Lindley, Assistant to the City December 28, 1993 Manager Consider Approval of the Ground Lease Agreement with VCTC for the Metrolink Park and Ride Facility The south Metrolink parking lot is located on property owned by the Ventura County Transportation Commission (VCTC). The Commission purchased this property with rail bonds. With the approval of VCTC, the City constructed a parking lot (Park and Ride facility) on the property with a Caltrans grant, TDA funds, and funds from the City's Traffic Mitigation Fund. Originally, VCTC intended to transfer ownership of the property to the Southern California Regional Rail Authority (SCRRA). VCTC has since decided to retain the property. It is therefore necessary for the City to enter into a lease agreement to document its relationship with VCTC regarding the property. The Lease Agreement outlines the terms by which the City will lease the property. The property will be used for a Park and Ride facility and other related transit activities. The City may, with prior approval of VCTC, use the property for non - transit related activities as long as it does not interfere with existing transit activities. The City will be responsible for all maintenance and optional improvements on the property. Any revenues received by the City from activities or business concessions on the property will be retained by the City to be spent for maintenance, security, overhead, and enhancements of the property. The initial term of the Agreement is ten years at a payment of $1.00. This term matches the term in the City's Agreement with Caltrans for the grant funds used to build the Park and Ride facility. Thereafter, the Lease will be automatically renewed, subject to termination, on an annual basis at a cost of $1.00 per year. Recommendation Staff recommends that Council approve the Ground Lease Agreement with VCTC for the Metrolink Park and Ride Facility and authorize the Mayor to sign the Agreement.
