SUBJECT: CONSIDER CLARIFICATION OF THE BUILDING AND SAFETY
CONTRACT BETWEEN THE CITY OF MOORPARK AND CHARLES ABBOTT
& ASSOCIATES
Background:
The Council may recall that on January 23 , 1989 the City approved
a contract for Building and Safety Services with Charles Abbott and
Associates (Abbott) . The essence of the contract was that Abbott
would provide plan check, building inspection, and related services
for a percentage of the plan check and permit fees.
In 1992 the permit activity had slowed to a level that Abbott
claimed could not sustain their services and the City opted to use
the General Fund to subsidize Abbott for two months at $5, 000 per
month. Abbott repaid the City on December 19, 1993 from their
share of the cap.
Discussion:
As a result of the City's financial involvement in 1992 , the City
established a parameter with Abbott in which both parties agreed to
limit the building inspector's time to four (4) hours a day. This
has worked well in the past two years and a "cap" of $141, 000 has
resulted. The money is due to Abbott for future inspection and
related services for currently active permits.
The construction activity has been slowly increasing, but the
Building Department has sometimes been forced to postpone
inspections due to the four (4) hour a day rule. Abbott has
consequently requested that the four (4) hour limit be removed.
Abbott has exceeded the four (4) hour time limitation in the past
several months and staff has consistently excluded charges by
Abbott's inspector which exceed the four (4) hour limitations.

The Budget and Finance Committee reviewed the issue on January 10,
1994 and recommends that Abbott could be given a greater leeway on
the hours per day being allocated to inspection services under the
following conditions:
1. That Abbott acknowledges full financial responsibility for
inspections, plan check and related services per the Contract
until the last inspection is made for which permits have been
issued by Abbott, and;
2 . That the Community Development Director will consult with
Abbott's staff concerning the number of inspections hours
needed; and
3 . That the Community Development Director may authorize a
biweekly (same biweekly period as City's payroll) total not to
exceed a total of 60 hours for inspection related services.
The hours necessary for those services provided by Abbott's
permit technician/secretary will also be bugeted in the same
manner and with a 60 hour biweekly cap.
Recommendation:
Concur with these changes and clarification to Abbott's Building
and Safety Agreement, and direct staff to obtain a written
concurrence from Abbott.
