SUBJECT: Consider Resolution No. 94 - 1) Approving the
Engineer's Report for Assessment District AD85 -1;
2) Declaring Intention to Make Certain Changes to and
Ordering the Annual Assessments for Said Assessment
District for FY 1994/95; and, 3) Setting the Dates and
Times of a Public Meeting and a Public Hearing to Consider
Said Assessments.
OVERVIEW
This presents for approval a Resolution approving the Engineer's
Report for Assessment District AD85 -1 and setting the date of a
Public Meeting to discuss the proposed assessments for AD 85 -1 for
FY 1994/95, and a public hearing to consider the levy of assessments
for said District for next fiscal year
The amount of the assessments proposed in the Engineer's Report are
based on a preliminary budget and Fund Activity detail which has
been developed by staff. That and other related information is
attached hereto and identified as tollows-,

BACKGROUND
Assessment District 85 -1 was formed in 1985 pursuant to the
provisions of the "Landscaping and Lighting Act of 1972." This
assessment district was established to allow for the funding of
parks maintenance expenses through the levying of assessments as
provided for in the act. As set forth in the Engineer's Report
(Exhibit "D "), costs are spread to all of the lots in the City by
means of a formula designed to spread said costs on the basis of
benefit. The formula uses land use as i measure of "people use" in
determining the amount of benef.tit.

The City must annually act to Levy the parks maintenance
assessments. Said assessments have been levied each year since the
formation of the district, except for FY 1987/88 and FY 1988/89.
DISCUSSION
A. Resolution of Intent
On January 5, 1994, the City Council adopted Resolution No. 94-
995 initiating the proceedings required to consider the levy of
assessments for subject assessment district for FY 1994/95. On
that date the City Council also selected the firm of Dwight
French and Associates to prepare the Engineer's Report for the
district.
B. Preliminary Budget for FY 19995
Attached as Exhibit 'C' is a copy of the preliminary budget for
the Parks Department budget for FY 1994/95. The expenditures
set forth in that Exhibit are based on the following
assumptions:
1. FY 1994/95 Budget -- As shown in the Budget recap attached as
Exhibit 'C', the total proposed budget for the Parks
Department for FY 1994/95 is $519,417. It is anticipated
that this level of expenditures is required to fund the scope
of work and level of effort to provide maintenance to all of
the City Parks. A recap of that effort is as follows:

The difference between the Budget and projected actual
figures is $28,969. This cost overrun is primarily due to
unanticipated irrigation wat(r -ost.s.
3. Significant Budget Variances Between FY 1993/94 and FY
1994/95 -- The proposed FY 1994/95 Budget of $519,714 is
$45,662 more than the approved FY 1993/94 Budget of $474,052.
The majority of these cost increase are listed as follows:
a. Contract Costs ($8,720): The budget amount for contract
maintenance was increased due an increase in the
maintenance period for Virginia Colony Park from nine (9)
months to twelve (12) months and Arroyo Vista Community
Park from ten (10) months to twelve (12) months.
b: Utilities ($33,250): It is recommended that the amount
budgeted for utilities be increased from $41,750 to
$75,000 ($33,250 increasei tc. more accurately reflect the
Projected Actual FY 1993/)4 year -end costs for this line
item ($80,000). The majority of these utility cost
increases arE' for irrigation water.

C. Fund Activity
Attached for your information as Exhibit 'B', is a summary of
Fund Activity for AD 85 -1 for FY 1992/93, FY 1993/94 and
FY 1994/95.
D. Tentative Assessment Summary
Attached as Exhibit 'A' is a chart comparing the recommended
Single- Family Residential assessment for FY 1994/95 to the
amounts assessed in past years. A summary of some of the FY
1994/95 assessment information set forth in Exhibit 'A' is as
follows:
• The total amount of anticipated expenses is $519,714.
• The total amount of the proposed assessment is $557,964.
• The amount of the proposed assessment includes an additional
$38,250 to repay a loan from the General Fund in accordance
with action taken by the City Council on March 2, 1994.
• The amount of the Single- Family residential assessment
required to generate $557,964 iS $`1.88.
• In the event the City Council wishes; to consider reducing the
amount of the assessment, a number of lesser assessment
amounts are listed on Exhibit 'A', along with the amount of
the fund transfer -in required to fund the difference between
the total assessments and thE' projected expenditures.
E. General Fund Transfer
As shown on Exhibit 'A', the amount of' the General Fund transfer
approved by the City Council last year was $112,620. As also
shown on Exhibit 'A', in order to fund the total anticipated FY
1993/94 year -end expenditures of $503,012, it is anticipated
that the final amount of the General. Fund transfer will be
$146,015, an increase of $3:3,395. 'This amount is slightly less
than the $38,250 General Fund appropriation approved by the City
Council on March .1, 1994. As discussed above, a number of
alternative Genera! Fund transfers are shown at the bottom of
Exhibit 'A' along with the resultant reduced amount of
assessments required and an estimate of the revised Single-
Family Residential assessment t o r Each.

