At the City Council's meeting of October 4, 1989 the subject of
permitted uses for. PD-1065 were considered by the Council. It was
requested that this subject be placed on the agenda for further
discussion at the next Council meeting of October 18, 1989.
Discussion
PD-1065 was approved by the City Council on November 5, 1987 as a 27,466
sq. ft. automotive service building on property located on. the Southside
of Los Angeles Avenue approximately 250 feet west of Park Lane Avenue
(see attachment Resolution No. 87-440) .
Recently the applicant of PD-1065 has inquired about the introduction of
general non-auto related retail uses to be established in. the new
center. Staff has advised the applicant that to do so would require a
• major modification to the approved PD. Until recently the applicant has
always referred to the center as an auto center. Staff has researched
the files and noted several documents that list the facility as an
automotive center. These documents are attached to th.i.s report.
Condition 1.d of Resolution No. 87-440 states that "all facilities and
uses other than those specifically requested in the application are
prohibited unless a modification application has beer. approved by the
Director of Community Development."

RESOLUTION NO. 87- 440
A RESOLUTION OF THE MOORPARK CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, CONDITIONALLY APPROVING THE APPLICATION FOR PLANNED
DEVELOPMENT PERMIT NO. 1065 FILED BY COLIN VELAZQUEZ FOR THAT CERTAIN
PROPERTY LOCATED ON THE SOUTH SIDE OF LOS ANGELES AVENUE APPROXIMATELY
250 FT. WEST OF PARK LANE AVENUE.
WHEREAS, pursuant to the provisions of Section 8165 of the Moorpark
Municipal Code, the applicant, Colin Velazquez has requested the City' s approval of
the application for Planned Development Permit No. 1065, i•neordeL to construct a
'2721.66--sg, fraau_tomotivrservice16uilding on that certain rre l property loca£ed-'at
the south-side of Los Angeles—Avenue approximately 250 feet west of Park Lane Avenue.
WHEREAS, studies and investigations were made, and staff reports and
recommendations were submitted; and
WHEREAS, the Planning Commission has reviewed and considered the Initial
Study and Negative Declaration on the project; and
WHEREAS, the Commission, upon giving the notice required by the
provisions of Section 8163-5 of the Moorpark Municipal Code and Section 65905 of the
Government Code (beginning at Section 65850), did, on the 5th day of October 1987,
conduct a public hearing as prescribed by law in order to consider said application
for Planned Development Permit No. 1065; and
WHEREAS, following the public hearing the Planning Commission adopted
its Resolution No. PC-87-156 conditionally approving Planned Development Permit No.
1065. Said resolution was adopted at the Planning Commission' s regular meeting of
October 19, 1987; and
WHEREAS, at a duly notice public hearing on November 23, 1987, the City
Council considered the subject application, has received testimony regarding said
project, has duly considered said proposed project, and has reached its decision; and
WHEREAS, the City Council after careful review and consideration, has
determined that the proposed project will not have a significant effect on the
environment, has reviewed and considered the information contained in the Mitigated
Negative Declaration, and has approved the Mitigated Negative Declaration as having
been completed in compliance with CEQA and the State Guidelines issued thereunder;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA,
DOES RESOLVE:
SECTION 1 . That the findings contained in the staff report dated
October 5, 1987, are hereby adopted, and said report is incorporated herein by
reference as though fully set forth.

COMMUNITY DEVELOPMENT DEPARTMENT CONDITIONS
1. GENERAL REQUIREMENTS:
a. The permit is granted for the land and project as shown on the plot
plans and elevations labeled Exhibit "3" , and "4" except or unless
indicated otherwise herein.
b. The development is subject to all applicable regulations of the CPD zone
and all agencies of the State, Ventura County, the City of Moorpark and any
other governmental entities.
c. Unless the use is inaugurated not later than two years after the date
this permit is granted, this permit shall automatically expire on that
date. The Director of Community Development may, at his discretion, grant
one additional one-year extension for use inauguration if there have been
no changes in the adjacent areas, and if permittee has diligently worked
toward inauguration of use during the initial two-year period.
d. All facilities and uses other than those specifically requested in the
application are prohibited unless a modification application has been
approved by the Director of Community Development.
e. The design, maintenance and operation of the permit area and facilities
thereon shall comply with all applicable requirements and enactments of
Federal , State and County and City authorities, and all such requirements
and enactments shall , by reference, become conditions of this permit.
f. If any of the conditions or limitations of this permit are held to be
invalid, that holding shall not invalidate any of the remaining conditions
or limitations set forth.
g. Signs are subject to the Moorpark Zoning Ordinance, Chapter 50 of Title
9. A sign permit is required for all on-site signs. Where there are more
than two signs on the building or within the complex a sign program shall
be approved by the director of Community Development. No off-site signs
are permitted. No illuminated signs shall be permitted in the interior of
the site.
h. No later than ten (10) days after any change of property ownership or of
lessee(s) or operator(s) of the subject use, there shall be filed with the
Director of Community Development name(s) and address(es) of the new
owner(s) , lessee(s) or operator(s), together with a letter from any such
person(s), acknowledging and agreeing to comply with all conditions of this
permit.

