SUBJECT: Consider Resolutions Adopting Revised Fees for the Use of
City Facilities and Revised Park Rental Fees, Deposits, and
Additional Charges, and Rescinding Resolutions No. 2009-
2792 and No. 2011-3057
SUMMARY
The Council is being asked to consider changes to the Resolutions governing City
indoor facility and park facility rental fees. The rental fees for indoor facilities (which
include the Moorpark Community Center and the Arroyo Vista Recreation Center) were
last amended in 2009 (Resolution 2009-2792). The fees for park facilities were last
amended in 2011 (Resolution 2011-3057). Attached to this report are draft resolutions in
legislative format detailing the proposed fees for indoor facilities and park facilities.
DISCUSSION
Rental fees are reviewed, evaluated, and revised on a periodic basis. Rental fees for
park facilities were last revised four years ago, and rental fees for indoor faculties were
last revised six years ago. The proposed rental fees are based on a variety of factors,
including demand for rental facilities within the City of Moorpark, operating costs when
available, and the market rate in neighboring park and recreation districts (based on a
survey of Conejo Recreation and Park District, Rancho Simi Recreation and Park
District, and Pleasant Valley Recreation and Park District, survey summary attached).
Rental fees are charged based on group classifications, which are defined in the Rules
and Regulations Governing the Rental Use of City Facilities (Resolution 2009-2792) and
the Rules and Regulations Governing City Park Rentals (Resolution 2011-3057). For
reference, these group classifications are described in Attachment D.
On the attached draft resolutions, current fees are listed in strike-through next to the
proposed fees. If there is no change to a fee, only the proposed fee is listed. The more
substantive proposed revisions to the fees are summarized below.

Revisions to the Fees for the Use of City Facilities
Section 2.2 Facility Use Fees
Proposed changes to this section include the following:
• Increasing room rental rates by 7-10% to account for increasing maintenance
and operating costs.
• Increasing gymnasium rental rates by 7-10% to account for increasing
maintenance and operating costs.
Section 2.4 Additional Charges
Proposed changes to this section include the following:
• Adding a permit application fee to cover staff costs associated with processing
indoor facility rental permits. This fee will be consistent with the proposed permit
application fee for processing park rental permits.
• Removing flat rate staff fees and adding language referring to City Council's Staff
Billing Rates Resolution for determining staff fees.
• Adding language to the law enforcement fees section, in order clarify when these
fees are charged and to be consistent with the language in the Park Rental Fees
Resolution.
Section 2.5 Non-Profit Organization Special Use
Proposed changes to this section include the following:
• Changing the language to reference the Non-Profit Organization Annual Facility
Reservation Policy in the City Council's Policies Resolution, and deleting the text
of the Policy, to avoid discrepancies if the Policy is amended.
Section 2.6 Youth Sports Organization Special Rate
Proposed changes to this section include the following:
• Adding language to clarify that the special rate is available only during days and
hours when the facility is ordinarily staffed.
Section Z7 Payment Schedule
This is a proposed new section. This section has been added to clarify when payment is
due for a rental permit, including rental permits with multiple rental dates. It also limits
the types of payment accepted for reservation applications that are submitted less than
ten business days in advance, and establishes a ninety day span for a rental permit.