1'. Engineer's Report
The above described expenditure information was provided to the
Assessment Engineer to be used as the basis for the preparation
of the attached Engineer's Report (Exhibit 'D'). Said report
sets for the proposed amount of the assessment for FY 1994/95
for various land use categories, along with an explanation of
the Benefit Assessment Formula and other related information.
G. Public Hearing
1. The "Landscaping and Lighting Act of 1972" (Streets and
Highways Code) requires a public hearing to be held prior to
the annual levy of assessments for the purpose of receiving
input and to hear any protests to the proposed assessments.
2. If the amount of the assessments are to remain the same, the
law does not require a Notice of the public hearing to be
mailed to each property being assessed. However, consistent
with past practice, it is recommended that a notice of the
public hearing be mailed to the owners of all of the affected
properties.
3. Notwithstanding the above mentioned policy, State law
requires that prior to considering any new or increased
assessment, a public hearinq notice must be mailed to the
owners of the properties to be assessed. Said notice shall
state the amount of the existing assessment, the amount of
the proposed assessment and the amount of the proposed
increase in the assessment. The approved amount of the
approved estimated assessments MAY NOT EXCEED the amounts
stated in the notice. Said notice must be mailed at least
forty -five (45) days prior to the date of the hearing.
Although the Notice may be postmarked April 15, 1994, the
content of the notice must be finalized by April 8, 1994, to
allow sufficient time for prtntinq and handling.
4. State law also requires that prior to considering any new or
increased assessment a PUBLIC MEETING shall be convened to
allow the public an opportunity to discuss the proposed
increased assessment. It is recommended that this PUBLIC
MEETING be convened on Monday, May 16, 1994, at 7:00 p.m. in
the Council Chambers. This will be an informal meeting
conducted by staff for the purpose of providing answers to
questions regarding projected program costs and the methods
used to spread those costs t) the properties assessed.

5. Attached as Exhibit 'E' is a copy of the Public Hearing
Notice for AD85 -1. Said Notice sets the time and place of
both the PUBLIC MEETING (May 16, 1994, at 7:00 p.m.) and the
public hearing (June 1, 1994, at &:00 p. m.). The date of
the public hearing is date of the first City Council meeting
in June as required by law.
RECOMMENDATION
Staff recommends that the City Council adopt the attached Resolution
(Exhibit "F ") 1) approving the Engineer's Report for Assessment
District AD85 -1; 2) declaring intention to make certain changes to
and ordering the annual assessments for said assessment district for
FY 1994/95; and, 3) setting the dates and times of a Public Meeting
and a public hearing to consider said assessments.

Landscape and Lighting Act of 1972
For Fiscal Year 1994 -95
SECTION 1. AUTHORITY FOR REPORT
This report is prepared pursuant. to City Council action taken. at
their regular meeting of January 5, 1994 to ext.erid this District
for the fiscal year commencing July 1, _994 and ending June 30,
1995 in compliance with the requirement:, of Article 4, Chapter 1,
"Landscaping Act, of 1972", being Part of Division 15 of the
California Streets and Highways Code.
This report is an update of an existing City -wide Assessment
District. The purpose for the district. is to provide operating
funds for the continued maintenance and improvements of existing
and planned City operated public ;arks.
SECTION 2 DESCRIPTION OF THE IMPROVEMENTS TO BE MAINTAINED

6. Pruning so as to not inhibit the natural growth
characteristics of the plan.
7. Cleaning existing facilities to be clear and free of all
debris. Minor repairs as needed.
8. Eradicating vector at the first indication of existence.
9. Maintaining lights, playground equipment, playcourts and
public restrooms.
10. Installing park or recreational improvements, including
but not limited to drains and sidewalks. Maintaining and
servicing said improvements.
Plans and specifications for the irrigation, landscaping, and other
authorized improvements within the City are on file in the
Department of Public Works. Reference is hereby made to said plans
and specifications for the exact location and nature of the
landscape improvements. Said planE and specifications by reference

SECTION 3 ASSESSMENT ROLL
All parcels of real property affected are listed on the "Assessment
Roll ", Exhibit "A ", which will be on file in City Hall with the
City Clerk, and is made a part hereof by reference. These parcels
are more particularly described in maps prepared in accordance with
Section 327 of the Revenue and Taxation Code which are on file in
the office of the Ventura County Assessor in the County Government
Center Administration Building, 80C, Solzth Victoria Avenue, Ventura,
California and which are also made a tart- hereof by reference.
SECTION 4 ESTIMATE OF COST
The City staff recommendation for the District budget is shown in
Appendix "B" of this report.