Background
The above item is a request for an" autoniotiVe- sets de cent
consisting of 27, 458 sq. ft. on a 2-3 acre site in a CPD zone.
Attached is the staff report and Planning Commission
Resolution No. PC-87-156 on this matter. The Commission held
a public hearing on this item on October 5, 1987 . It is the
recommendation of the Planning Commission to approve this item
subject to the conditions of approval contained in Resolution
No. PC-87-156.
Discussion
In addition to the material contained in the staff report,
staff would like to request the following language to be added
to City Engineer Condition No. 1 . c. :
"A meandering sidewalk shall be provided on Los Angeles
Avenue. The precise design and location shall be
approved by the City Engineer and Director of Community
Development. "
Community Development condition no. 2a ( last paragraph) should
be amended to read $17, 863 . 32 rather than $54, 757. 97 as
shown. This figure is derived from:
1. The applicant' s tree appraisal and inventory lists
$69, 757 . 96 worth of trees on the site.
2 . Of the $69, 757. 96, credit is given for trees located
• in areas where street dedication will be necessary.
This amounts to $39, 313 . 70 (tree nos . 9, 16,22, 23 ,
29, and 30) .

MOORPARK, CALIFORNIA, RECOMMENDING TO THE CITY COUNCIL CONDITIONAL
APPROVAL OF PLANNED DEVELOPMENT PERMIT NO. 1065, ON THE APPLICATION OF

(beginning at Section 21000)) , the Planning Commission of the City of Moorpark
approves the Negative Declaration.

1987 which report is incorporated herein by reference as though fully set
forth at this point and as amended orally at the public meeting, are hereby
adopted.
SECTION 3. The Commission hereby recommends to the City Council
conditional approval of Planned Development Permit No. 1065 subject to compliance
with all the conditions attached hereto. Violation of any such condition shall be
grounds for revocation of said permit and any other remedy which is available to the
City.

Michael Rubin gave an overview of the staff report dated October
29, 1987. The Council discussed how much architectural review
there was on this project which will be built fairly close to
ParkLane Center. The duly noticed Public Hearing was opened.
C-1. Mr. Colin Velazquez, 1078 Mellow Lane, Simi Valley, felt some of
the staff requirements were too restrictive.
The Public Hearing was closed when no one else wished to speak.
Discussion among the Council then ensued concerning the
sidewalks and tree landscaping on the Los Angeles Avenue
Corridor Area. Councilmember Brown indicated she supported the
Planning Commission' s recommendations for the project.
Councilmember Lane indicated he liked meandering sidewalks,
however, he was not sure trees which were about to die should be
the responsibility of the developer. Mayor Galloway also liked
the Planning Commission' s recommendations, and agreed with
Councilmember Lane concerning the trees. Councilmember Harper
felt the tree report should show which trees might be viable for
retention, and which should be removed.
Councilmember Brown asked if the money cited in the tree report
for the value of trees being removed could be applied to
additional landscaping for the project site. However, this
should not be applied until after the second tree report which
would also give an indication of which trees would remain and
which trees should be removed on the site.
MOTION: Councilmember Brown moved and Councilmember Lane
seconded a motion to approve the Negative Declaration as having
been completed in compliance with State CEQA Guidelines. The
voice vote was unanimous.
MOTION: Councilmember Brown moved and Councilmember Lane
seconded a motion to approve the recommendation of the Planning
Commission as stated in Resolution No. PC-87-156; to find that
the proposed uses were consistent with the purpose, intent,
guidelines, standards, policies and provisions of the City's
General Plan and Chapters 1 and 2 of the Ordinance Code; to find
that the proposed uses would not impair the integrity and
character of the zone in which they are to be located; to find
that the proposed uses were compatible with land uses permitted

within the General Plan land use designations and the zones in
the general area where the uses are to be located; to find that
the proposed uses would not be detrimental to the public
interest, health, safety, convenience or welfare; to find that

