Aguilera, Director of Community Developmen Kathleen Mallory, Associate Planner K W\ li t` DATE: March 17, 1994 (CC meeting of April 6, 1994) SUBJECT: CONSIDER MINOR MODIFICATION NUMBER 9, TO DEVELOPMENT PERMIT NUMBER 980, IN ORDER TO MODIFY THE EXISTING TOWN CENTER SIGN CRITERIA AND TO ALLOW THE CENTER TO HAVE A 24 FOOT TALL BY 11 FOOT WIDE PYLON SIGN ON LOS ANGELES AVENUE AS WELL AS OTHER MODIFICATIONS TO THE SIGN CRITERIA BACKGROUND On November 11, 1993, the Carlson Company filed Minor Modification No. 9, to Development Permit Number 980. According to the applicant, the purpose for Minor Modification Number 9 is to re-submit their request for a Pylon sign and modifications to the existing sign criteria for the Center. On March 16, 1994, the City Council continued this item to the Council's April 6, 1994 meeting. DISCUSSION Minor Modification Number 7 Minor Modification Number 7 was filed by the Carlson Company, the Management Company for the center, requesting approval of the installation of a 24 foot tall by 10 foot wide Pylon sign, three 6 foot tall Monument signs, one on Moorpark Avenue and two on Los Angeles Avenue, and revisions to the centers sign criteria. On May 19, 1993, the City Council concurred with the Director of Community Development's decision which was to deny the allowance of the Pylon sign for the center. The Director did approve modifications to the centers sign criteria and three five foot tall Monument signs, instead of three six foot tall Monument signs, as requested, see Attachment Number Ia. On June 16, 1993, the Council heard an appeal from the Carlson Company requesting Council consideration of their support of the Director's decision to deny the center a Pylon sign. At the June 16, 1993 meeting, the Council upheld the Director's decision to deny the installation of a Pylon sign for the center. KMP-3-17-93(10:30am)A:\4-6MM9.RPT a The Honorable City Council March 17, 1994 Page 2 All conditions of approval for Minor Modification Number 7 have been met except one. This condition of approval required that the Carlson Company re-stripe the Moorpark Avenue driveway to indicate three drive lanes - re-stripping will allow left and right turn egress from two separate lanes. Staff has been working with the Carlson Company to have this work completed. Further, all required permits for driveway expansion have been obtained from Caltrans, as Moorpark Avenue fronts on a State Highway. Staff has been working with the Carlson Company since September 1993 regarding this matter. Regardless of if the Pylon sign or additional sign colors are allowed (Minor Modification Number 9), it is staff's recommendation that the Carlson Company be directed to complete the Moorpark Avenue driveway widening by April 30, 1994. Additionally, ingress and egress from the westerly driveway on Los Angeles Avenue is being hindered by lack of painted stripes indicating drive lanes. Therefore, regardless of if the Pylon sign or additional sign colors are allowed (Minor Modification Number 9), it is staff's recommendation that the Carlson Company also be directed to complete the Los Angeles Avenue driveway re-striping, and if necessary curb radius modifications, by April 30, 1994. Minor Modification Policy Pursuant to Resolution Number 88-523, the Director of Community Development has the authority to approve, conditionally approve or deny Minor Modifications. However, due to the fact that this request had been previously acted upon by the City Council, the Director is requesting that the Council act as the "approving authority" for the proposed modifications to the sign criteria. The Director has therefore assumed the role of a recommending body to the City Council. Comparison of Minor Modification Number 7 and 9 As previously mentioned, the request for a 24 foot tall by 10 foot wide Pylon sign (Minor Modification Number 7) was denied by the Director, with the Director's decision being upheld by the City Council. Additionally, three five foot tall Monument signs were approved as part of Minor Modification Number 7. Minor Modification Number 9 requests the installation of only two six foot tall Monument signs [instead of three five foot tall Monument signs, as was approved as part of Minor Modification Number 7]. The proposed Pylon sign is located where, one of the Monument signs was approved as part of Minor Modification Number 7. KMP-3-17-93(10:30em)A:\4-6MM9.RPT a a The Honorable City Council March 17, 1994 Page 3 For the Council's information, Minor Modification Number 8 was a modification to add landscaping within the primary cart storage area in the parking lot and a landscaped wall to screen the shopping carts within the portico of Hughe.s Market. At the Council's meeting of March 16, 1994, the Council concurred with the Director's decision to approve this modification. Minor Modification Number 9 Minor Modification No. 9 was filed in order to modify the existing sign criteria (see Attachment Number 1), including a request for a Pylon sign and the allowance of two six foot tall, instead of the approved five foot tall, Monument signs. After review of the proposed changes to the sign criteria, staff was in concurrence with some of the requested changes. In Attachment Number 