The method and formula of benefit spread recognizes that every
property within the City of Moorpark benefits from public parks and
recreation facilities.
The method of spreading maintenance costs is based upon the "people
use" attributed to each land use within the City. This method was
chosen because the benefit received by having park facilities is
directly proportionate to the number of people generated by each
land use. Recognizing that residential land uses within the City
derive a higher degree of benefit than non - residential land uses,
the formula was subdivided into two main groups, with residential
land uses contributing in 75% of the assessment and non - residential
uses being assessed for the remaining 25% of the maintenance costs.
The benefits to residential land uses are clear. The residents of
the City utilize the parks during their leisure hours. Benefits to
non - residential property include such items as offering employees
the opportunity to utilize the parks during lunch time and after
hours, as well as providing an aesthetic environment which attracts
potential employees into the area
The "people use" factors utilized in 'ihe assessment district spread
formula are shown in Appendix "A"
The City Council approved a rebate procedure for disadvantaged
citizens on November 1989. The procedure shall be followed as
described in Appendix "F."
In conclusion, it is our opinion that. the assessments within Parks
Maintenance Assessment District No. AD -85 -1 are apportioned by a
formula that fairly distributes the net cost to each lot or parcel
in accordance with the benefits ghat ire received.

PUBLIC NOTICE IS HEREBY GIVEN that the City Council of the City of Moorpark. California, on April 6, 1994, adopted
Resolution No. 94- fixing the dale and time of a public rneetinX to be held on the 16th day of May, ]994, at the hour of 7:00

public meeting� is to allow the public an opp"rtunit to meet with City, staff to question and discuss the proposed annual

3. That the amount of the assessments for Assessment District No. AD85 -1 for FY 1994,,95 are proposed to increase from the

4. That it is the intention of the City Council a) to make certain changes to Assessment District No. AD 85 -1, which consists
of, a single city -wide district for the maintenance and improvement of pparks and recreational facilities within the City.
h) to order the extension of the annual assessment for said district for T Y 1994/95; and, c) to levy and collect assessments
for such parks maintenance and improvement
5. That said parks maintenance assessment distncl mcludrs the park sites with all improvements located therein, described by
and included within Assessment District No. •1D 85 -1.
6. That the foregoing described work is to he located within Assessment District No. AD 85 -1, the boundary of which is
described on a map on file in the City Clerk's office.
7. That said proposed maintenance and improvement is of henefit to, and expense for which are chargeable upon, the district.
9. That a full and detailed description of the improvements, the houndaries of the District and any zones therein, and the
proposed assessments upon assessable. parcels within said District. is set forth in a copy of the afore mentioned Engineer's
Report on file with the City Clerk and open to inspection.
9. That the existing assessments, the propostJ assessments and the proposed increase in the assessment amounts are set lorth

11 That this Joint Notice of Public Sleeting and Public Hearing is given, and that any persons having any objections to the
work or extent of the assessment district may appear and show cause why said work should not be done or carried out or
why said district should not be extended for the fiscal year commencin , July 1, 1994 and ending June 30, 1995. Protests
must be in writing, and must be filed by the property owner with the City Clerk prior to the conclusion of the hearing and
such protest shall state all grounds of the objection and shall contain a description sufficient to identify the property. A
majonty protest will cause the assessment increase to he abandoned. For additional information about the assessments

