Hare, City Clerk- By _ DATE: July 23, 1994 (CC meeting of 4/6/93) SUBJECT: CONSIDER RESOLUTION 94- (f''-7 RELATIVE TO THE FILING OF NOTICES OF COMPLETION FOR PUBLIC PROJECTS BACKGROUND In response to a request by staff for clarification on the requirement to file notices of completion, the City Attorney has opined that the City is under no mandatory duty to file notices of completion. The advantage of doing so is primarily an administrative one, as stop notices may be filed for 30 days after the recordation of a notice of completion but the period is extended to 90 days after the work is accepted as complete, if no notice of completion is recorded. It has been the practice of the City to prepare an agenda item for Council to authorize the filing of a notice of completion on all public projects no matter what the dollar amount of the job. To simplify procedures and streamline processing, the following policy regarding the filing of notices of completion is suggested: COST OF PROJECT FILING OF NOTICE OF COMPLETION $1, 000 or less Not required. $1, 001 - $15, 000 City Manager authorizes the filing. Over $15, 000 Council authorize filing. The amounts listed above comport to the City's purchasing and bid thresholds ($1, 000 or less - bidding not required; $1, 001 to $15, 000 - informal bidding; over $15, 000 - formal bidding, award is agendized) .
