' Kathleen Mallory, Associate Planner KVJ\ DATE: March 10, 1994 (CC meeting of March 16, 1993) SUBJECT: CONSIDER MINOR MODIFICATION NUMBER 8 TO DEVELOPMENT PERMIT (DP) NUMBER 980 (MOORPARK TOWN CENTER) BACKGROUND Planned Development Permit 980 was approved by the City Council (Resolution Number 84-63) on January 18, 1984 for the construction of a 125,113 square foot shopping center. As originally approved, Hughes was permitted to store shopping carts in shopping cart corrals in four specified locations within the parking lot. On August 19 and 20, 1993, Hughes Market conducted parking lot modifications, without a permit, in order to facilitate the storage of more shopping carts within the parking lot. Additionally, Hughes has also chosen to store shopping carts, in violation of Development Permit Number 980, within the portico in front of the store. The purpose of this staff report is to present, as a courtesy, to the Council the solutions which have been approved by the Director of Community Development to remedy the aforementioned issues. Proposed modifications to the sign color, window and door trim color, and Pylon Sign for the Town Center are the subject of Minor Modification Number 9. For the Council's information, Minor Modification Number 6 gave approval for the installation of the water dispenser in front of Hughes Market. DISCUSSION Storage of Shopping Carts within the Parking Lot and Portico The modifications in August 1993 allowed more shopping carts to be stored within concrete corrals directly south of the store, defined by staff as the primary shopping cart corral (see Attachment Number 2); three shopping cart corrals on each side of the walkway were constructed. In addition to the primary cart corral, four "temporary" cart corrals were approved and are currently being utilized within the parking lot area in front KMP-3-1 0-94(4:30pm)A:\3-16RPT.NO8 The Honorable City Council, DP 980, Minor Modification Number 8 March 10, 1994 Page 2 of Hughes Market; these facilities were approved as part of the original development permit for the center (see Attachment Number 1). As seen within the conditions of approval, all shopping cart storage facilities within the parking lot are considered to be temporary. All shopping carts within temporary facilities shall be removed when the store is not open to the general public. The shopping carts stored underneath the portico are considered by both Hughes Market and staff, to be permanent. Shopping Cart Corrals The unpermitted modifications to the shopping cart corrals are not consistent with the City's expectations for quality development within the City. Therefore, the Director is requiring the addition of landscaping within one existing shopping cart corral on the east and west side of the walkway, in order to improve the aesthetics of this area (see Attachment Number 3). Staff has reviewed and approved the species of landscaping to be installed; said landscaping is consistent with the approved landscaping plan for the center. The landscaping within the planters will add height in order to "screen" the shopping carts, without creating a site distance problem with opposing traffic. The parking lot modifications recommended by the Director of Community Development will not interfere with any parking spaces or existing landscaping. For the Council's information, the shopping cart modifications conducted in August 1993 did not remove any landscaping or parking spaces. Shopping Carts within the Portico If permitted by the development permit, most businesses who wish to store shopping carts within the portico, are required to screen the shopping carts. For example, K Mart was required to install a three foot tall block wall to screen the shopping carts in front of K Mart. Ralphs grocery store, though not yet constructed, in the Mountain Meadows center was required to screen shopping cart storage areas. Internal tenant improvements conducted in September 1993, do not allow for the storage of shopping carts inside of the market. Therefore, Hughes Market has requested City approval to store the shopping cart within the portico. The applicant will be required to comply with conditions of approval as noted within Attachment Number 5. KMP-3-10-94(4:30pm)A:\3-16RPT.NOB The Honorable City Council, DP 980, Minor Modification Number 8 March 10, 1994 Page 3 Construction of a Landscaped Planter As seen within Attachment Number 4, a 3 Y foot tall tan landscaped slumpstone planter is proposed to be installed between the columns in front of Hughes Market in order to screen the shopping carts. Flowering shrubs and perennial color will be planted within the four planters, consistent with the approved landscape plan. The slumpstone planter will complement the existing planters and decorative concrete within the center (see Attachment Number 6). Water to these planters will be made available from existing planters. The width of the proposed landscape planter will not interfere with required walkway widths, as required by the Americans with Disabilities Act (ADA). Overview Staff has reviewed the initial conditions of approval for Development Permit 980 and has determined that granting this modification will not be in conflict with the initial conditions of approval or any subsequent conditions of approval established as a result of previous Minor Modifications to Development Permit Number 980. The Director of Community Development has reviewed the Minor Modification request and conditionally approved the proposed modifications to the development permit on March 8, 1994, with the appeal period ending on March 24, 1994 (see Attachment Number 7). If no appeal is filed, the Director's decision will stand. If the Council wishes to appeal the Director's decision, the next available public hearing would be April 20, 1994. Pursuant to Resolution Number 88-523, the Director has the authority to approve Minor Modifications. RECOMMENDATION Receive and file this report Attachments: 1. Site Plan of development 2. All carts and miscellaneous supplies of the market within the rear of the Market, shall be removed daily. If these items are not removed, an enclosure may be required by the Director of Community Development 2. All staff time spent working on Minor Modification Number 8, shall be reimbursed, prior to Issuance of a Zoning Clearance. 3. All shopping cart storage facilities within the parking lot are considered temporary; all shopping carts within temporary storage facilities shall be removed when the grocery store is not open to the general public. 4. The re-striping of the westerly driveway on Los Angeles Avenue shall be re-striped to indicate two egress lanes and one ingress lane; curb radius modifications shall be completed, if necessary. Said re-striping, and other related work, shall be completed by June 17, 1994. Categorically exempt from CEQA requirements as a Class 1, (15301 of CEQA) Exemption for Minor Alterations. California Environmental Quality Act (CEQA) Compliance: This Department has reviewed the project to ascertain if there will be a significant effect on the environment. The Minor Modification is consistent with the intent and provisions of the City's General Plan and Division 8, Chapters 1 and 2 of the City Ordinance Code; b. The Minor Modification is compatible with the character of surrounding development; c. The proposed Minor Modification is not obnoxious or harmful, or impairs the utility of neighboring property or uses; d. The Modification is not detrimental to the public interest, health, safety, convenience, or welfare; and e. Is compatible with existing and planned land uses in the general area where the development is to be located. Appeals: As stated in Section 8111-8, within 16 calendar days after the permit has been approved, conditionally approved or denied, any aggrieved person may file an appeal of the approval,conditional approval or denial with the Community Development Department who shall set a hearing date before the City Council to review the matter at the earliest convenient date. Zoning Clearance and Building Permit: Upon the expiration of the 16 day appeal period and upon completion of the "prior to Zoning Clearance" conditions, a Zoning Clearance may be obtained from the Community Development Department.