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, APPROVING THE
ENGINEER'S REPORT FOR, AND DECLARING ITS
INTENTION TO MAKE CERTAIN CHANGES AND TO ORDER
THE ANNUAL ASSESSMENTS FOR THE "PARKS
MAINTENANCE ASSESSMENT DISTRICT NO. AD -85 -1"
FOR THE FISCAL YEAR COMMENCING JULY 1, 1994
AND ENDING JUNE 30, 1995 PURSUANT TO THE
LANDSCAPING AND LIGHTING ACT OF 1972, AND
FIXING THE TIME AND PLACE FOR A PUBLIC MEETING
TO DISCUSS AND A PUBLIC HEARING TO RECEIVE
OBJECTIONS THERETO.
WHEREAS, by Resolution No. 94 -995, the City Council
ordered the City Manager to cause to be prepared an Engineer's
Report for Assessment District 85 -1 for FY 1994/95, in
accordance with Article 4, Chapter 1, Part 2, Division 15 of
the California Streets and Highways Code; and
WHEREAS, pursuant to said Resolution, the said Engineer's
Report was filed with the City Clerk on the 1st day of April,
1994; and
WHEREAS, the City Council has reviewed said Engineer's
Report and wishes to take certain actions relative to said
report and to the levy of the assessments recommended therein.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
SECTION 1. The Engineer's Report for "PARKS MAINTENANCE
ASSESSMENT DISTRICT NO. AD -85 -1" for the fiscal year
commencing July 1, 1994 and ending June 30, 1995, filed with
the City Clerk on the 1st clay of April, 1994, is hereby
approved.
SECTION 2. That said Engineer's Report may be further
modified or changed, pursuant to the provisions of Section
22630 of the Streets and Highways Code.
SECTION 3. That the amount of the assessments for FY
1994/95 are proposed to increase over the amount of the
assessments levied in FY 1993/94.

SECTION 4. That the public interest and convenience
require and it is the intention of the City Council of the
City of Moorpark to make certain changes to the "PARKS
MAINTENANCE ASSESSMENT DISTRICT NO. AD -85 -1" consisting of a
single city -wide district for the maintenance and improvement
of parks and recreational facilities within the City and to
order the extension of the annual assessment for said district
for the fiscal year commencing July 1, 1994, and ending June
30, 1995, pursuant to the Landscaping and Lighting Act of
1972, and to levy and collect assessments for such parks
maintenance and improvement in accordance with said Act.
SECTION 5. That said parks maintenance assessment
district shall specifically include the park sites with all
improvements located therein, described by and heretofore
included within "PARKS MAINTENANCE ASSESSMENT DISTRICT NO. AD-
85-1."
SECTION 6. That the foregoing described work is to be
located within said Assessment District, the boundary of which
is more particularly described on a map on file in the City
Clerk's office, and entitled "Boundary Map, City of Moorpark
Lighting and Landscaping Maintenance Assessment District No.
AD- 85 -111, filed in the office of the City Clerk on the 1st of
April, 1994.
SECTION 7. That the contemplated maintenance and
improvement of parks and recreational facilities, in the
opinion of said City Council, is of benefit to, and the said
City Council hereby makes the expense of the said maintenance
and improvements chargeable upon, the district.
SECTION 8. That a full and detailed description of the
improvements, the boundaries of the Assessment District and
any zones therein, and the proposed assessments upon
assessable lots and parcels of land within said District, is
set forth in a copy of the afore mentioned Engineer's Report,
a copy of which is on file with the City Clerk and open to
inspection.
SECTION 9. That the proposed assessment amounts are set
forth in Exhibit 'A' attached hereto and made a part hereof.
SECTION 10. That a Public Meeting shall be convened on
the 16th day of May, 1994, at the hour of 7:00 p.m., in the
Council Chambers of the City Hall of said City, located at 799
Moorpark Avenue, Moorpark, for the purpose of allowing the
public an opportunity to meet with City staff to question and
discuss the proposed assessments for FY 1.994/95.

Council shall be convened on the 1st day of June, 1994, at the
hour of 7:00 p.m., in the Council Chambers of the City Hall of
said City, located at 799 Moorpark Avenue, Moorpark, for the
purpose of receiving oral and written testimony regarding the
proposed assessments for FY 199,11 /9`z .
SECTION 12. That Joint Notice of said Public Meeting
and public hearing is hereby given. All persons interested in
learning more about the proposed assessments and the basis for
same are invited to attend said Public Meeting. All persons
having any objections to the work or extent of the assessment
district may appear at the public hearing and show cause why
said work should not be done or carried out or why said
district should not be extended for the fiscal year commencing
July 1, 1994 and ending June 30, 1995. Protests must be in
writing, and must be filed by the property owner with the City
Clerk prior to the conclusion, of the public hearing and such
protest shall state all grounds of the objection and shall
contain a description sufficient to identify the property. A
majority protest will cause the assessment increase to be

SECTION 13. All the work herein proposed shall be done

of this resolution.