Revisions to the Park Rental Fees, Deposits, and Additional Charges:
Section 2.2 Hourly Fees
Proposed changes to this section include the following:
• Increasing field light fees by approximately 10%, to cover increasing
maintenance and operating costs.
• Increasing picnic pavilion rental rates by $5 per hour (for small, medium, and
large picnic pavilions), and $25 per hour (for the Peppertree Pavilion at Arroyo
Vista Community Park), for consistency with rental rates in neighboring park
districts and due to increasing demand for pavilion rentals.
• Adding rates for the batting cages at Poindexter Park. Currently, there is no
rental rate established for this facility.
Section 2.3 Flat Rate Fees
Proposed changes to this section include the following:
• Modifying the permit application fee, to account for single and multiple day
rentals. The purpose of the permit application fee is to cover staff costs related to
processing rental permits. Currently, the fee is $10, regardless of how many days
or facilities are included on a permit. As larger permits require more staff time to
process, staff proposes retaining the $10 rate for single-day permits, and
increasing the fee to $20 for multiple-day permits.
Section 2.4 Payment Schedule
Proposed changes to this section include the following:
• Changes to the language to address multiple-day permits. Currently, the
language is written based on a rental date. Since many permits contain multiple
rental dates, collecting fees based on this schedule is cumbersome. The
language has been modified to establish payment due dates based on the first
rental date on a permit.
• Increasing the minimum rental fee amount which requires full payment at the
time of application. Currently, full payment is due at the time of application for
rental requests received less than thirty days in advance and for rentals with fees
totaling $50 or less, even if those rentals are received more than thirty in
advance. Increasing this amount to $200 is proposed.
• Limiting a single permit to a span of no more than ninety calendar days.
• Currently, there is no written rule limiting the length of time or number of rental
dates that may be included on a single rental permit. Limiting a single permit to a
span of no more than ninety calendar days allows for more easily managed
permits. This limit would not apply to youth sport organization permits under a
use agreement.

Section 2.6 Additional Charges
Proposed changes to this section include the following:
• Removing flat rate staff fees and adding language referring to City Council's Staff
Billing Rates Resolution for determining staff fees.
FISCAL IMPACT
Since the number of rentals fluctuates from year to year, and rentals may increase or
decrease based on changes to fees, an exact fiscal impact cannot be determined. If
historical usage remains the same, revenue from picnic pavilion rentals should increase
by 20-40% and revenue from indoor facility rentals should increase by 7-10%. New
revenue from permit application fees for indoor facilities is estimated at $600-$800 and
revenue from permit application fees for park facilities should increase by $800-$1,000.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, ADOPTING REVISED
FEES FOR THE USE OF CITY FACILITIES AND
RESCINDING RESOLUTION NO. 2002 20282009-2792
WHEREAS, the City has adopted a schedule of fees for the rental of City
facilities; and
WHEREAS, at its meeting of February 2009July 1, 2015 the City Council
reviewed and concurred with the amendments to the
Fees for the Use of City Facilities; and
WHEREAS, City Council Resolution No. 2002 20282009-2792 (Fee Schedule For
City Facilities) shall be rescinded and replaced with the Resolution herein.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. City Council Resolution No. 2002 20282009-2792 (Fee
Schedule for City Facilities) is hereby rescinded upon the effective
date of this Resolution-herein.
SECTION 2. FEES AND CHARGES. Fees and charges for the rental use of
City indoor facilities shall be as follows:
Section 2.1 Purpose
The purpose and intent of the City Council in adopting the Facility-Rental/Use-Fee
Schedule for Rental Use of Indoor Facilities shall be to provide directory
guidelines for staff and the public relating to the fees and deposits required to rent
City indoor facilities and amenities. Fees shall be charged based on Group
Classifications, as defined in the Rules and Regulations Governing the Rental
Use of City Facilities Resolution, as may be amended from time to time. The City
shall reserve the right to make adjustments or impose additional fees on a case-
by-case basis.
Section 2.2 Facility Use Fees
Fees are calculated on an hourly basis unless otherwise noted. Fees include one
(1) staff person for the duration of the rental.
A. AVRC Sycamore Room. Seating capacity: Up to158 seated with
tables and chairs, up to 340 seated theater style.
Community Center Apricot Room. Seating capacity: Up to 150 seated
with tables and chairs, up to 205 seated theater style.

Section 2.3 Refundable Security Deposits

Refunds of deposits are contingent upon meeting all the requirements for the
rental of the facility. All or a portion of the deposit may be retained for reasons as
described in Section 4.6 of the Rules and Regulations Governing the Rental Use
of City Facilities.
Section 2.4 Additional Charges
Additional charges over the basic rates are as follows:
A. Staff Fees: Charged when additional staff is— dare required for
rentals with attendance of 100 or more, when additional set up,
breakdown, or cleanup beyond normal time requirements is needed, or for
other special circumstances. Staff fees shall be charged in accordance
with the City Council's Staff Billing Rates Resolution, as may be amended
from time to time.
Full time staff fee: $15 per staff person, per hour
B. Law Enforcement Fees: Fees for law enforcement may be charged for any
rental requiring police services, as determined to be necessary by the
Director. Law enforcement fees shall be charged in accordance with the
City Council's Police Service Fees Resolution, as may be amended from
time to time.

