SUBJECT: CONSIDER MINOR MODIFICATION NUMBER 4 TO DEVELOPMENT
PERMIT NUMBER 302 (AMERICAN PRODUCTS)
BACKGROUND
On May 22, 1985, Development Permit Number 302 was approved by the City Council
(Resolution Number 85-302) for the construction of a 109,300 square foot office and
manufacturing building. Major Modification Number 1 was approved on March 2, 1988,
and Slowed the construction of a 121,520 square foot office, manufacturing and
warehouse building, which adjoined the existing 109,300 square foot building. The
subject building is 230,820 square feet in size, and is occupied by American Products,
located at 10951 West Los Angeles Avenue.
American Products is requesting approval to modify Condition of Approval Number 19
to Major Modification Number 1. Pursuant to this condition of approval, if signage is
requested for the subject building, only a Monument Sign may be installed.
DISCUSSION
Conditions of Approval
Major Modification Number 1 to Planned Development Permit Number 302 stated, "...only
a Monument Sign shall be permitted for this development plan and shall not exceed 30
square feet, no higher that 5 feet above average ground level. A sign program shall be
submitted and approved by the Director of Community Development for all other on-site
direction signs" (see Attachment Number 1). For the Council's information, no other
signage is present on the existing building.
American Products Proposal
American Products is requesting approval to install two wall signs, in two locations on the
same elevation (see Attachment Number 2) facing Los Angeles Avenue. The total
proposed sign area for each sign is 59 square feet; the total sign area for both signs is

118 square feet. The proposed letter size is 8 '1 inches and each logo stripe is 11 %
inches. The height of the sign, from the top to bottom of each logo stripe, is 5 feet two
inches (5' 2').
Conformance with the City's Sign Ordinance and Staff's Analysis
The City's Sign Ordinance does not allow more than one sign per elevation, with a
maximum of 120 square feet of sign area for the entire building. Therefore, the Director
of Community Development has denied the request for two wall signs on one elevation.
One wall sign has been approved (in lieu of the Monument Sign) on the south elevation
(Los Angeles Avenue) by the Director at a location to be determined by the applicant and
approved by the Director of Community Development (see Attachment Number 3). The
Zoning Ordinance allows only one wall sign per elevation and the proposal as approved
by the Director of Community Development complies with all sign regulations including
size.
Staff has visited the site and determined that installation of a Monument Sign would not
be an effective form of sign advertising based upon existing site constraints. The existing
and improved flood control channel south of the site, parallel to Los Angeles Avenue,
hinders the ability to install an effective form of low ground signage.
Overview
Staff has reviewed the original conditions of approval for Development Permit Number
302 and Major Modification Number 1 and has determined that the applicant is in
compliance with all other conditions of approval. The Director of Community
Development has reviewed the Minor Modification request and conditionally approved the
proposed modifications to the development permit on July 6, 1994,with the appeal period
ending on July 22, 1994. If no appeal is filed, the Director's decision will stand. If the
Council wishes to appeal the Director's decision, the next available public hearing would
be August 3, 1994. Pursuant to Resolution Number 88-523,the Director has the authority
to approve Minor Modifications.

16. That trash disposal areas shall be provided in a location which will not interfere with
circulation, parking or access to the building and shall be screened with a six (6) foot
high, solid wall enclosure with metal gates, final design of said enclosure shall be
subject to the approval of the Director of Community Development prior to the
issuance of zone clearance.
17. That all utilities shall be underground to the nearest off-site utility pole except through
transmission lines.
18. That all parking shall be surfaced with asphalt or concrete and shall include adequate
provisions for drainage, striping and appropriate wheel blocks or curbs in parking
areas.
19. That signs are subject to the Moorpark Code, Chapter 50, Title 9, Sign Ordi-
nance. A sign permit is required. No building signs of any type shall be allowed on
any building wall or window. Only a monument sign shall be permitted for this
development plan and shall not exceed 30 square feet, no higher than 5' above average
ground level. A sign program shall be submitted and approved by the Director of
Community Development for all other onsite directional signage.
20. Roof design and construction shall include a minimum 18" (inch) extension of
the parapet wall above the highest point of the roof.
21. That the permittee agrees as a condition of issuance and use of this permit to
defend, at his sole expense, any action brought against the City because of issuance (or
renewal) of this permit or in the alternative to relinquish this permit. Permittee will
reimburse the City for any court cost which the City may be required by court to pay
as a result of any such action. The City may, at its sole discretion, participate in the
defense of any such action, but such participation shall not relieve permittee of his
obligation under this condition.
22. That the continued maintenance of the permit area and facilities shall be subject to
periodic inspection by the city. The permittee shall be required to remedy any defects
in ground maintenance, as indicated by Code Enforcement Officer within thirty (30)
days after notification.
23. Prior to issuance of a zoning clearance, the final working drawings shall be
submitted to the Director of Community Development for review and approval.

Ordinance Compliance: Based upon the information and findings developed by staff, it
has been determined that this application, with the attached conditions, meets the
requirements of Moorpark Ordinance Code Section 8111-2.1.2-Permit Standards, in that:
a. The Minor Modification is consistent with the intent and provisions of the City's
General Plan and Division 8, Chapters 1 and 2 of the City Ordinance Code;
b. The Minor Modification is compatible with the character of surrounding
development;
c. The proposed Minor Modification is not obnoxious or harmful, or impairs the utility
of neighboring property or uses;
d. The Modification is not detrimental to the public interest, health, safety,
convenience, or welfare; and
e. Is compatible with existing and planned land uses in the general area where the
development is to be located.
Appeals: As stated in Section 8111-8, within 16 calendar days after the permit has been
approved, conditionally approved or denied, any aggrieved person may file an appeal of
the approval,conditional approval or denial with the Community Development Department
who shall set a hearing date before the City Council to review the matter at the earliest
convenient date.
Zonina Clearance and Building Permit: Upon the expiration of the 16 day appeal period
and upon completion of the "prior to Zoning Clearance" conditions, a Zoning Clearance
may be obtained from the Community Development Department.
