Gilbert, Director of Public Works DATE: July 28, 1994 (Council Meeting 8 -3 -94) - SUBJECT: Consider Assuming the Maintenance of Parkway and Median Landscaping on Tierra Rejada Road in the Mountain Meadows Planned Community [PC -31 K11DUVIA This request approval of the steps required for the City to take over the landscape maintenance responsibilities for the parkways and medians on Tierra Rejada Road from the Edison Easement located just west of Walnut Creek Drive, westerly to the'Tierra Rejada Road bridge. DISCUSSION A. Landscape Maintenance Responsibilities With some exceptions, the City of Moorpark provides for the maintenance of the landscaping located in the parkways and the medians on major arterial streets throughout the City. The cost of this maintenance is funded by the assessments levied by Assessment District 84 -2. All of the City's median maintenance costs are funded by a Citywide assessment. City costs for the maintenance of some parkways are also funded by the Citywide assessment. In addition, the cost of maintaining certain parkways is funded by an assessment on the lots within a number of Zones of Benefit, which are deemed to derived benefit from this parkway landscaping. The parkway landscape maintenance funded by Zone assessments includes a number of parkways on Tierra Rejada Road including the following: Zone Tract Developer Tierra Rejada Road From To 2 2865 Pacifica East of Spring Rd, 2000 feet east of Peach westerly Hill Road 2 2865 Pardee 2000 feet east of Peach Hill Road Peach Hill Road, westerly 5 3019 / Warmington Peach Hill Road Edison Easement 3525 westerly tr _ls Tierra Rejada Road Landscaping August 1994 Page 2 In recent months staff and the developer, California Community Builders (CCB) [formerly Urban West Communities (UWC)], have been working to resolve a number of issues prerequisite to the City's acceptance for maintenance of that portion of Tierra Rejada Road within PC -3. As a part of that process, the City Council recently authorized staff to advertise for bids for the construction of minor repairs and the application of a Type II Slurry Seal to the entire length of Tierra Rejada Road, including that portion within PC -3. CCB has agreed to reimburse the City for any of the project costs related to that portion of the work performed within PC -3. A number of other matters need to be resolved prior to proceeding with the City's Slurry Seal project. They include the following: • action by CCB to construct needed repairs to- sidewalks and gutters; • action by CCB to remove and replace problem asphalt and base in the street; • resolution of problems (visibility and infrastructure damage) caused by parkway trees(l); and • resolution of questions pertaining to the long -term maintenance of the parkway and median landscaping(2). Notes: 1. Staff will be meeting with CCB in the near future to discuss the tree problem and related issues. 2. The parkway and median landscaping on Tierra Rejada Road within PC -3 has been maintained by the developer since these improvements were constructed. C. PC -3 Specific Plan The Specific Plan for the Mountain Meadows planned Community (PC -3) was initially approved by the County of Ventura prior to the City's incorporation. That plan called for the developer (Urban West Communities) to construct and maintain a number of public facilities, including that portion of the parkway and median landscaping on Tierra Rejada Road which is located within this development. Table 5 of the Specific Plan (Exhibit 1) lists a number of the parks and open space improvements required to be provided by the developer. The right -hand column of that table states that the maintenance responsibilities for these improvements should eventually be assumed by a public mechanism. In the opinion of staff that public mechanism was established when the City formed Assessment Districts to fund such maintenance costs. tr_10 Tierra Rejada Road Landscaping August 1994 Page 3 Most of the parks and open space improvements constructed by the developer, including Mountain Meadows Park, Tierra Rejada Park Peach Hill Wash, etc., are now or are scheduled to be maintained by this public mechanism. Item #6 of Table 5 also cites roadway landscaping as being maintained by this public mechanism. D. Alternatives The City Council may consider approval of one of the following alternatives: Alt. 11 -- City Assumes Maintenance of Parkways and Medians: If this Alternative is selected, it is recommended that the City Council direct that staff undertake and implement. the following tasks: a. assume the maintenance of the hardscape improvements (concrete and pavement) subsequent to completion of corrections by the developer; b. resolve any problems caused by parkway and /or median trees; c. final inspection, correction and acceptance of the landscape and irrigation improvement prior to June 30, 1995; d. preparation, execution (by developer) and recordation of deeds to the parkway parcels on Tierra Rejada Road; and, e. provide language in the draft Engineers Report for AD84 -2 for FY 1995/96 addressing the following: • City maintenance of the medians on Tierra Rejada Road within PC -3 to be funded by the Citywide landscape maintenance assessment; • City maintenance of the parkways on Tierra Rejada Road within PC -3 to be funded by one or more new Zones of Benefit; • the establishment of one or more new Zones of Benefit to encompass all of the properties within PC -3; and, • the development of assessments for the properties within each of these new Zones of Benefit sufficient to fund the cost of maintaining the parkways on Tierra Rejada Road within PC -3. tr is Tierra Rejada Road Landscaping August 1994 Page 4 Alt. 12 -- City Assumes the Maintenance of Median Only: If this Alternative is selected, it is recommended that the City Council direct that staff undertake and implement the following tasks: a. assume the maintenance of the hardscape improvements (concrete and pavement) subsequent to completion of corrections by the developer; b. resolve any problems caused by parkway and /or median trees; c. final inspection, correction and acceptance of the landscape and irrigation improvement prior to June 30, 1995; d. provide language in the draft Engineers Report for AD84 -2 for FY 1995/96 allowing the City to consider City maintenance of the medians on Tierra Rejada Road within PC -3 to be funded by the Citywide landscape maintenance assessment. e. Take steps to provide for the installation of irrigation water sub- meters, separate irrigation controllers and other system modifications which will allow for an accounting of costs for providing irrigation water to the medians. f. Develop and present for approval by the parties, an Agreement between the City and the developer pertaining to City payment to the developer the cost of providing irrigation water to the median. Alt. 13 -- No Change: Deny request or defer action at this time.