1, requested changes are noted in legislative format (additions have been shaded and deletions have been struck out). While the discussion within the sign criteria regarding a Pylon sign has been highlighted, this does not indicate staff's concurrence with the allowance of a Pylon sign. Staff has met with the Carlson Company regarding the proposed criteria changes. To date, two issues remain to be resolved: signage colors and installation of the Pylon sign. The Carlson Company's response to staff's concerns can be found in Attachment Number 2. The Carlson Company has agreed to reduce the height of the two proposed Monument signs from six feet to five feet, as approved as part of Minor Modification Number 7. Signage Color In summary, the Carlson Company is requesting the allowance of five colors within the center (red, blue, green, yellow, and orange). As part of the update to the City's Sign Ordinance, staff researched the allowance, within other cities, of multiple sign colors within a center. Staff's research revealed that most cities specify a maximum of three colors within a center; some cities, such as Agoura Hills and Westlake Village, only allow two colors within a center, though logos and trademarks are exempt. It is staff's opinion that the allowance of five colors, as proposed by the Carlson Company, will result in visual clutter and detract from continuity in signage. It is staff's recommendation that three colors be permitted within the center: red, blue, and bronze (given that bronze is the existing color of most signs within the center). Historically, white has been allowed on signs within the center because it is considered a neutral color; for example, the Bank of A. Levy and Hughes, to name a few, utilize white either within the border or text of their signs. Further, it is customary to allow white within a sign, as an accent color; therefore, this allowance actually increases the number of allowable sign colors from three to four KMP-3-17-93(10:30am)A:\4-6M M9.RPT The Honorable City Council March 17, 1994 Page 4 (white, red, blue, and bronze). As written within the sign criteria, logos and trademarks are exempt from the color requirements; thus,this allowance further increases the number of colors available within the center. Monument Siqns As seen in Attachments Number 3 and 4, two six foot tall Monument signs are proposed for the center; one Monument sign on Moorpark Avenue and one Monument sign on Los Angeles Avenue. After discussions with staff, the Carlson Company is agreeable to reducing their requested height for the two Monument signs from 6 feet to 5 feet in height. As proposed, the Monument sign on the corner of Moorpark Avenue and Los Angeles Avenue, will advertise the Center name (Town Center) and the Coffee Grinder. The Monument sign at the Moorpark Avenue driveway will advertise the Center, Hughes and Thrifty's. All Monument signs may display a maximum of 15 square feet of sign area. Pylon Sign The Carlson Company has requested approval of a Pylon sign to be located on Los Angeles Avenue, see Attachment Number 5. The Pylon sign is proposed to display the name of the Center, and advertise Hughes, Thrifty's and a future anchor tenant. The proposed Pylon sign is twenty-four (24) feet in height and eleven (1 1) feet in width. As seen on the site plan, attachment number 4, the location of the proposed Pylon sign has been moved to the westerly driveway area; as part of Minor Modification Number 7, the proposed Pylon sign was located on the east side of the driveway closer to Moorpark Avenue. Also, as seen within Attachment Number 4, only two Monument signs are shown on the Pylon sign. The Carlson Company is proposing the deletion of a Monument sign which was approved as part of Minor Modification Number 7, on the west side of the westerly driveway on Los Angeles Avenue. It is staff's opinion that the advertisement of Hughes and Thrifty's on both the Monument and Pylon signs will result in excessive signage and visual clutter. Further, the center is well established and has been successful without additional signage for Hughes and Thrifty's. From Los Angeles Avenue, Hughes and Thrifty's can easily be seen; therefore, the advertisement of these two businesses on the Pylon sign, appears to be excessive in that signage for these two stores is appropriate without the Pylon sign and is emphasized with the Monument sign on Moorpark Avenue. KMP-3-17-93(10:30am)A:\4.6MM9.RPT The Honorable City Council March 17, 1994 Page 5 Discussions with the Carlson Company indicate that the Company is interested in attracting a third anchor tenant for the center. The anchor could conduct internal modifications and possibly utilize shops 28 through 39 (see Attachments Number 4 and 6), with the possible relocation of one existing business. The utilization of these shops would result in roughly 9,000 square feet of leasing area, thereby creating enough continuous square footage for another anchor tenant. Utilization of these buildings for one tenant is an idea which the Carlson Company has considered given that the vacancy rate on the west side of the center has been continuously high. The Carlson Company has indicated that in order to attract an anchor tenant to the west side