Traffenstedt, Senior Planner 'DX -1, DATE: May 13, 1994 (CC Meeting of 5- 18 -94) SUBJECT: CONSIDER ADOPTION OF RESOLUTION INITIATING AN AMENDMENT OF ORDINANCE NO. 189, MOORPARK ZONING ORDINANCE, INCLUDING AMENDMENT OF ARTICLE 18, ZONING MAP, FOR GENERAL PLAN AND ZONING ORDINANCE CONSISTENCY PURPOSES Background Revisions to the Moorpark Zoning Map are required to achieve consistency with the General Plan Land Use Element and the recently adopted Zoning Ordinance (No. 189), as discussed below. Section 65860(d) of the Government Code requires that in the event that a zoning ordinance becomes inconsistent with a general plan by reason of amendment to such a plan, or to any element of such a plan, such zoning ordinance shall be amended within a reasonable time so that it is consistent with the general plan as amended. Discussion The City Council adopted updated Land Use and Circulation Elements in May 1992. The adopted land use plan included new Open Space 2 (OS -2) and Public Institutional (PUB) designations for properties. Follow -up rezoning was accomplished by the adoption of Ordinance No. 155 in November 1992; however, the acreage designations for new OS Zone properties were inadvertently not included. Without an acreage designation, the OS Zone allows minimum 10 acre lots, with one dwelling unit permitted per lot. The OS -2 General Plan land use designation requires 40 acre minimum lots. Therefore, the correct zone designation should have been OS -40 Acres (although a lesser acreage designation could be imposed for OS zoned parcels that are already smaller than 40 acres). No zone change for properties newly designated as Public Institutional was accomplished in 1992, because there was no Institutional Zone designation. The new Zoning Ordinance (No. 189), recently adopted in March 1994, now includes an Institutional Zone, and the Zoning Map should now be revised to show Institutional Zone designations consistent with those properties The Honorable City Council May 13, 1994 Page 2 designated as Public Institutional on the General Plan land use map. The City Hall property is one such property, and should have the zoning revised from Commercial Planned Development (CPD) to Institutional. Another Zoning Map revision, which is required to achieve consistency with the new Zoning Ordinance, is to change the Trailer Park Development (TPD) Zone shown for the Villa Del Arroyo Mobilehome Park property to Residential Planned Development (RPD). The new Zoning Ordinance does not include any reference to a TPD Zone, and a RPD- Mobilehome Park (MHP) Zone designation (including appropriate limitation on number of dwelling units permitted per acre) would be appropriate. Section 8115 -1.1.a of the Moorpark Zoning Ordinance provides that an amendment of the Zoning Ordinance may be initiated by the adoption of a Resolution of Intention by the City Council requesting the Planning Commission to set the matter for study, hearing, and recommendation within a reasonable time. Staff has prepared a draft Resolution of Intention (attached) to initiate a Zoning Map amendment for the reasons identified in this report. The need for other minor corrections or changes to the Zoning Map or Zoning Ordinance will also be analyzed by staff in conjunction with this zoning amendment action. Recommendation Adopt a resolution initiating proceedings, directing the Planning Commission to study, set a public hearing, and provide a recommendation to the City Council pertaining to a proposed amendment of Ordinance No. 189, Moorpark Zoning Ordinance, including amendment of Article 18, Zoning Map.