C. Insurance Fees: Insurance fees shall be charged to Renter in accordance
with current rates as established by the City's current insurance provider.
Insurance fees may be waived for organizations and businesses who
provide insurance in accordance with Section 4.7 of the Rules and
Regulations Governing Rental Use of City Facilities.
D. Rental Permit Application Fee: Charged for each Rental Permit. Fee is
non-refundable.

Section 2.5 Non-Profit Organization Special Use

Policy in the City Council's Policies Resolution, as may be amended from time to

SECTION 2.6 Youth Sports Organization Special Rate
City of Moorpark Youth Sports Organizations that have a current use agreement
with the City may request a special rental rate of $25 per hour for use of any one

single room at the Moorpark Community Center or Arroyo Vista Recreation
Center, for a rental directly associated with the organization's business, such as
planning meetings, training sessions, and registration. A Reservation Application
and deposit must be submitted in accordance with the Rules and Regulations
Governing the Rental Use of City Facilities, and all other City fees, restrictions
and regulations apply. The special rate is available only during days and hours
when the facility requested is ordinarily staffed. Regular rental rates apply to any
rental use outside of normally staffed days and hours.
SECTION 2.7 Payment Schedule
Reservation dates on a Rental Permit may not span a time period of more than
ninety (90) calendar days. Payment for rental fees is due as follows:
A. Reservation Applications submitted more than thirty (30) days in advance
of the first rental date on the Rental Permit: A holding deposit must be
paid at time of application. All fees are due in full thirty (30) days prior to
the first rental date on the Rental Permit.
B. Reservation Applications submitted less than thirty (30) days in advance
of the first rental date on the Rental Permit: Applications submitted less
than thirty (30) days in advance require Director approval in order to be
accepted. Fees are due in full within one (1) business day of notification of
acceptance of application. For Reservation Applications submitted less
than ten (10) business days in advance, all fees must be paid via credit
card (Visa or MasterCard only), cashier's check, money order, or cash.
SECTION 3: This Resolution shall become effective on August 1, 2015.
SECTION 34. The City Clerk shall certify to the adoption of this resolution
and shall cause a certified resolution to be filed in the book of original resolutions.

Arroyo Vista Recreation Center and Moorpark Community Center rooms. Fees
shall be charged based on Group Classifications, as defined in the Rules and
Regulations Governing City Park Rentals Resolution, as may be amended from
time to time. The City shall reserve the right to make adjustments or impose
additional fees on a case-by-case basis as a determination of the approval of a

Park Rental Permit pursuant to Moorpark Municipal Code Section 12.16.140 and
the current City Council Resolution Adopting Rules and Regulations Governing
City Park Rentals. As used in this resolution, Director shall mean the City
Manager or his/her designee.

Moorpark non-profit organizations may receive a once-yearly special rental rate
in accordance with the Non-Profit Organization Annual Facility Reservation
Policy in the City Council's Policies Resolution, and as may be amended from
time to time.

Section 2.4 Payment Schedule
For Reservation Applications submitted more than thirty (30) calendar days in
advance of the first rental date requested, and with rental fees exceeding
$200.00, the Renter may submit partial payment of not less than $100.00, which
will be applied toward the rental fees. Payment of all rental fees is due in full
thirty (30) calendar days prior to the first rental date on the Rental Permit.
For Reservation Applications submitted thirty (30) calendar days or less before
the first rental date requested, full payment must be made at the time the
Reservation Application is submitted. For all rentals with rental fees totaling $50
200.00 or less, full payment must be made at the time the Reservation
Application is submitted.