of the center the Company has considered one incentive. This incentive involves the removal of a few shops, in order to allow access from Park Lane into the center. This will result in creating a "corner pad" for another tenant, thus, increasing its leasability. Staff was informed that the Carlson Company, has found this reconstruction alternative cost prohibitive, given that construction costs would total approximately $350,000.00. The square footage lost due to creating the driveway opening could be added to a pad which is adjacent to either Moorpark Avenue or Los Angeles Avenue. Traditionally, pads which face major roadways command a higher rent; therefore, increasing the square footage of these pads would result in increased revenue for the Center. While staff is cognizant of the up-front cost to construct the connector, the long-term benefits include increased leasability in the center, increased pad rental rates, and ultimately increased revenues for the owner and the City. It is staff's opinion that the opening of a third anchor tenant business within the center gives merit to the claim, made by the Carlson Company, that additional name recognition is needed for the Center and anchor tenants. If a third anchor tenant is solicited, it would be inequitable to allow the new proposed anchor tenant to obtain advertisement on the Pylon sign without allowing all of the anchor tenants advertisement on the Pylon sign. Until the roadway connection is accomplished, staff does not support the approval of a Pylon sign. However, staff would be agreeable to allowing a three year time period for the construction of the Park Lane access with the understanding that the sign would be removed if the access was not completed by the end of the three year time period. Painting of Trim for the Center and Single-Out Tenant Parcels The Carlson Company is also requesting approval to change the color of the trim for in- line as well as out tenant parcels. The color of the in-line tenants trim will be changed from bronze to blue ("Nantuckett"). The color of the out tenants trim will be changed from bronze to green ("Norway Pine"). A color board will be available at the Council's March 16, 1994 meeting. Based upon the signage colors recommended by staff (white, bronze, KMP-3-17-93(10:30am)A:\4-6M M9.RPT • The Honorable City Council March 17, 1994 Page 6 blue, and red), green trim for out tenant parcels may not be complimentary. However, historically the business which locate within single pads tend to be comprised of registered trademarks or logos, which, based upon the proposed sign criteria, are exempt from the color requirements. CONCLUSION In summary, in reviewing the proposed changes to the sign criteria, staff is in concurrence with all of the proposed changes to the sign criteria, as seen in Attachment Number 1. However, staff is not in support of the following: o The allowance of more than three colors (if white is considered a "neutral" color) within the center; and o If the connection between Park Lane and the Town Center is not provided, the installation of the Pylon sign on Los Angeles Avenue. RECOMMENDATION 1. Staff recommends approval of the sign criteria modifications with the exception of the Pylon sign unless the Park Lane access is built within a specified time period; staff further recommends the conditions of approval as seen within Attachment Number 7. 2. If the Council wishes to approve the Pylon sign, staff recommends the conditions of approval listed in Attachment Number 8. Attachments: 1. End Unit - A building who has with two primary elevations, usually located at the end of a row of shops. The Director of Community Development shall determine which shops meet this criteria. 2. Logo - A sign which depicts a local, regional, or national symbol, word, or design used by a manufacturer or dealer to distinguish their products from those of their competitors. The trademark is required to be registered and protected by law. 3. Freestanding (Out Parcel) Tenant - A tenant occupying lease space in a freestanding building on a pad separate and apart from major and other in-line tenants. 4. Major Tenant - A tenant occupying lease space equal to or greater than 6,000 square feet. 5. Minor Tenant - A tenant occupying lease space equal to or less than 5,999 square feet. 6. Monument Sign - A free standing sign, other than a pylon sign, no taller than five (5) feet in height. 7. Painted Sign - Signs painted directly on the exterior surface of a building or structure. 8. Primary Sign - Consists of the name of the Company, Corporation, Business or Organization doing business at this location. 9. Pylon Sign - A free standing sign, the supports or uprights and structure of which have received architectural enhancement. 10. Secondary Sign - Consists of name of specialized department or services being conducted within a Company, Corporation, Business or Organization doing business at this location. Sign - Any device or part thereof capable of visual communication or attraction including any announcement, declaration, association, corporation, institution, organization, product, service, event, location or other business entity by any means, including words, letters, figures, design, symbols, fixtures, colors, illumination or projected images. "Sign" shall not include any official notice, directional, warning, or information signs or structures issued by any federal, state, county or municipal authority. 