MOORPARK CITY COUNCIL ACTION:
AGENDA REPORT
d.d ` 13.4
TO: Honorable City Council ,/)
FROM: David A. Bobardt, Community Develo• t Director
By:
By: Ramon Young, Building Official I
DATE: August 24, 2015 (CC Meeting of 9/2/2015)
SUBJECT: Consider Ordinance Amending Title 15, Buildings and Construction,
of the Moorpark Municipal Code, by Adding Chapter 15.21 — Small
Residential Rooftop Solar Energy Systems, and Determination that
the Creation of an Expedited, Streamlined Permitting Process for
Small Residential Rooftop Solar Energy Systems is Exempt from the
Provisions of the California Environmental Quality Act
BACKGROUND
Assembly Bill 2188, which amends the California Solar Rights Act, requires that on or
before September 30, 2015, every city must adopt an ordinance that creates an
expedited, streamlined permitting process for small residential rooftop solar energy
systems. The purpose of the law is to further State policy of promoting and encouraging
the installation and use of solar energy systems by limiting obstacles to their use, and
minimizing the permitting costs of such systems.
DISCUSSION
Currently, City Building and Safety staff reviews residential solar permit applications
over the counter and issue permits administratively on the same day. Permit
applications are not accepted electronically or with electronic signatures. State
legislation under Assembly Bill 211 requires the City to adopt an ordinance for the
review of small residential rooftop solar energy systems, including both photovoltaic
electrical systems (no larger than 10 kilowatts alternating current) and water heating
systems (30 kilowatts thermal) for detached and duplex homes. The required ordinance
compels the City to do the following for small residential rooftop solar energy systems:
• Adopt a checklist of all requirements with which the systems must comply to be
eligible for expedited review.
• Substantially conform its permitting process, including checklists and standard
plans, with the most current version of the California Solar Permitting Guidebook,
published by the Governor's Office of Planning and Research.
• Make the permit application available on the City's website.

• Accept electronic submission and electronic signatures for the permits
documents.
• Approve applications that meet all of the checklist requirements administratively
by the Building Official or assigned staff.
• Have only one inspection for small residential rooftop solar systems, unless the
system fails the inspection.
The attached draft ordinance would add Chapter 15.21 to the Moorpark Municipal Code
to achieve compliance with these requirements of State law. Reference is made to
State law wherever possible so that any changes to State law would not necessarily
require changes to the Municipal Code. This draft ordinance has been reviewed and
approved as to form by the City Attorney's Office.
ENVIRONMENTAL DETERMINATION
This ordinance with the proposed addition of Chapter 15.21 — Small Residential Rooftop
Solar Energy Systems, to Title 15, Buildings and Construction, of the Moorpark
Municipal Code, which creates an expedited, streamlined permitting process for small
residential rooftop solar energy systems, is exempt from the provisions of the California
Environmental Quality Act (CEQA), in that the action of the City Council does not
involve the consideration of the approval of a project.
FISCAL IMPACT
None.
STAFF RECOMMENDATION
Introduce Ordinance No. for first reading, waive full reading, and direct staff to
schedule a public hearing and second reading and adoption of this ordinance for
September 16, 2015.
