Consider Opposing Assembly Bill 2471 (Benefit
Assessments) and Supporting AB 2290 and SB 1318
(Disaster Relief)
Council is being asked to consider taking positions on AB 2471
(Rainey), AB 2290 (Katz), and SB 1318 (Hayden).
AB 2471 - Benefit Assessments
It is recommended that Council oppose AB 2471 (Rainey) regarding
benefit assessment districts. Currently under the Benefit
Assessment Act of 1982, the City may levy a benefit assessment to
finance the maintenance of streets, roads, or highways. Any such
assessment can be levied by a two - thirds vote of the Council. If
a majority of the City's voters protest, a proposed assessment
cannot be levied.
If approved, AB 2471 would require all new benefit assessments,
imposed pursuant to the Benefit Assessment Act, to be approved by
a majority vote of the eligible voters. In addition, the bill
would require voter approval of any assessment increase that is
greater than 2.5% per year. The League of California Cities has
taken a position to oppose AB 2471.
AB 2290 and SB 1318 - Disaster Relief
It is recommended that Council support AB 2290 (Katz & Boland) and
SB 1318 (Hayden) regarding disaster relief. If approved, AB 2290
and SB 1318 would allow persons who suffered losses due to the
Northridge earthquake to carry forward the losses relative to their
income or corporation tax. In addition, the bills provide for
state reimbursement to cities and counties of local property tax
losses as a result of the earthquake. The League of California
Cities is supporting both AB 2290 and SB 1318.
Recommendation
Staff recommends the Council express opposition to AB 2471 (Benefit
Assessments) and support for AB 2290 and SB 1318 (Disaster Relief)
and direct the Mayor to convey the City's position to the
appropriate legislative committees
