Gilbert, Director of Public Works DATE: May 10, 1994 (Council Meeting 5- 18 -94) SUBJECT: Consider Resolution No. _ _ to Enable the Enforcement of the California Vehicle Code on Certain Private Roads and Parking Facilities Located Southeast of the Intersection of Penn Street and Stanford Street (Varsity Park South HOA OVERVIEW This presents for consideration at a public hearing, a resolution making the private roads and parking areas in Varsity Park South, located southeast of Stanford Street and Penn Street, subject to the provisions of the California N'ehic:le Code (CVC) . DISCUSSION A. Authority The City enforces the CVC in a number of privately owned parking areas in commercial shopping centers and multi - family residential developments. Enforcement of the CVC on private property requires the adoption of a resolution by the local agency at the request of the property owner. B. Reguest Attached as Exhibit 1 is a copy of a Resolution of the Board of Directors of the Varsity Park South Homeowners' Association, requesting that the Moorpark Police Department enforce traffic regulations on the streets and in the parking areas located on private property owned by the BOA. C. Notice A notice of this Public Hearing was sent to the applicant in accordance with the requirements of the California Vehicle Code. RECOMMENDED ACTION Staff recommends that the City Council adopt the attached resolution declaring certain roads on private property subject � the California Vehicle Code. Pursuant to the requirements of Sections 21107.5 and 21107.8 of the California Vehicle Code, THIS IS TO NOTIFY the owners of the affected property that a public hearing on this matter will be held at a regular meeting of the Moorpark City Council on May 18, 1994, commencing at 7:00 p.m. at the Moorpark: Community Center, 799 Moorpark Avenue, Moorpark, Califorria. This will also serve to request that you advise all of the property owners and residents within the Varsity Park South HOA of this hearing.
