S AGENDA REPORT ACity of Moorpark �� To: The Honorable City Council From: Jaime Aguilera, Director of Community Developmg4j Prepared by Craig Malin, Assistant Planner Date: September 8, 1995 (CC meeting September 20, 1995) Subject: Consider approval of a Resolution approving Minor Modification No. 3 to Residential Planned Development Permit No. 89 -3 (Moorpark Presbyterian Church) to allow a third modular building to be used as a classroom and to allow a time extension. Background On July 25, 1990 the City Council approved Resolution No. 90 -699 to allow the construction of a 23,161 square foot church. Minor Modification No. 1 was approved on April 17, 1991 for minor alterations in the building plans. Minor Modification No. 2 was approved on November 6, 1991 to modify the project phasing, parking lot design, landscape plan modifications, and to place two portable buildings on site to be used as classrooms. The classrooms were approved with a condition requiring that they be removed in five years (November 6, 1996). Discussion This Minor Modification consists of two requests. The first request is to allow the placement of a third modular building to be used as a temporary classroom. The building will be located adjacent and to the east of the two existing modular classrooms. This location will not be visible from Spring Road, but is visible from Peach Hill Road as are the two existing classrooms. The building will be 24' by 60' in size and be painted tan with dark green trim, which matches the two existing classrooms. The applicant is also requesting that the date for removal of the existing temporary classrooms be changed to five years from occupancy of the third classroom. If approved, this would mean that all three classrooms would have to be removed within five years after occupancy of the third classroom. Although the Director has the ability to approve the placement of temporary structures, it has been City practice to have the Director defer any request for any time extensions to the City Council. This Minor Modification request meets all applicable Zoning Code requirements. This Minor Modification request will be conditioned to require that: 1) A landscape plan prepared by a California licensed landscape architect is to be submitted to the Community Development Department. The landscape plan is to be approved by the Director of Community Development. Additional landscaping shall be planted adjacent to Peach Hill Road and on the corner of Spring Road and Peach Hill, and around the perimeter of the new classroom. 2) Approval of a Zoning Clearance and landscape plan is required before the building can be placed on the site. 3) All portable buildings on the site must be removed within five years from the date of approval of this Minor Modification. 4) Failure to inaugurate this Minor Modification in twelve months or less from the date of approval will render this Modification null and void. This proposal has been reviewed by the Director of Community Development, who is deferring action on this application to the City Council in accordance with the established practice regarding time extensions.
