SUBJECT: Consider Ventura County Waste Commission Reorganizational
Options
BACKGROUND
On May 19, 1994, the Waste Commission asked its members to have
their respective Councils/Boards consider the reorganization
proposals and select a preference. Members were requested to
report back at the June 16 , 1994 , Waste Commission meeting.
SB 817, authored by Senator Wright on behalf of the Waste
Commission, authorized the creation of a Ventura County Regional
Waste Authority. However, the original proposal by the Waste
Commission for a comprehensive waste management authority was
dismantled by the State Legislature. The amendments to SB 817
deleted many agreed upon provisions that were drafted to accomplish
the intended reorganizational objectives. A consultant (Deloitte
& Touche) confirmed such findings.
In Addition, recent revisions to the AB 939 regulations (AB 2494)
have a direct bearing on the formation of regional agencies.
Specifically, the new regulations provide for the voluntary
formation of regional agencies by all cities and/or counties for
joint AB 939 planning and implementation. Subject to review by the
California Integrated Waste Management Board (CIWMB) , regional
agencies can now be created by inter-jurisdictional agreements,
without special legislation like SB 817 .
It is the State's intent to authorize regional agencies to assist
in reducing the cost of reporting and tracking of disposal and
diversion programs to increase the diversion of solid waste from
disposal facilities while ensuring that member jurisdictions remain
responsible for all of their own AB 939 mandates. Depending on
their membership and charter, such agencies can encompass all of
the policy and planning, program implementation, and system
management objectives as desired with the original SB 817 . The
difference between a regional agency established under the CIWMB's
guidelines and a Waste Authority established under SB 817 is that
the regional agency would not be a separate independent
organization assuming the County's and Cities' functions and
responsibilities. AB 2494 states that cities and counties remain
"responsible" no matter who is in "control" of solid waste issues.

Four scenarios for reorganizing the current system of solid waste
management in the county have been under consideration by the Waste
Commission since March, 1994. These options include alternatives
to restructure City/County activities at the regional and/or
subregional levels. The scenarios are summarized below (and in
Attachment A) , following a brief description of the current waste
management structure.
Current System
Regional planning and program activities (including development of
the Countywide Integrated Waste Management Plan (CIWMP) and Siting
Element) are currently coordinated through the Waste Commission,
which serves as the State-designated AB 939 Local Task Force (LTF) .
Regional AB 939 plans developed by the LTF must also be ratified by
the Board of Supervisors and the majority of City Councils
representing the majority of the incorporated population.
Currently subregional program activities such as HHW collection
events are done by interjurisdictional agreements. Additionally,
the East Ventura County Waste Task Force, consisting of "Eastern
Wasteshed" jurisdictions, has been formed to coordinate programs of
subregional interest to the eastern end of the county. Subregional
public facilities in the western and central areas of the county
are currently operated by the Ventura Regional Sanitation District
(VRSD) , which has recently eliminated former program overlaps with
the County Solid Waste Management Department (SWMD) .
Changes to the current system may require varying levels of legal
and financial commitments. The four scenarios under discussion
include the following:
Scenario I: Countywide Regional Agency
This option consolidates all AB 939 activities of the County
and cities, with no withdrawal by any jurisdiction. This
option also requires the development of a shared ongoing
funding mechanism by the cities and County, as well as a plan
for allocation of liabilities for State noncompliance
penalties. This option most closely approximates the agency
envisioned by SB 817, with the exception that VRSD operations
are excluded.

Scenario II: Sub-Regional Agencies
This option envisions a West County Regional Agency and an
East County Regional Agency. Each regional agency would share
a common plan for meeting AB 939 diversion, funding
implementation programs, and covering any noncompliance
penalties assessed to its members. Regional planning
activities would remain with the Waste Commission functioning
as the LTF.
Scenario III: CIWMP Regional Agency
This option creates a separate County-wide Regional Agency
with independent staff for CIWMP functions and LTF
responsibilities currently performed by the Waste Commission.
A network of subregional Joint Power Authorities (JPAs) or
MOUs would be created for plan implementation. There would be
no withdrawal from the County-wide Regional Agency, however
withdrawal would be possible from subregional groups (JPAs or
MOUs) . VRSD facility operations are excluded.
As in Scenario I , this new agency would require joint funding
agreements by cities and the County, and the development of a
shared liability agreement for applicable County AB 939
noncompliance penalties. This scenario is similar to the
proposal forwarded by Waste Commissioner Kildee (Attachment
B) .
Scenario IV: No Regional Agencies
This scenario would maintain a status quo with no new Regional
Agency formation on a Countywide or subregional basis.
Jurisdictions would continue to cooperate on issues of mutual
concern while maintaining flexibility and local control over
individual community programs. Coordination and planning of
regional programs would continue with the Waste Commission in
its role as the LTF.
Responses Received From Jurisdictions
Three jurisdictions have forwarded letters to the Waste Commission
regarding Council/Board action on reorganization issues and
options.

