Myers, Solid Waste Coordinator dpp-- DATE: March 24, 1994 (CC Meeting of April 6, 1994) SUBJECT: Reconsider Council's Action Supporting Waste Management's Request for Sunday Closure of the Simi Valley Landfill BACKGROUND In December 1993, the East County Waste Task Force heard a request by the County and Waste Management (owner /operator of the Simi Valley Landfill) to close the Simi Valley Landfill on Sundays. On December 1, 1993, the City Council formally expressed its support for Sunday closure. Moorpark was the only east county city to take formal action. No additional progress was made on the closure request. In February 1994, the Task Force began informal negotiations with Waste Management regarding the importation of out -of- county waste, for the purpose of extending the useful life of the landfill for east county residents and businesses. Specifically, the Task Force is requesting that Waste Management restrict Los Angeles County waste from disposal at the Simi Valley Landfill. In return, the Task Force would consider guaranteeing a minimum daily tonnage. The County drafted a letter (March 3, 1994) to the cities indicating that it was proceeding forward with the approval of Waste Management's request. The Task Force, with the assistance of Supervisor Howard, was successful in delaying the approval time- line. The cities now have until April 13, 1994 to respond with any written testimony. Due to the developments that have taken place since Council's action on December 1, 1993, the City is being requested to reconsider its support for Sunday closure of the Simi Valley Landfill. The position taken by the East County Waste Task Force is to support Sunday closure if, in return, Waste Management agrees to provide acceptable consideration for the restriction of Los Angeles County waste. Upon completion of the negotiations, currently in progress between the Task Force and Waste Management, staff will return to Council if further action is necessary. Honorable City Council April 6, 1994 Page 2 RECOMMENDATION Staff recommends in light of the negotiation efforts of the East County Waste Task Force that the City Council: 1. Reconsider its earlier support for Sunday closure of the Simi Valley Landfill; 2. Support the East County Waste Task Force's efforts to negotiate restrictions on the importation of out -of- county waste at the Simi Valley Landfill; and 3. Direct Staff to communicate the Council actions to the East County Waste Task Force and appropriate County Department.
