This request is to adjust the property lines between parcels 2 through 6 of Tract 4341, all of which are owned by Urban West Communities. These lots currently contain the Belmont Models. The purpose of these Lot Line Adjustments are to adjust the property lines to ensure setback compliance with the model homes and to match the location of the already completed walls. All lots conform with all of the requirements of the Residential Planned Development zone. All required legal documents have been reviewed by the City Engineer. The Community Development Department has reviewed the request and determined that it meets all applicable codes and resolutions. 0 () U () 31 The Director of Community Development approved the Lot Line Adjustment on September 8, 1995, with the appeal period ending September 25, 1995. Pursuant to Resolution 95 -1135 the Director has the authority to approve Lot Line Adjustments. This matter is being presented to the Council as a courtesy. Should the Council, or any other party, desire to appeal the Director's decision, the item should be scheduled for a regular Council meeting. The next available hearing date is October 4, 1995. If the Council takes no action, the Director's decision will become effective on September 25, 1995. Staff Recommendation Receive and file this report. Attachments: 1. The agoroval expires in 180 days unless the attached exhibits are recorded at the Ventura County recorders Office prior to the expiration date. FINDINGS: This Lot Line Adjustment complies with the City of Moorpark Municipal Code in that neither a greater nor a lesser number of parcels than originally existed has been created and all the resulting lots will conform to all applicable zoning, General Plan, and Specific Plan requirements. COMPLIANCE WITH CALIFORNIA ENVIRONMENTAL QUALITY ACT: This Department has reviewed the project and found it to be categorically exempt according to Section 15305 of the State Environmental Impact Report Guidelines (Class 5: Minor Alterations in Land Use Limitations). 000033 RIGHT TO APPEAL: Pursuant to Section 17.44.090 of the City of Moorpark Municipal Code, any aggrieved party may appeal this Lot Line Adjustment approval within sixteen calendar days after such approval. Such an appeal must be made by filing an appeal form and submitting the required fee with the Department of Community Development of the City of Moorpark. Appeal forms may be obtained from the Department of Community Development. If an appeal has been timely filed, the Department of Community Development will schedule a hearing date before the Planning Commission to review the matter at the earliest convenient date.