The County of Ventura Board of Supervisors did not select a
particular scenario. They did however, adopt guidelines under
which County functions may be transferred to a new agency,
including "demonstrative assurances" that the reorganization solves
a clearly defined problem, represents true streamlining and costs
savings, and that the functional transfer is accompanied by a
corresponding transfer of funding responsibilities and liabilities
to a new agency and its members.
The City of Ojai supports the phased reorganization proposal as
outlined by Commissioner Kildee in her letter.
The City of Thousand Oaks supports the formation of subregional
JPA/MOU entities as an initial step to the development of a larger
countywide agency. Subregional cooperative agreements would
coordinate subregional solid waste issues. Development of these
subregional entities would occur first, with the existing Waste
Commission continuing as the AB 939 Local Task Force.
City staff proposes an organizational structure similar to the one
supported by Thousand Oaks. The initial focus would be subregional
entities that come together as a result of shared solid waste
issues and/or facilities. As programs and facilities develop,
there may be a need for a more formalized and independent waste
authority. Until that time, the existing Waste Commission should
continue to discuss, plan, and, where appropriate, implement
regional programs.
RECOMMENDATION CL"
Staff recommends that the City Council:
1. Support the concept of subregional JPA/ U entities for
the purpose of discussing, planning, nd implementing
shared solid waste and AB 939 program ;
2. Support the continuation the Waste Commission in its
existing structure, with dual responsibilities as the
LTF, until the cities and County determine the need for
an independent waste authority; and
3 . Authorize Councilmember Montgomery to communicate the
City's position at the June 16 Waste Commission meeting.

Dear Commissioners:
I am writing to express my regrets that, due to my attendance at
the National Association of Counties . (NACo) annual meeting, I will
be unable to join you at the scheduled March 10 Commission workshop
to discuss the future direction of our reorganization plan. As one
who has been intimately involved in these efforts over the past
several years, I am keenly interested in the Commission's
deliberations and in the outcome of this important meeting. For
this reason, I 'd like to share some preliminary thoughts I have on
"the issues before us in the hope that they will become a part of
the workshop discussions.
It seems that we have reached an important crossroads in our
efforts to redesign the county's solid waste management system. We
began this project in June 1991 with the intent of resolving major
issues and organizational problems that have historically led to
conflict between the cities and the County. Major reorganization
objectives have been the elimination of conflicting solid waste •
policies pursued by the County, cities, and VRSD, and the
elimination of duplicative solid waste functions and programs among
public agencies. Later in our deliberations, indemnification of
solid waste liabilities also became an important issue. Most of
our efforts over the past two and one-half years have been devoted
to reaching a consensus on how these objectives could be met
through the creation of a single countywide agency with
consolidated powers and functions. The August 6th Accord was the
culmination of this lengthy process.
1, like you, was deeply disappointed when the compromise proposal
we so painstakingly constructed for a comprehensive Waste
Management Authority was dismantled by the State Legislature. As
recently confirmed by our latest round of consultants, the

programs, liability funding agreements, and other ventures of
mutual benefit. This initial reorganization phase, where policy
development occurs on a regional level and policy implementation
decisions are deferred to subregional consortia, can provide the
basis for future consolidation efforts, as warranted.
We've all worked very hard to get to this point. We should not
look back, nor should we be dissuaded by roadblocks at the State
level. By utilizing the existing powers we hold in common as
cities and the County, we can effectuate reasoned changes in our
current system now, without legislation or further expenditures.
And by phasing these changes, I believe we will build a stronger
consensus on many of the subregional and local issues that have
been troublesome throughout our current reorganization efforts.
I hope you will join me in supporting the suspension of further
consultant studies, and the establishment of immediate steps to
empower the Commission as an independent policy making board. once
established, that Board can consider the nature and phasing of
subsequent system changes that may enhance the efficiency and
effectiveness of city and County waste management programs.