Fees for Reservation Applications submitted less than ten (10) business days in
advance must be paid by credit card (Visa or MasterCard only), cashier's check,
money order, or cash. Personal checks will be accepted only when the
Reservation Application is submitted ten (10) or more business days in advance.
Reservation dates on a Rental Permit may not span a time period of more than
ninety (90) calendar days, except those Rental Permits issued to youth sports
organizations for use under an agreement with the City.
Section 2.5 Refundable Security Deposits
The following security deposit amount(s) shall be collected to ensure return of
rented equipment and protection of City property. All or a portion of the deposit
may be retained for the reasons specified in the City Council's Resolution
Adopting Rules and Regulations Governing City Park Rentals.

Section 2.6 Additional Charges
Additional charges over the basic rates are as follows:
A. Staff Fees: Staff fees will be charged when

or more people, or for special circumstances as described in the City
Council's Resolution Adopting Rules and Regulations Governing City Park
Rentals. Staff fees shall be charged in accordance with the City Council's

For all Groups, the Police service fee shall be consistent with the City

fifteen percent City general government overhead cost).

C. Insurance Fees: For Rentals which require insurance in accordance with
the City Council's Resolution Adopting Rules and Regulations Governing
City Park Rentals, insurance fees shall be charged to Renter in
accordance with current rates as established by the City's insurance
provider. Insurance fees may be waived if insurance documentation is
provided, including certificate of liability insurance and endorsement
naming the City of Moorpark as additional insured, in accordance with the
City Council's Resolution Adopting Rules and Regulations Governing City
Park Rentals.
D. Large Event and Large Venue Waste Management: Consistent with
Article V of Chapter 8.36, Solid Waste, of the City's Municipal Code, all
large events and large venues, as defined in Chapter 8.36, are subject to
the requirements of that Chapter, including the requirement for a waste
management plan and a waste management fee as established by
resolution of the City Council.
E. Other Charges: Additional charges may be levied for rental requests
containing unusual activities or accommodations as determined by the
Director.
Section 2.7 Cancellation Fees
Rental fee refunds for park rental cancellations are subject to the provisions
established in the City Council's Resolution Adopting Rules and Regulations
Governing City Park Rentals, which includes description of deductions for the
Processing Fee and Cancellation Fee. The amount of the Processing Fee is
included under Section 2.3, Flat Rate Fees. The amount of the Cancellation Fee
for a late cancellation, as described in the Rules, shall be as follows:

GROUP CLASSIFICATION DEFINITIONS
GROUP 1: City co-sponsored programs. When deemed a community benefit, the
City, at its sole discretion, may co-sponsor an activity or event. Rental fees may be
charged for City incurred direct costs, including but not limited to utilities, City staff
costs, police service costs, security, damage to City property, or any other direct cost
incurred by the City.
GROUP 2: Residents of the City of Moorpark, certain nonprofit organizations based in
the City of Moorpark, and governmental agencies serving the residents of the City of
Moorpark for purposes where an entrance or other fee for participation is not charged
and no product is sold for profit, with the exception of a nonprofit organization
fundraising event.
• The designation of City of Moorpark resident applies to individuals who live within
the incorporated Moorpark City boundary. Proof of residency will be required.
• The designation of a Moorpark nonprofit organization applies to those with
current tax exempt status under Section 501(c)(3), 501(c)(4), 501 (c)(6), 501
(c)(19) of the U.S. Revenue Code and chartered within the limits of the City of
Moorpark. Proof of 501 (C) status will be required.
• The designation of governmental agency directly serving the residents of
Moorpark applies, but is not limited, to the following agencies: Moorpark Unified
School District, Moorpark College, Ventura County Water Works District I,
County of Ventura, Ventura County Superintendent of Schools, and agencies of
similar status as determined by the Director's sole discretion.
• For field rentals, a minimum of 51% of those attending the rental must be City of
Moorpark residents in order for the Renter to be classified under Group 2.
GROUP 3: Residents of the Moorpark Unified School District boundaries that reside
outside of the City's incorporated limits; non Moorpark nonprofit organizations,
Moorpark businesses and commercial for-profit organizations for purposes where an
entrance or other fee for participation is not charged and no product is sold for profit,
