Gilbert, Director of Public Works IN FROM: DATE: July 8, 1994 (Council Meeting 7-20-94) SUBJECT: Consider Approval of the Granting to Caltrans Additional Street Right-of-Way at the Northeast Corner of the Civic Center Property Required for a Project to Widen Walnut Canyon Road in the Vicinity of Wicks Road and Casey Road. BACKGROUND A number of years ago Caltrans initiated a project to widen Walnut Canyon Road [State Route 23] near the Wicks Road / Casey Road curve. The purpose of this project is to improve sight distance visibility and to provide a center left-turn lane along this portion of the highway. DISCUSSION A. Right-of-Way Acquisition In order to construct the proposed street improvement project it will be necessary for Caltrans to acquire additional right-of-way on Walnut Canyon Road. One of the pieces of property required for the project is located at the northeast corner of the Civic Center property. This parcel , which is shown on the map attached as Exhibit 1 , is approximately 357 sq. ft. in area. Caltrans made an offer to the City to purchase this parcel for $2 ,300, or $5 per sq. ft. It was the opinion of staff that the amount of this offer was too low. City staff continued to negotiate with Caltrans regarding the value of the property. B. Right of Entry Permit On March 16 , 1994 , the City Council granted Caltrans a Right-of-Entry Permit to allow the construction of the project to proceed on schedule and not be hampered by the price negotiations for the right-of-way acquisition. wlntrow2 IL Walnut Canyon Road Widening July 1994 Page 2 C. City Request for Additional Sidewalk Improvements The design for the Caltrans street widening project shows the construction of a sidewalk on the west side of the street north of the Civic Center driveway. However, that plan shows the sidewalk ending approximately three hundred feet (300' ) south of Casey Road (see Exhibit 2) . Staff made a request to Caltrans that they modify their design by extending this sidewalk northerly to Casey Road. It was proposed to Caltrans that if they would consider adding these sidewalk improvements to their project, the City would consider the following: 1) conveying to Caltrans at no cost any additional right- of-way required from the Civic Center property to accommodate the additional sidewalk; 2) providing assistance to Caltrans to facilitate the acquisition of any additional rights-of-way required from the two property owners to the north (Moorpark Unified School District and the Moorpark Boys and Girls Club) ; and, 3) accepting the above described offer of $2, 300 for the initial right-of-way requested by Caltrans. D. Caltrans Agreement to Copstruct Additional Sidewalk In a letter dated April 26, 1994, (Exhibit 3) Caltrans accepted the City's terms and agreed to construct the additional sidewalk. It is the intent of Caltrans to construct these improvements by means of a change order to the construction contract they intend to award within the next few months. Caltrans is now in the process of preparing additional right-of-way deeds and temporary construction easements for this additional work. Upon completion of those documents, they will be forwarded to the City, the Moorpark Unified School District and the Moorpark Boys and Girls Club for execution. E. Right-of-Way Certification Caltrans has requested that the City and Caltrans proceed with and conclude the steps necessary to finalize the street right-of-way acquisition initially proposed. The completion of these efforts are necessary for Caltrans to certify the right-of-way acquisition for this project. If approved by the City Council, it is the intent of staff to forward these documents to Caltrans with a letter documenting the additional construction effort agreed to by Caltrans. wlntrow2 Walnut Canyon Road Widening July 1994 Page 3 RECOMMENDATION Staff recommends that the City Council take the following actions: 1 . Accept the offer by Caltrans of the payment of $2,300 for the purchase the property generally described in Exhibit 1 . 2. Authorize the Mayor to execute the Grant Deed (Exhibit 4) and other documents related to said sale. Moorpark, California 93021 Dear Mr. Gilbert: • Thank you for your April 11, 1994 letter, in which you requested Caltrans to reconsider extending the sidewalk by 300 feet up to Casey road on the west side of Route 23 (Walnut Canyon Road) , and to include it along with the Caltrans ' widening project planned for construction this year. As stated in your letter, the City of Moorpark is willing Lo dedicate the right-of-way that will be needed to extend this sidewalk, at no cost to the State. You also stated that you' re willing to work with the Moorpark Unified School District (MUSD) to do the same along their property. Caltrans has reviewed your proposal and is agreeable to the inclusion of this extension in the widening project an the presumption that both entities will dedicate the required right- of-way. The right-of-way acquisition and temporary construction easement requests will be submitted to the MUSD and your office for execution. Becaus.e_ of short lead time, the .proposed sidewalk will be constructed by contract change order at a later date.
