SUBJECT: Consider Ordinance Amending Solid Waste Ordinance 123,
Municipal Code Chapter 8.36., Section 050 for the Purpose
of Addressing the Placement and Storage of Solid Waste
and Recycling Containers.
BACKGROUND
On February 25, 1994, the City received a complaint from a resident
about the storage of solid waste containers. The resident is
concerned about the unsightliness of the receptacles stored at a
residences in locations visible from the street and adjacent
properties.
The Moorpark Municipal Code, Chapter 8.36 does not currently
address the proper placement and storage of solid waste or
recycling containers at times other than on regularly scheduled
collection days.
Staff believes it is appropriate to address the storage of solid
waste and recycling containers in the Municipal Code. Staff
reviewed ordinances from other Ventura County cities and proposes
that the following language be included in the Moorpark Municipal
Code:
"No receptacle or bin shall be stored in any required
side yard that abuts any public street or in any required
front yard. Every receptacle or bin shall be stored in
a manner such that it is screened and not visible from
the street, sidewalk, or alley. No receptacle or bin
shall be stored in a location visible from an adjacent
property, as viewed from ground level."
Attached, you will find the proposed ordinance amending Ordinance
123 and the Moorpark Municipal Chapter 8.36, Section 050 pertaining
to placement of containers. The City Attorney reviewed the
proposed ordinance and her comments were incorporated. The
proposed language is included as 8.36.050.F.
RECOMMENDATION
Staff recommends that the City Council approve Solid Waste
Ordinance 123 as amended for first reading.
ORDINANCE NO.
AN ORDINANCE OF THE CITY OF
MOORPARK, CALIFORNIA, AMENDING THE
MOORPARK MUNICIPAL CODE BY REVISING
CHAPTER 8.36 RELATIVE TO SOLID WASTE
COLLECTION SERVICES
WHEREAS, the periodic collection of solid waste from all
properties within the City benefits all of the people who live or
do business within the City; and
WHEREAS, because of such benefit, all of the people who live
or do business within the City should share proportionately in the
cost of solid waste collection services
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK DOES
ORDAIN AS FOLLOWS:
SECTION 1. The Moorpark Municipal Code is hereby amended by
revising Section 8.36.050 to read as follows:
8.36.050 Placement of containers. A. Any receptacle, bin or
drop box shall be placed for collection on any sidewalk, street,
roadway or alley only as provided in this chapter.
B Any receptacle or bin shall be placed for collection along
any street, roadway or alley only on the day established for the
collection or solid waste on the particular route or after five -
thirty (5:30) p.m. on the day immediately prior to such collection,
and shall not remain thereon for more than eighteen (18) hours
after it has been emptied.
C. Any receptacle placed for collection along a street or
roadway shall be placed between the curb line and the property line
as close to the curb line or edge of the street or roadway as
practicable.
D. Any receptacle, bin or drop box placed for collection in
any alley shall be placed as close to the property line as
practicable.
E. Any bin or drop box placed in any street, roadway or alley
shall require an encroachment permit from the city pursuant to this
SECTION 2. If any section, subsection, sentence, clause,
phrase, part of the portion of this ordinance is in any reason held
to be invalid or unconstitutional by any court of competent
jurisdiction, such decision shall not affect the validity of the
remaining portions of this ordinance. The City Council declares
that it would have adopted this ordinance and each section,
subsection, sentence, clause, phrase, part of the portion of this
ordinance, irrespective of the fact that any one or more sections,
subsections, sentences, clauses, phrases, parts or portions be
declared invalid or unconstitutional.
SECTION 3. This ordinance shall become effective thirty (30)
days after its passage and adoption.
SECTION 4. The City Clerk shall certify to the passage and
adoption of this ordinance; shall enter the same in the book of
original ordinances of the City; shall make a minute of the passage
and adoption thereof in the records of the proceedings of the City
Council at which the same is passed and adopted; and shall, within
fifteen (15) days after the passage and adoption hereof, cause the
same to be published once in a newspaper of general circulation
designated for that purpose.
