SUBJECT: Consider Support for AB 3754, Parking and Business
Improvement Areas, and BB 1564, Property Tax
Allocation, and Opposes AB 2788, Public Safety
Maintenance of Effort Requirements
Background
The City Council is being asked to support AB 3754, Parking and
Business Improvement Areas, and SB 1564, Property Tax Allocation,
and oppose AB 2788, Public Safety Maintenance of Effort
Requirements. In addition, the Council is being requested to
direct the Mayor to communicate the City's position on these bill
to the appropriate legislative representatives and committees.
AB 3754. Parkina and Business Improvement Areas: Staff and the
League of California Cities are recommending that the Council
support AB 3754 (Caldera) . If approved, the bill would
authorize benefit assessments on property owners rather than
business owners as does the Parking and Business Improvement
Area Law of 1989. Property owners who would pay more than 50
percent of the assessments proposed to be levied must petition
to form a district.
The benefit assessments could be used for improvements such as
parking facilities, benches, pedestrian shelters, public
restrooms, lighting facilities, parks, planting areas, closing
or opening streets, or rehabilitation or removal of existing
structures. The assessment could also be used to fund
activities such as promotion of public events, marketing,
economic development, graffiti removal, or street and sidewalk
cleaning.
