DATE: May 10, 1994 (CC Meeting of May 18, 1994) SUBJECT: Consider Ordinance Amending Solid Waste Ordinance 123, Municipal Code Chapter 8.36., Section 050 for the Purpose of Addressing the Placement and Storage of Solid Waste and Recycling Containers BACKGROUND On February 25, 1994, the City received a complaint from a resident about the storage of solid waste containers. The resident is concerned about the unsightliness of the receptacles stored at a residences in locations visible from the street and adjacent properties. The Moorpark Municipal Code, Chapter 8.36 does not currently address the proper placement and storage of solid waste or recycling containers at times other than on regularly scheduled collection days. The Public Works, Facilities, and Solid Waste Committee (Councilmembers Wozniak and Montgomery) and staff believe it is appropriate to address the storage of solid waste and recycling containers in the Municipal Code. As you are aware, this item was originally scheduled for consideration at the April 6, 1994, City Council meeting. Councilmember Wozniak expressed concerns about the last sentence of the proposed language_ The Public Works, Facilities, and Solid Waste Committee discussed this matter and determined that the inclusion of the last sentence would make enforcement difficult due to the varied elevations of adjacent lots. After discussion by the Committee, the last sentence was deleted. The Public Works, Facilities, and Solid Waste Committee and staff propose that the following language be included in the Moorpark Municipal Code: "No receptacle or bin shall be stored in any required side yard that abuts any public street or in any required front yard. Every receptacle or bin shall be stored in a manner such that it is screened and not visible from the street, sidewalk, or alley. The City Attorney reviewed the proposed ordinance and her comments were incorporated. The proposed language is included as 8 36.050.F. RECOMMENDATION The Public Works, Facilities, and Solid Waste Committee (Councilmembers Wozniak and Montgomery) and Staff recommend that the City Council approve Solid Waste Ordinance 123 as amended for first reading.
