gone and there were some issues regarding his financing that needed to be resolved. Greenway has accomplished a lot in just two months. I like their proposal of an upscale office project with no retail. Should they not be able to secure financing then I must go back to the marketplace. Would the Council consider extending the time period to June 30, 2001, just in case my Escrow with Greenway Development does not close? Westgate Plaza has paid over $400K in various City fees including the $287K Storm Drain Lien paid last April. Payment on this lien was not required or expected until a building permit was issued.
