SUBJECT: Consider Resolution No. 94 - Establishing
Certain Parking Restrictions on the South Side of Los
Angeles Avenue between Moorpark Avenue and Park Lane
OVERVIEW
This presents a Resolution
restrictions on the south side
Moorpark Avenue and Park Lane.
DISCUSSION
A. Overnight Parking of Trucks
establishing certain parking

The dirt shoulder area on the south side of Los Angeles
Avenue between Moorpark Avenue and Park Lane is used for the
parking of large trucks and semi -truck and trailers to allow
drivers to use the commercial services located at the
Moorpark Town Center. It has been observed that some trucks
park in this area for an extended period of time late at
night and through the early morning hours using the area as
an overnight rest stop.
B. Transportation & Streets Committee
At a recent meeting of the Transportation and Streets
Committee (Mayor Pro tem Hunter and Councilmember Wozniak) it
was recommended that staff pursue efforts necessary to
prohibit the overnight parking of all vehicles along this
dirt shoulder area.
C. Private Road
It appears that the subject dirt shoulder area may be located
south of the state highway right -of -way, and may, therefore,
be considered a private road. Section 21107.5 of the
California Vehicle Code provides for the establishment of
parking restrictions on a private road, subsequent to a
public hearing for which notice, given at least ten (10) days
prior to the scheduled public hearing, has been given to the
owners of the properties affected.

CVC Section 21107.5 (c) requires the City Council to hold a
public hearing and give at least a ten (10 ) day notice of
said hearing to the owners of the affected properties. Such
a notice was sent.
Subsequent to the public hearing, the City Council may adopt
a resolution imposing parking restrictions on a private road,
even if the property owner(s) object. However, if an owner
erects a sign in accordance with the requirements set forth
in CVC Section 21107.5 (b), stating that the road is
privately owned and maintained and that it is not subject to
traffic regulations or controls, the resolution becomes
unenforceable.

ILOW
I. NO STOPPING -- In November of 1991, the City Council
adopted Resolution No. 91 -818 establishing a number of
parking restrictions including a NO STOPPING ANYTIME zone
on the south side of Los Angeles Avenue from a point one
hundred feet east of Park Lane, westerly to a point west
of Butter Creek Road. This NO STOPPING restriction
applies to the frontage of the Circle -K property.
It is recommended that another NO STOPPING ANYTIME zone be
established on the south side of Los Angeles Avenue from
Moorpark Avenue westerly to a point approximately two
hundred fifty feet (2501) west of Moorpark Avenue. This
restriction will ease congestion near the intersection of
Los angeles Avenue and Moorpark Avenue. The limits of
this additional parking restriction is also coincidental
with the limits of the street improvements required by the
future development of the property at the southwest corner
of Moorpark Avenue and Los Angeles Avenue.
2. NO PARKING 10:00 P.M. TO 5:00 A.K. -- It is recommended
the remaining area between Moorpark Avenue and Park Lane
be designated NO PARKING 10: P.m. to 5:00 a . m . in order to
prevent the overnight parking of large trucks.

F. Staff Review
The City Attorney and the Deputy Chief of Police were
provided earlier drafts of this resolution and have provided
input to the author regarding the proposed action
G. Caltrans Approval
In accordance with applicable CVC requirements, it is
proposed that the parking restrictions set forth in the
attached resolution be approved by Caltrans.
RECOMMENDED ACTION
Staff and the Transportation and Streets Committee recommend
that the City Council adopt the attached Resolution establishing
certain parking restrictions on the south side of Los Angeles
Avenue between Moorpark Avenue and Park Lane.

RESOLUTION NO. 94 -
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MOORPARK, CALIFORNIA, ESTABLISHING CERTAIN
PARKING RESTRICTIONS ON THE SOUTH SIDE OF LOS
ANGELES AVENUE BETWEEN NOORPARK AVENUE AND
PARK LANE
WHEREAS, it is desire of the City Council to establish
certain parking restrictions on the south side of Los Angeles
Avenue between Moorpark Avenue and Park Lane, said street segment
being designated a State Highway; and,
WHEREAS, Section 22506 of the California Vehicle Code (CVC)
provides for the establishment of parking restrictions on a State
Highway subject to the approval of Caltrans; and,
WHEREAS, it appears that the dirt shoulder on the south side
of this segment of street may be located south of the state highway
right -of -way, and may, therefore, be considered a private road;
and,
WHEREAS, CVC Section 21107.5 provides for the establishment
of parking restrictions on a private road by a local agency,
subsequent to a public hearing on the matter and notice having been
given to the affected property owners at least ten days prior to
said hearing.
WHEREAS, notice of a public hearing, to be convened at 7:00
p.m. on August 3, 1994, in the City Council Chambers of the
Moorpark City Hall, was sent to the owners of all affected
properties, advising said property owners of the intent of the City
Council to consider the establishment of the aforesaid parking
restrictions; and,
WHEREAS, said public hearing was convened and public
testimony was received regarding said proposed action.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES HEREBY FIND, DETERMINE, RESOLVE, AND ORDER AS
FOLLOWS:
SECTION 1. That the dirt shoulder on the south side of Los
Angeles Avenue between Moorpark Avenue and Park Lane has generally
been held open for use by the public for vehicular travel and is
connected to a highway in such a manner that the public cannot
determine that this dirt shoulder is not a part of the highway.

SECTION 2. That NO STOPPING ANYTIME zones are hereby
established on the south side of Los Angeles Avenue between from
Moorpark Avenue westerly to a point approximately two hundred fifty
feet (2501) west of Moorpark Avenue, as generally shown on Exhibit
'A' attached hereto and made a part hereof.
SECTION 3. That a NO PARKING 10:00 P.M. TO 5 :00 A.M zone is
hereby established on the south side of Los Angeles Avenue from a
point approximately two hundred fifty feet (2501) west of Moorpark
Avenue, westerly to a point approximately one hundred feet (1001)
east of Park Lane, as shown on Exhibit 'A.'
SECTION 4. That said zones shall not apply to Bus Stops,
Loading Zones and other such areas designated by Resolution of the
City Council for the stopping of vehicles.
SECTION 5. That a copy of this resolution shall be forwarded
to Caltrans for approval.
SECTION 6. That, upon receipt of approval by Caltrans, the
City Manager shall provide for the installation of and maintenance
of the appropriate signs and markings giving notice of said parking
restrictions.
