Aguilera, Director of Community Developmerce/ Kathleen Mallory, Associate Planner ' Date: March 31, 1994 (CC meeting of April 6, 1994) SUBJECT: CONSIDER THE APPROPRIATION OF $19,508.50 TO DEMOLISH (INCLUDING A 10 PERCENT CONTINGENCY) THE MAYFLOWER MARKET LOCATED AT 105 HIGH STREET, DAMAGED DURING THE JANUARY 17, 1994 EARTHQUAKE BACKGROUND Due to the earthquake and subsequent aftershocks, on January 17, 1994, an inspection was made by the Department of Building and Safety of the City of Moorpark of the Mayflower Market located at 105 High Street. Upon inspection it was determined that the building was unsafe and therefore, a threat to !he ;public health, safety, and welfare. The purpose of this staff report is to receive Council approval to appropriate $19,508.50 ($1,000.00 for consultant management, $6,550.00 for demolition, $10,185 for asbestos removal, and $1,773.50 as a contingency), which requires a roll call vote, in order to demolish the aforementioned t�uilding DISCUSSION The inspection conducted on and after Januac y 17, 1994, revealed that the Mayflower Market had been damaged and that it was a threat to the public health, safety, and welfare. Therefore, the structure was declared to be a Dangerous Building, as determined by Section 302.4, 302.7, and 302.9 nf the 1991 Uniform Building Code for the Abatement of Dangerous Buildings. According to the February 9, 1994 Notice and Order (see Attachment Number 1), the City's building inspector requested that physical work be commenced in either the repair or demolition of the unsafe buildings; this notice i equested action within seven days from receipt of the February 9, 1994 correspondence phis deadline was extended by the Director of Community Development upon discussions with the owner and the owner's engineer regarding potential rE,construction of T-c- n iarket KMP- 03- 31- 94(4:30am)A •,DEMCC4 -l-, RFo- The Honorable City Council March 31, 1994 Page 2 Demolition Demolition of the building will cost $6,550.00. Additionally, asbestos has been identified as being present within the building; therefore, an additional $10,185.00 would be needed in order to remedy this problem (see Attachment Number 2). Reimbursement Based upon discussions with the Federal Emergency Management Agency (FEMA), staff has been informed that the City would be eligible to receive reimbursement funding from the State and /or Federal Government, for the demolition of "the project." The project is considered by FEMA to include- the investigative report, staff time spent by the consultant hired by the City (Phil Vein), asbestos removal, and demolition. The City hired consultant (Phil Vein) has informed staff that his costs will not exceed $1,000.00. The City will not be reimbursed 100 percent for the total cost of the project. According to information received from FEMA and the State Office of Emergency Services (OES), the City can expect to be reimbursed for 94 90 of the total cost of the project. The City can anticipate at least partial FEMA /OES reimbursement for ''ity staff and contract building inspection services. A Consent to Enter, Waiver of Liability and Reimbursement Agreement is being prepared and should be approved subject to final language approval by the City Attorney and City Manager. The Agreement will provide the owner 60 days to reimburse the City, without incurring an interest charge. The Agreement will provide for the owner to reimburse the City for all of the cost not reimbursed by FEMA or OES (approximately 6% or $1,064.10 [10% of $17,735.001 if the contingency budget is riot utilized). Staff recommends that reimbursement of City staff costs not be rer,uestec of the owner. If the owner doesn't sign the Agreement by April 18, 1994, staff will proceed to perform the work as authorized by the Uniform Building Code and seek full reimbursement, including any staff costs not reimbursed by FEMNOES Upon receipt of the signed Agreement, staff will proceed with the asbestos removal and demolition work. Bids were as follows: Asbestos Removal Ventura Asbestos Control (VAC) $10,185.00 () Demolition, excluding removal of the foundation CNM Paving $14,800.00 All Contractors $ 6,550.00 Buildina Exoansion After demolition of the market. the owner would like to reconstruct the market; the owner and the owner's engineer have met with staff regarding the proposed market and the addition of new retail space (see Attachment Number 3). Some of the commercial space within the proposed market will be available for lease by other businesses. Authorize the City Manger to enter into a contract with All Contractors ($6,550.00) for the demolition and VAC ($10,185.00) for asbestos removal (see Attachment Number 2) and to approve a contingency not to exceed 10 percent of the total cost of the project. 3. Approve the agreement with the owners of the Mayflower Market subject to final language approved by the City Attorney and City Manager for the reimbursement of the project and authorize the City Manager to sign on behalf of the City. Preliminary and subsequent inspections of the structure have revealed that significant damage has occurred as a result of the recent earthquakes. It is the opinion of this Department that the structure has been damaged and is an inherent danger to the public right -of -way and /or occupants of this building. We, therefore, have declared this structure to be a Dangerous Building as determined by Sec. 302.4, 302.7, and 302.9 of the 1991 Uniform Code for the Abatement of Dangerous Buildings. The Department of Building and Safety requires that: this building be vacated, engineered shoring be put in place to prevent further failure due to aftershocks, and temporary safety fencing installed, As an option, the building must be demolished pursuant to Chapter 4 Sec.401(b)3, A &C. Permits must be obtained and physical work commenced within seven calendar days from the date of this Notice and Order. Should you desire an Administrative Hearing within the next twenty -four hours to protest this Notice and Order, you may request such. Your protest must be accompanied by a structural engineers analysis. All correspondence and permit applications should be directed to our Building and Safety office at 111A Poindexter Ave. The City of Moorpark may proceed to cause repairs or demolition of the above referenced structure if work is not commenced within 7 days. PROJECT NUMBER: 1623 Ventura Asbestos Control is pleased to submit a proposal to provide all labor, materials and equipment necessary for the removal of asbestos containing materials at the above address. 1. SCOPE OF WORK: Contractor will perform: A. The removal of all acoustic spray -on material on the interior ceilings, located in the front area of the market. B. The removal of all asbestos containing roofing material including capsheet, felts, mastic and roof penetration /flashings. C. Isolation of work area using 4 -mil and 6 -mil poly sheeting. D. Decontamination unit. E. Negative air filtration system containment. F. HEPA (High Efficiency Particulate Air) vacuum and encapsulate areas where asbestos was removed. G. REMOVAL PROCEDURES: All work at the above address will be performed in accordance with all Federal, State and Local laws and regulations that pertain to asbestos removal and disposal, including 8 CCR 1529 (OSHA), 40 CFR 763 (AHERA), 40 CFR part 61 and 5208 (CAL /OSHA). 3. DISPOSAL: All asbestos waste will be handled, transported and disposed of as per Federal, State and Local regulations to an E.P.A. approved landfill. Owner to obtain a generator's EPA I.D. number and a hazardous waste tax account number for transportation and disposal of the asbestos waste. The EPA I.D. number may be obtained from The Environmental Protection Agency at (916)324 -1781 and the hazardous waste tax account number may be obtained by calling (916)739 -2582. 4. SCHEDULING AND NOTIFICATIONS: Contractor will complete the project in 5 working days if there are no unforseen interruptions. A period of 10 working days is necessary after notice to procede, to submit the required notifications to the appropriate regulatory agencies. 5.
