CITY OF MOORPARK,CALIFORNIA City Council Meeting ACTION: /, ,, MOORPARK CITY COUNCIL , AGENDA REPORT BY: .e (' TO: The Honorable City Council FROM: Jeremy Laurentowski, Parks and Recreation D', ectolffj� BY: Jessica Sandifer, Senior Management Analy 1 DATE: August 11, 2015 (CC Meeting of 08/19/15) SUBJECT: Consider Response to Final Report of the Ventura County Grand Jury 2014-2015 on Detention Facilities and Related Law Enforcement Issues BACKGROUND/DISCUSSION On June 1, 2015, the Ventura County Grand Jury provided the City Council and City Manager with a Final Report of its investigation entitled, "Detention Facilities and Related Law Enforcement Issues." The Grand Jury report has required a response from the City Council on the findings and recommendations within 90-days of receiving the report. A form was provided for the response. Staff has provided the attached draft response to this report for City Council consideration. STAFF RECOMMENDATION 1. Approve the draft responses to the Grand Jury report findings and recommendations and authorize the Mayor to sign and submit the responses to the Presiding Judge of the Superior Court; and 2. Direct staff to implement the direction of the City Council contained in the draft responses. (Attach a statement specifying any portions of the findings that are disputed; include an explanation of the reasons therefore.) RECOMMENDATIONS • Recommendation numbered R-11 has not yet been implemented but will be implemented in the future. Parvin, Mayor Number of pages attached: 1 90 August 19 City of Moorpark City Council Responses to Grand Jury 2014-2015 Report on Detention Facilities and Related Law Enforcement Issues Page 1 GRAND JURY REPORT FINDINGS (in italics) AND CITY OF MOORPARK CITY COUNCIL RESPONSES GRAND JURY FINDING FI-07: Proposition 47's consequence, both intended and unintended, are only beginning to be evaluated. Early indications are that it may be successful in reducing the State prisoner population, but the effects on the local law enforcement agencies and communities are yet to be understood. CITY COUNCIL RESPONSE TO FINDING FI-07: The Ventura County Sheriffs Department (VCSD) is the contract law enforcement agency for the City of Moorpark. VCSD, who has also been asked to comply with Fl-07, should be tasked with keeping these statistics as a part of their compliance with the finding county-wide. The City Council will request an annual report from the VCSD on statistics specific to Moorpark, but feel that VCSD should be the agency responsible for collecting and maintaining this information for Moorpark. GRAND JURY REPORT RECOMMENDATIONS (in italics) AND CITY OF MOORPARK CITY COUNCIL RESPONSES GRAND JURY RECOMMENDATION R-02. The Grand Jury recommends that the Sheriff's office, probation, and City Councils closely track and evaluate the impact of Proposition 47 on local law enforcement agencies and communities and report findings to the Board of Supervisors. CITY COUNCIL RESPONSE TO RECOMMENDATION R-02: VCSD is the contract law enforcement agency for the City of Moorpark. The City Council does not believe it is reasonable for the City to track the information due to the fact that the statistics will be tracked by VCSD. As such, VCSD will track the information and provide an annual report to the City Council. GRAND JURY RECOMMENDATION R-11. The Grand Jury recommends that the Moorpark City Council upgrade the Moorpark Police Service Center lavatory used for detainees with tamper-proof fixtures of the type commonly found in holding cells. CITY COUNCIL RESPONSE TO RECOMMENDATION R-11: Plumbing fixtures in the restroom that serves detainees will be outfitted with tamper resistant fixtures no later than September 30, 2015. 91