12. Sign Maintenance - The repairs of faded, broken or electrical components of a sign. 13. Trademark - A sign which depicts a local, regional, or national symbol, word, or design used by a manufacturer or dealer to distinguish their products from those of their competitors. The trademark is required to be registered and protected by law. 14. Wall Signs - Signs which are in any manner affixed to any exterior wall of a building or structure, the exposed face of which is in a plane parallel to the plane of the wall and which projects not more than a iii i imum (11 eight inches for major 1enants and ;i maximum of five inches for out Parcel' and minor tenants from the building or structure wall. 15. Window Signs - Signs painted, attached, glued or otherwise affixed to a window or otherwise easily visible from the exterior of the building. General Requirements 1. Purpose: The purpose of the following criteria is to establish a coordinated sign program that gives each tenant adequate identification, while achieving a unified, attractive appearance among all lease spaces. In order to maintain the integrity of the criteria and equity among all tenants, deviations from the criteria will not be approved. 2. Existing Signs: Upon enactment of this criteria, all existing signs which do not meet this programs criteria at this center shall be considered legal non-conforming signs and shall be allowed to be maintained (see Sign Maintenance, definitions) until tenant vacates lease space. 3. KMP-3-17-93(10:30am)A:\4-6MM9.RPT 5 4. Landlord Approval: Prior to sign fabrication, the tenant shall submit three (3) copies of drawings of the proposed signs to the landlord for approval. Such drawings must include all of the items listed below under "City Approval and Permits" and shall be stamped by the landlord for submittal to the City of Moorpark Department of Community Development. 5. City Approval and Permits: When approved by the landlord, the tenant shall secure a sign permit from the City of Moorpark Department of Community Development by submitting three (3) copies fully dimensioned scaled drawings which shall include the following: a. A site plan showing the location of the lease space on the site. b. An elevation of the lease space drawn to scale and showing sign placement and lease space width. c. A detailed elevation of the sign drawn to scale and showing all colors, materials, dimensions and copy. d. Fabrication and installation details, including structural and engineering data, U.L. electrical specification, and type and intensity of illumination (for electrical signs). e. Any other drawings, details and information as required by City. 6. Colors: All signs shall be either red (#2793), blue (#2051), bronze •(#2412) aril may include wliit6, Yellow (#2037), Green (#2030). 7. Cost of permits: All permits for signs and the installation thereof shall be obtained and paid for the by the tenant or his contractor. 8. Compliance with Code: All signs and the installation thereof shall comply with all local zoning, building and electrical codes. Major Tenants Wall Signs 1. Approval Required: All signs shall be attached to the building only at a location specified by these criteria and approved by the landlord and the City of Moorpark Department of Community Development. 2. Main Business 1D Sign: The main business identification sign shall be centered on the building fascia, both vertically and horizontally, above the lease space. Delivery Entrance Sign: If applicable, the tenant may attach a sign consisting of 2" high Helvetica medium letters, identifying the business name and address on a non-customer delivery entrance. The location of this sign will be subject to landlord and Department of Community Development approval and shall not exceed one (1) two (2) square feet feet in area. 4. Shirlee Bradley, with regard to your latter dated February 7, 1994 indicating that the applicant should forward any ad- ditional information to be submitted to the City Council to you by February 14, 1994. This letter is intended to consti- tute that additional information and it is requested to be included in the Council packet. We anticipate having display boards, photographs and/ or renderings available for the March 2 meeting as well. Un- fortunately, they are not ready at this time. This letter is written on the basis that staff will be consistent with its prior actions and recommend the denial of written criteria for a pylon sign, but the approval of crite- ria for monument signs adjacent to two driveways, but in a significantly modified form from the criteria originally re- quested. For purposes of this letter, I would prefer to dis- cuss the topic of signs based upon visual standards rather than written standards. I believe that once the Council reaches a consensus as to the "look" that it wishes to achieve, it will be easy to modify the proposed written crite- ria to achieve that and. While it is true that the Town Center was the first such development in the City of Moorpark and has