Myers, Solid Waste Coordinator By DATE: July 19, 1994 (CC Meeting of August 3, 1994) SUBJECT: Consider Approval of the Final Draft Nondisposal Facility Element (NDFE) in Compliance with AB 939 Summary The City Council is being asked to receive public testimony on the Nondisposal Facility Element (NDFE) and consider the final draft NDFE for adoption by resolution. Background A Nondisposal facility is defined as any solid waste facility required to obtain a state solid waste facility permit except a disposal facility (landfill) or a transformation facility (incineration or waste to energy). Such facilities include transfer stations, materials recovery facilities, and large scale yard waste and composting facilities. Attached, you will find Moorpark's proposed Nondisposal Facility Element (NDFE) prepared in compliance with the amended regulations Of AB 939. The regulations require that every city and county prepare and adopt a Nondisposal Facility Element (NDFE) for all Nondisposal facilities that will be needed to implement the Source Reduction and Recycling Elements (SRRE). Currently no Nondisposal facilities are needed to achieve the City's short -term (1995) diversion requirements, and such facilities may be considered to meet the long -term goals (2000). However, Moorpark has included a brief description of other facilities that will be utilized to attain diversion and program implementation goals. Similar to the SRRE, the NDFE was submitted to the Local Task Force (Waste Commission) for review and comment regarding the regional impacts of any Nondisposal facilities identified. The Waste Commission reviewed Moorpark's NDFE at its meeting on March 17, 1994. At the meeting, a thirty (30) day public review period was posted. The Waste Commission provided written comments to Moorpark in late April 1994. No changes were needed. For adoption of the final draft NDFE by the City Council, public hearing notice was published requesting public input. Honorable City Council Nondisposal Facility Element August 3, 1994 Page 2 The regulations state that the NDFE must be submitted to the Board within thirty (30) days after the element is adopted by a local jurisdiction. The NDFE must be submitted to the California Integrated Waste Management Board (Board) by August 31, 1994. The NDFE was reviewed by the Public Works, Facilities, and Solid Waste Committee (Councilmembers Montgomery and Wozniak) at their meeting on March 1, 1994. Recommendation The Public Works, Facilities, and Solid Waste Committee and Staff recommend that the City Council receive public testimony and approve by resolution the final draft of the Nondisposal Facility Element (NDFE).