of Resolution No. PC-87-156; to direct staff to prepare the
appropriate resolution for Planned Development Permit No. 1065,
for consideration at Council ' s next meeting; to direct that no
asbestos pipe would be used; to direct that a second tree report
would be done and considered by the staff, with any difference
in the tree reports to be added to the landscaping to be done on
the project possibly in the way of better specimens and larger
specimens, with landscaping to stay on the property versus
street trees being planted somewhere else; to direct that a
meandering sidewalk be provided on Los Angeles Avenue whose
precise design and location would be approved by the City
Engineer and the Director of Community Development. The motion
was approved with Mayor Galloway voting no.
AT THIS POINT IN THE MEETING, the Council recessed. The time was 11:25 p.m.
At 11:43 p.m. , the Council reconvened.
AT THIS TIME, the agenda was reordered.
MOTION: Councilmember Lane moved and Councilmember Harper seconded a motion to
adjourn to the Rent Review Board. The voice vote was unanimous. The time was
11:46 p.m.
At 11:47 p.m. the Rent Review Board convened. All members of the Board were
present. There were no Speaker Cards.
Mobile Home Park Rent Review Board review of a proposed Villa Del Arroyo Rent
Increase.
MOTION: Board Member Harper moved and Board Member Brown seconded a
motion to approve the 2.6 percent increase proposed, and to determine
November 12, 1987, as the effective date of the increase. The voice
vote was unanimous.
MOTION: Board Member Lane moved and Board Member Brown seconded a motion to
adjourn the meeting. The voice vote was unanimous. The time of adjournment
was 11: 50 p.m.
AT 11: 51 P.M. , THE COUNCIL RECONVENED.
10. COMMENTS FROM COUNCILMEMBERS:
A. Consider membership on various City Council Committees.
Councilmember Brown commented the Council should take Mr.
Ferguson' s name off and either leave the appointment vacant
until February of 1988, or allow the alternate to take over
where there is an alternate. No further action was taken by the
Council .

Requested that the Planning Commission consider the
following:
Residential - encourage residential planned communities.
Commercial - restricted from a residential neighborhood,
no gas sales within the surrounding area.
Industrial - considerations should be made in maintaining
standards in environmental health, clean air,
maintenance/use hazardous/toxic waste or materials.
Traffic/Circulation - after the 118/23 connector is
accomplished the 118 could still be a problem to the Los
Angeles Avenue traffic circulation.
Other comments referenced hillside preservation,
hospital facility, more senior citizen housing, encourage
mobile home parks, and church site.
D. Rusty Beeler, representing West Oaks Realty, 299
Hillcrest Drive, Thousand Oaks. Promoted a change from 5ac
lots on his 350 acre parcel to lac lots. Future plans for
a golf course.
It was the general consensus of the Planning Commission to
continue the meeting of the General Plan Update to November 16th
for review of work task of the update by planning and public
works and study program and make its recommendation to the City
Council.
It was also requested by Commissioner Lawrason to keep an
updated map of locations and general plan amendment request.
8. PUBLIC HEARINGS (New Business)
A. Planned Development Permit No. 1065 - Colin Velazquez
Requesting approval of a 27,466 sq. ft. automotive center
(18, 102 sq. ft. , of service bays and 9, 356 sq. ft. of retail
space) . Located on the south side of Los Angeles Avneue
(approximately 250 feet west of Parklane Avenue) .
B. Planned Development Permit No. 1066 - Leonard Liston

bays and a 4-stall coin operated car wash. Located on the

The consensus of the Commission regarding Items 8.A & B. was to
hear both items together. The Senior Planner began with PD-1065
and proceeded with PD-1066 giving a brief overview of the staff
reports dated 10/5/87. Testimony received by the following:

Mr. Velazquez concurred with the following City Engineer
requirement:
The present site plan shows two points of access from Los
Angeles Avenue only. Among the City Engineer' s conditions
is a requirement that only one driveway be permitted on Los
Angeles Avenue and that it should be a minimum of 40 feet
wide. The two driveways shown are presently 25 feet and 30
feet. No access is presently proposed to the rear. Part of
the same City Engineer' s condition is to require a 30 foot
driveway to provide access to the south. This will provide
ultimate circulation to Park Lane Avenue and out to Los
Angeles Avneue.

The applicant proposed to use 36" box trees instead of the
required 24" as a credit towards replacement value of the
existing trees. Questioned a tree report imposed by the
City and its accuracy to the value of the 76 sited trees.
B. Bruce Labins, the applicants architect, 23935 Ventura
Blvd. , Calabasas, CA. 91311 . Concurred with the Commission
concern regarding a barrier for the adjacent property and
additional parking spaces.
PD-1065 related concerns were:
Establishing parking ratio for automotive repair service.
Hours of operation.
Setback requirements (related to visual impact, noise, odor,
etc. ) in relation to the 67 single family units which will
be adjacent to the proposed PD-1065 .
Increase landscaping.

Commissioner Butcher that a minimum wall of 8 feet be
provided to mitigate noise, odor, and visual impact to
the adjacent 62 single family homes and adjacent
church. Roofing shall be designed to accommodate
baffling or deflector to control noise.

Commissioner Butcher to require the developer to
continue noise deflector features to the service bays
at the east side of the property.

Chairman Montgomery that a 10% error factor at $49,000
be allowed on the submitted tree report.
Motion failed on a 1 : 3 : 1 vote.

Commissioner Wozniak to recommend conditional approval
to the City Council of Planned Development Permit No.
1065 as recommended by staff with modified and
additional conditions.