served the City for several years, the City has grown and continues to grow, resulting in increased competition for the Town Center and its tenant busi- nesses. That competition is healthy and should be nurtured. There are many instances where new shopping centers have an almost immediate affect of irreparably damaging the existing shopping centers because they suddenly look old, dowdy or less attractive. The and result is that the older centers must be renovated and reopened or attract less desirable tenants to maintain profitability. The current owner of the Town Center through its agent, The Carlson Company, has discussed with City staff, the benefits to be derived to the Town Center and to the City by making certain physical changes to the property improvements. However, basic financing rules in the current market dictate 4110 that before such renovation or modifications can be financed, the center must have new tenant leases signed or the center must have a vary strong financial base. The Town Center, along with many similar centers in and around Southern California, have not been performing par- ticularly well in the last few years. Therefore, the goal of the Town Center management will be to attract one or more sig- nificant new tenants to the center to keep it competitive with its new neighbors to the west and with similar centers to be constructed within other areas of the City of Moorpark. It is for this reason that the owner of the Town Center is proposing a pylon sign and two monument signs to increase its vis- ibility. It is our belief that the additional signage will allow the shopping center to increase its economic viability and serve to attract exciting new national or chain tenants who require street signage and visability which will enable the Town Center to compete with the newer centers. There is also an impact and will continue to be im- pacts on the traffic flow by the Town Center as a result of the completion of the 118/23 interchange. We believe that the new signs will help the Town Center adjust to the changed traffic patterns. Frankly, they will not distinguish between a new center to be constructed west of our site and the Town Center simply on the basis that the Town Center is preexisting and has an established market share. Those new families will shop wherever the attraction is the greatest, including the ease with which they can locate, enter and exit the shopping areas. In summary the proposal for the new signs will assist the Town Center in strengthening its financial capacity, as- sist the center in attracting new tenants of significance, assist the shopping center to compete with new centers now coming on line or being planned and assist the City to in- crease its sales tax revenues through the creation of a strong, competitive commercial base. 0 Proposed Qriterit. As to the plan before the Council, we realize that there is no adopted criteria for judging who is granted pylon and monument signs or for judging the design of those signs at 'the current time. The basic criteria for the physical design of the signs can best be handled by com- paring our request to the approvals on the adjacent properties to the west. We have modified our proposal to move the pylon sign to the second driveway from Moorpark Avenue on New Los Angeles Avenue in order to increase safety and minimize dis- ruption to the existing landscaping at the Town Center. our sign consultant, Lynn Cathcart of Sign Methods will review for the City Council the location, designs and colors of signage being proposed. Ilks.- ♦J ATTACHMENT NUMBER 7 CONDITIONS OF APPROVAL IF THE PYLON SIGN IS NOT APPROVED 1. All staff time spent on Minor Modification Number 9 shall be reimbursed prior to issuance of a Zone Clearance. 2. Widening of the Moorpark Avenue driveway, as required in Minor Modification Number 8, shall be completed by April 30, 1994. 3. The westerly driveway on Los Angeles Avenue shall be striped to indicate two egress lanes and one ingress lane; curb radius modifications shall be made, if necessary. Said striping, and other related work, shall be completed by June 17, 1994. 4. The Sign Criteria (attached) as amended within this Minor Modification and excluding the Pylon Sign, shall supersede the previous Sign Criteria approved on May 27, 1993. 5. A Sign Permit shall be obtained and approved, prior to the installation of any signs. Should any landscaping be impacted by the installation of any signs on Los Angeles Avenue or Moorpark Avenue, all removed landscaping shall be replaced with approved landscape material as stipulated in the landscape plan for Development Permit Number 980. The replacement location shall be approved by the Director of Community Development. A Zoning Clearance shall be obtained for all replacement landscaping. All replacement landscaping shall be completed within thirty days of issuance of a Sign Permit for the installation of the Pylon sign. 5. A Zoning Clearance shall be obtained prior to beginning construction of the Pylon sign. 6. A Sign Permit shall be obtained for the installation of the Pylon sign. 7. The Sign Criteria (attached) as amended within this Minor Modification, shall supersede the previous Sign Criteria approved on May 27, 1993. 8.
