C.uIFC- r, Coin^I Nook:;g 199Y ACTiON: _i / - L/J AGENDA REPORT /� J ' TO: The Honorable City Council FROM: Jaime Aguilera, Director of IcHm unity Development Paul Porter, Senior Planner Y(f,•J DATE: February 28, 1994 (CC meeting o March 16, 1994) SUBJECT: MINOR MODIFICATION NO. 8 TO CPD 89-2 (Mission Bell Plaza) ON THE APPLICATION OF SHELL OIL COMPANY Background: The City Council certified the original EIR and approved this project (known as CPD 89-1, 89-2 and LDM 89-2) on October 17, 1990. On March 29, 1991, the applicant submitted an application for a Major Modification request for CPD 89-1 and -2 to construct and operate a 265,940 sq. ft. food/retail/commercial shopping center (including 221,440 sq. ft. of general retail uses, 24,000 sq. ft. of restaurants, a 2,300 sq. ft. gasoline service station, 9,000 sq. ft. of medical/dental office and 9,200 sq. ft. outdoor plant nursery) and Tentative Tract Map No. 4757 for a division of two existing parcels into thirteen parcels of land totalling 23.62 net acres . The Tract Map was in addition to the existing approved land division map (LDM 89-2, four parcels) . The City Council approved the Tentative Tract Map and Major Modification on October 2, 1991. Since then, the Department of Community Development has approved seven Minor Modifications for CPD 89-1 and -2 . On February 10, 1994, Shell Oil Company submitted Minor Modification No. 8 for CPD 89-2 for approval of a thirty-five (35) foot wide driveway to be located on Los Angeles Avenue easterly of the existing Carl 's Junior Restaurant. Staff Comments The City Engineer has reviewed the proposed project and has determined that the proposed driveway would be acceptable with the attached Conditions of Approval. The Director of Community Development is deferring this matter to the City Council for review because the Council specifically approved this project without a curb-cut on Los Angeles Avenue on the basis that a curb-cut on Los Angeles Avenue in front of the Shell Service Station would potentially increase traffic hazards on Los Angeles Avenue. Should the City Council choose to approve this Minor Modification for the curb-cut, staff recommends that the attached additional Conditions of Approval be placed on this project. PP03:02:94/4:25(mA:\/aWW8.GC1 1 Landscaping The proposed curb-cut will reduce the amount of landscaping by approximately 500 square feet. Staff has determined that there is no other area on-site in which to add the amount of the reduced landscaping as a result of the curb-cut. However, the recommended conditions include a requirement that the applicant provide additional trees along Los Angeles Avenue and Park Lane and require the existing trash enclosure have vines placed on it. Site plan PP02:02:94/4:25pmAAMImnW8.CC1 2 THESE CONDITIONS OF APPROVAL ARE IN ADDITION TO THE EXISTING CONDITIONS OF APPROVAL FOR CPD 89-2 CONDITIONS FOR CPD 89-2 MINOR MOD NO. 8 1. Left hand turns onto Los Angeles Avenue from or into the project shall be prohibited. Signs shall be posted at the exit indicating no left hand turns. 2 . The proposed driveway shall be constructed per Ventura County Plate E-2 (rev. -B) 3. Prior to any construction, the applicant shall obtain an encroachment permit from Caltrans. 4. A revised landscape plan shall be submitted for review and approval of the Director of Community Development. The following additional landscaping shall be added to the site (The size of the trees be at least the same size or larger as the existing trees. The size of the trees shall be determined by the Director of Community Development) : a. Two more trees of the same variety of the existing trees shall be installed at the planting area at the southwesterly portion of the site. Three additional trees along Park Lane. b. Two more trees in the area of the existing palm trees along Los Angeles Avenue. c . One additional palm tree located to the rear of the building behind the car wash. d. Vines shall be installed around the trash enclosure structure at five feet on center. 5. The existing air and water unit and drain shall be relocated from the existing location adjacent to Los Angeles Avenue to the area adjacent to the vacuum cleaners. 6 . The applicant shall be responsible for design and construction of a raised median with landscaping along Los Angeles Avenue from Park Lane to Liberty Bell Road to prevent vehicles from making left-hand turns onto Los Avenue to or from the site. Prior to issuance of a Zoning Clearance, the subdivider shall submit to the City of Moorpark for review and approval, street improvement plans prepared by a Registered Civil Engineer; and shall post sufficient surety guaranteeing the construction of the improvements . ATTACHMENT 1 803:02:94/4:2Spallz ICIOD8 Cx 3 Any right-of-way acquisition necessary to complete the required improvements will be acquired by the subdivider at it's expense. The raised landscaped median shall be accepted by Caltrans and installed before the driveway can be operational The improvements shall include striping and signing, modifications to the signal, paving, medians, traffic control, and any necessary transitions to the satisfaction of the City Engineer. All driveway locations shall be approved by the City Engineer, the Director of Community Development and Caltrans . The applicant shall dedicate any necessary right- of-way to make all of the required improvements . The median shall be constructed at it's ultimate location.
