Myers, Solid Waste Coordinator J ilt— DATE: May 25, 1994 (CC Meeting of June 1, 1994) SUBJECT: Consider Simi Valley Landfill's Revised Conditional Use Permit For Closure of the Landfill on all Sundays Except the Third Sunday of Each Month SUMMARY Council is being asked to consider authorizing the Mayor to draft a letter to the County of Ventura requesting approval of the Simi Valley Landfill's revised Conditional Use Permit which requires the Landfill to remain open on the third Sunday of each month. BACKGROUND In February 1994, the Task Force began informal negotiations with Waste Management regarding the importation of out -of- county waste, for the purpose of extending the tisef'ul life of the landfill for east county residents and businesses. The position taken by the East County Waste Task Force was to support Sunday closure if, in return, Waste Management agreed to provide acceptable consideration for the restriction of Los Angeles County waste. On April 6, 19941 the City Council took action to support the East County Waste Task Force's negotiation efforts. The Task Force Negotiating Team has since removed the Sunday closure issue from the negotiations and it will now be addressed through separate administrative pr,cessinq. On May 4, 1994, staff from the cities of Moorpark, Simi Valley, Thousand Oaks, County of Ventura Planning Division and Solid Waste Management Department, and the Simi Valley Landfill met to reach a mutually acceptable arrangement ;,n Sunday closure. With the concurrence of the Task Force Negotiating Team, staff is recommending that the Landfill close on all Sundays, except the third Sunday of each month. The th rd Sunday is least impacted by holidays which could potentially interfere with residents use of the Sunday opening. Additionally, the Landfill will continue to provide the East County Cities ith two (2) "free Sundays ". Historically, Moorpark has made arrangements with the Landfill to Honorable City Council Sunday Closure June 1, 1994 Page 2 have the "free" days on Saturday to coincide with the two (2) community clean -up events. The County Planning Division has released a draft of the County Conditional Use Permit (CUP) (attachment A) which would allow this change in the Landfill's operations. The CUP also requires the Landfill to obtain a Zoning Clearance from the County. The Landfill must also provide specific public notification of the proposed change in operations. RECOMMENDATION Staff recommends that the City COU r1C i JL : 1. Support approval of the Simi Valley Landfill's revised Conditional Use Permit for Sunday closure of the Simi Valley Landfill, except on the third Sunday of each month. 2. Direct the Mayor to draft a letter to the County of Ventura Resource Management Agency coriveying the City's action. ATTACHMENT A PFRMITTEE: Waste Management of California PAGE: 1 of 2 This Permit Adjustment amends Condition No. 37 of CUP -3142, Modification No. 4, (approved September 16, 1993) to authorize site closure on Sundays for the life of the Permit except for the third Sunday of each month and an free days a Sunday through the Y required to occur an �petations Contract entered into between the permittee and the County Solid Waste Management Department This Permit Adjustment will expire unless a Zoning Clearance is obtained within 90 days of approval. Prior to issuance of a Zoning Clearance, WMC must submit evidence of authorization for this use from the Solid Waste Management Department and the Environmental Health Department (acting as the Local Enforcement Agency) and that Condition No. 3 has been met. (a) At least fourteen (14) calendar days in advance of the first Sunday closures, a sign notifying landfill patrons of the pending closure shall be posted in clear view at the existing scalehouse, and shall remain posted until the permanent signs identifying days of operation are revised, (see d, below). (b) At least seven (7) calendar days m advance of the first Sunday closure, a legal sized advertisement shall be placed for seven consecutive days in the Thousand Oaks Chronicle and the Simi Valley Enterprise and in one edition of the weekly Moorpark News - Mirror giving notification of pending closure. (c) At least seven (7) calendar days in advance of the first Sunday closure, advertisements shall be run on two Spanish language radio stations, which hrr, d act to the t-JUtheas [ti tern Fa or. of the County, to mn two (Z) to three (3) rimes per day for seven (7) days giving notification of pending closure to Spanish- speaking patrons. 4 CONDITIONS FOR: CUP -3142, Permit Adjustment (Sunday Closure) APPROVAL DATE: 4. RL:ke ATTACHMENT A PERMITTEE: Waste Management of California PAGE: 2 of 2 (d) Within fourteen (14) calendar days after the first Sunday closure event, the existing permanent signs designating hours of operation shall be revised to reflect the closure. (e) Within thirty (30) calendar days after the first Sunday closure. event, the Master Development Plan and the Closure Plan describing days of operation shall be revised and submitted to the Planning Director. Should any oral or written complaint of illegal dumping on Sundays within a one -mile radius of the CUP perimeter be received by any County or City Y agency, WMC shall be responsible for complete removal and proper disposal of all waste and shall perform the clean -up within two hours of receiving oral notification by said Agency.
