Bobardt, Community Development Directo , d Dave Klotzle, City Engineer/Public Works Director DATE: July 28, 2015 (CC Meeting of August 19, 2015) SUBJECT: Consider Response to Final Report of the Ventura County Grand Jury 2014-2015 on Countywide Bicycle Safety BACKGROUND/DISCUSSION On June 1, 2015, the Ventura County Grand Jury provided the City Council and City Manager with a Final Report of its investigation entitled, "Countywide Bicycle Safety." The Grand Jury report has required a response from the City Council on the findings and recommendations within 90 days of its provision (August 29, 2015). A form was provided for the response. Staff has provided the attached draft response to this report for City Council consideration. Responses on the Grand Jury's findings related to law enforcement activities and causes of bicyclist deaths and injuries are deferred to the Sheriffs Office (also serving as Moorpark Police Department), which also has been required to respond to this report. STAFF RECOMMENDATION 1. Approve the draft responses to the Grand Jury report findings and recommendations and authorize the Mayor to sign and submit the responses to the Presiding Judge of the Superior Court. 2. Direct staff to implement the direction of the City Council contained in the draft responses. Parvin, Mayor City of Moorpark CC ATTACHMENT Number of pages attached: 3 8 5 August 20 City of Moorpark City Council Responses to Grand Jury 2014-2015 Report on Countywide Bicycle Safety Page 1 GRAND JURY REPORT FINDINGS (in italics) AND CITY OF MOORPARK CITY COUNCIL RESPONSES GRAND JURY FINDING Fl-01: Throughout the County, law enforcement personnel rarely enforce helmet laws. They do not enforce bicycle licensing ordinances. CITY COUNCIL RESPONSE TO FINDING FI-01: Law enforcement services in the City of Moorpark are provided by the Ventura County Sheriffs Office. The Grand Jury report requires the Sheriffs Office to separately respond to this finding of the Grand Jury. The City Council defers to the response provided by the Ventura County Sheriff's Office on the enforcement of helmet laws and bicycle licensing. The City Council agrees with the Sheriffs Office response that the Moorpark Municipal Code provisions related to the licensing of bicycles are not actively enforced in the City of Moorpark. GRAND JURY FINDING FI-01. Licensing or registering bicycles with the police assists in the return of lost or stolen bicycles to owners, thereby reducing the number of unclaimed bicycles. CITY COUNCIL RESPONSE TO FINDING FI-02: Law enforcement services in the City of Moorpark are provided by the Ventura County Sheriffs Office. The Grand Jury report requires the Sheriffs Office to separately respond to this finding of the Grand Jury. The City Council defers to the response provided by the Ventura County Sheriffs Office on the efficacy of licensing bicycles in the ability to reclaim lost or stolen bicycles. GRAND JURY FINDING FI-05. Of all the factors contributing to bicyclists'deaths and injuries, motor vehicle driver error is the most prevalent. Rear-ending of cyclists is the most common error. CITY COUNCIL RESPONSE TO FINDING FI-0S: Law enforcement services in the City of Moorpark are provided by the Ventura County Sheriffs Office. The Grand Jury report requires the Sheriffs Office to separately respond to this finding of the Grand Jury. The City Council defers to the response provided by the Ventura County Sheriffs Office on the finding as to the causes of bicyclists' deaths and injuries. 86 August 20 City of Moorpark City Council Responses to Grand Jury 2014-2015 Report on Countywide Bicycle Safety Page 2 GRAND JURY REPORT RECOMMENDATIONS (in italics) AND CITY OF MOORPARK CITY COUNCIL RESPONSES GRAND JURY RECOMMENDATION R-01. The Grand Jury recommends that the County Board of Supervisors and the city councils of all the cities within the County encourage their respective law enforcement personnel to increase enforcement of bicycle and related motor vehicle laws. CITY COUNCIL RESPONSE TO RECOMMENDATION R-01: The City Council of the City of Moorpark agrees with this recommendation. The City of Moorpark encourages the Ventura County Sheriff's Office to provide the highest level of law enforcement services to the City including enforcement of bicycle and related motor vehicle laws. GRAND JURY RECOMMENDATION R-02. The Grand Jury recommends that the County Board of Supervisors and the city councils of all cities within the County that do not already have a Bicycle Advisory Commission/Committee establish one to perform such tasks as: • Identify roads in need of bicycle lanes • Research federal, State, and other funding sources for projects related to bicycle infrastructure and use • Issue motor vehicle and bicycle public safety announcements • Promote use of bicycles as a viable form of transportation and for health and ecological reasons • Offer safety education and bike rodeos for children • Provide liaison between city councils, transportation agencies, and the community on bicycle- related issues and concerns • Assist in the development and dissemination of educational materials related to bicycle laws and safety • Review and comment on private development plans that include bicycle facilities or have an impact on bicycle safety and access • Review and promote the enforcement of city and State laws related to bicycle safety • Encourage the public to register bicycles and keep a record of the serial numbers to facilitate the return of stolen or lost bicycles. CITY COUNCIL RESPONSE TO RECOMMENDATION R-02: The City Council of the City of Moorpark agrees with this recommendation.The Public Works and Transportation Committee is a standing committee of the City Council, scheduled to meet on a monthly basis. Bicycle related topics are considered by the Committeeas needed and may include the involvement of the Ventura County Sheriffs Office, members of the public, and bicycle community advocates. In addition to this committee,each year, the Planning Commission, Public Works and 8 7 Transportation Committee, and City Council all review the City's Capital Improvement Program,which August 20 City of Moorpark City Council Responses to Grand Jury 2014-2015 Report on Countywide Bicycle Safety Page 3 includes bicycle transportation improvement projects. The City and Sheriffs Office both already address the educational outreach listed items in this recommendation. Finally,the City has applied for and received State BTA grants for bicycle lanes on Princeton Avenue and TDA Article 3 grants for studying bicycle improvements to Collins Drive and Arroyo Drive. GRAND JURY RECOMMENDATION R-03. The Grand Jury recommends the County Board of Supervisors and the City Councils of all cities within the County, continually promote bicycle laws and safety to people of all ages, concentrating on school-age children through events such as bike rodeos, bicycle rallies, and other educational activities. CITY COUNCIL RESPONSE TO RECOMMENDATION R-03: The City Council of the City of Moorpark agrees with this recommendation. The Ventura County Sheriffs Office promotes bicycle laws and safety to the Moorpark community and school children through the School Resource Officer, Beat Coordinator,and with special events. GRAND JURY RECOMMENDATION R-04. The Grand Jury recommends the County Board of Supervisors and the City Councils of all cities within the County use local media (e.g., public service announcements, public events, and government websites) to educate the motor vehicle driving public and bicyclists of their responsibility to know and obey bicycle- related laws. CITY COUNCIL RESPONSE TO RECOMMENDATION R-04: The City Council of the City of Moorpark agrees with this recommendation. The City newsletter includes general pedestrian and bicycle safety information at the start of each school year. In the next six months,the City will include bicycle law and safety information on the City website. Any special bicycle safety events hosted by the City or the Ventura County Sheriffs Office will be promoted on the City website as well. 88
