HomeMy WebLinkAboutAGENDA REPORT 1994 0105 CC REG ITEM 08I / 3 ITEM a • AGENDA REPORT / ,S 7s99 CITY OF MOORPARK i TO: THE HONORABLE CITY COUNCIL FROM: Dirk Lovett, Assistant City Engineer hC/ DATE: December 20, 1993(Council Meeting of January 5, 1994) SUBJECT: Resolution of Intent to Vacate A Portion of Science Drive; Vacation No. V-94-1 (Affects Parcel Map No. 3828) OVERVIEWz This item asks the City Council to consider a request to vacate a portion of Science Drive and initiate vacation proceedings by a resolution declaring its intention to vacate and setting a public hearing for the matter. BACKGROUND On September 14, 1993 the City Council approved Industrial Planned Development Permit No.93-1 providing for the development of Parcels 5, 6 and 7 of Parcel Map 3828. The proposed development showed the realignment of a portion of the cul-de-sac of Science Drive. To effect the development as approved requires the vacation of a portion of the existing right-of-way of Science Drive and acceptance of an offer of dedication, for street and public utility purposes, of a portion of the adjacent property(Lot 7) . These actions were anticipated early and included in a request to vacate in correspondence dated June 4, 1993(copy included) from the developer's consultant. As provided by Section 8320 of the Streets and Highways Code the City Council may initiate proceedings to vacate, upon request of an interested person, by adopting, a resolution of intention to vacate. Such request has been made as cited above. As required by Section 65402 of the Government Code, no street shall be vacated until the Planning Commission has reported on the proposed location, purpose and extent as to conformity with the Moorpark General Plan. By Planning Commission Resolution No. 286 1 adopted at its meeting of December 6, 1993 this proposed vacation was found to be in conformance with the Moorpark General Plan. As required by Section 2381 of the Streets and Highways Code rights-of-ways established for other purposes shall not be abandoned unless the governing body determines that the rights-of - way are not useful as a non-motorized transportation facility. The Planning Commission considered this matter at the time it studied conformity with the Moorpark General Plan. It found, and in its Resolution No. 286 recommended to the City Council to find, that the proposed vacation was not necessary for a non-motorized transportation facility. DISCUSSION: This vacation proceeding is proposed to be undertaken in accordance with Division 9, Part 3(Public Streets, Highways, and Service Easements Vacation Law) , of the Streets and Highways Code(commencing with Section 8300 et seq) which provides a procedure and requirements for vacating streets. Taking this recommended action does not result in the vacation of any portion of Science Drive and is not the final action necessary to accomplish this vacation. This resolution states your intention to vacate and sets a public hearing on the matter. Upon receiving testimony at the hearing you must then make certain findings of fact after which you may adopt a resolution of vacation. The resolution of vacation may provide for the reservation of public service easements and may include other conditions as this body finds necessary. Also it may provide that the resolution not be recorded until the conditions have been satisfied. Upon recordation of the resolution of vacation by the City Clerk in the Office of the County Recorder the vacation is complete. As there are existing facilities within the area proposed to be vacated, the owners and/or operators have been advised of this request to vacate. Responses have been received from all and no companies have indicated that they object to such vacation. All have indicated that if the existing right-of-way is vacated they desire that the City retain suitable public service easements for their existing facilities if satisfactory arrangements cannot be made to relocate existing facilities. The developer's consultant has indicated that efforts are in progress to arrange for relocation of all existing facilities, which if accomplished to the satisfaction of the respective utility company, would negate any need to reserve public service easement(s) in the resolution of vacation. 2 The developer's consultant has indicated that the developer(owner), proposes to grant the City an easement for vehicular access over portions of its property as necessary to construct an equivalent cul-de-sac. Proposed legal descriptions for this offer of dedication have been prepared and are currently under review by the City Engineer's office. The earlier approval of the IPD permit for this project included a condition that the cul-de-sac be designed to the satisfaction of the City Engineer. Detail designs have been proposed, but final approval has not been given. The engineering staff will consider only designs that conform to established standard drawings for cul - de-sacs or which meet currently accepted criteria for the design of roadways of this type and classification. The concept drawings conditionally approved with the IPD Permit show the roadway terminating with "enriched^ avement, landscape and hardscape elements. Should the final design approved by the City Engineer include these "enriched" elements within the dedicated right-of-way, any recommendation for final approval of a resolution of vacation would include, as a condition of approval of the resolution, a recommendation that the property owner(heirs and assigns) enter into agreement with the City to assume responsibility for the maintenance of this portion of the roadway. $ECOMMENDATION: Adopt the attached resolution of intention declaring the City Council's intention to vacate a portion of Science Drive and setting forth the time, date and place for a public hearing on the matter. 3 PALOS VERGES ESTATES (310) 373-255e RAYMOND L.
