MEMORANDUM TO: The Honorable City Council ITEM � lye FROM: Jaime Aguilera, Director of Community Development) Paul Porter, Senior Planner DATE: October 28, 1994 (CC meeting of November 16, 1994) SUBJECT: CONSIDER APPROVAL OF MINOR MODIFICATION NO. 2 TO PLANNED COMMUNITY NO. 3 (URBAN WEST COMMUNITIES /MOORPARR INVESTORS, LTD) FOR MODIFICATION OF APPROVED LANDSCAPE PLAN TO REFLECT THE "AS- BUILT" LANDSCAPING ALONG TIERRA REJADA ROAD FROM SOUTH END OF ARROYO SIMI BRIDGE TO THE SOUTHERN CALIFORNIA EDISON EASEMENT Background On November 20, 1984, the Landscape Plans for Mountain Meadows Streetscape (Tract 3274), prepared by David L. Simon Landscape Architect, was approved by the City. These Landscape Plans included the landscaping for the Tierra Rejada Street parkway landscape and median from the Arroyo Simi Bridge to the Southern California Edison Easement. Discussion In anticipation of the City accepting maintenance responsibility for the roadway, the Public Works Director and the Director of Community Development have reviewed the existing road, landscape and parkway situation. The City staff found several areas of deteriorated roadway and damage to sidewalks and curbs by tree roots. They also found that the existing tree wells are about four (4) feet square in an eight foot sidewalk. This has resulted in portions of the sidewalk that are only four feet wide and present a potential hazard to pedestrians. Since the approval of the landscape plans, the City Public Works Department has required the removal of several trees along this area due to sight distance and curb, gutter and sidewalk damage problems as a result of tree growth. It is estimated that approximately 20 trees have been removed from the median and parkway, a final count will be established when the Minor Modification becomes effective, but is expected to total about 50 trees. This has created a situation whereby the applicant is no longer in compliance with the approved Landscape Plans. The applicant proposes to replace the trees with shrubs in order to PP10:2I :9415s02pmA: \1690V94.CC 00077 provide greater visibility for motorists and to promote pedestrian safety and reduce the cost of long term maintenance (ie. no root problems). On October 12, 1994, the Department of Community Development received an application for Minor Modification No. 2 to PC3 requesting a modification of the parkway and median landscaping along Tierra Rejada Road to depict the proposed landscape replacement scheme. The attached revised landscaping plans shows the proposed landscape replacement scheme (see attached revised landscape plan). The plan will reduce the width of the tree wells to provide a minimum sidewalk width of five (5) feet. The planter area will then be planted with Hemerocallis (Daylily). The Director of Community Development reviewed the proposed Minor Modification request and conditionally approved it on November 2, 1994 with the following condition: The applicant shall replace fifty percent (50 %) of the trees removed and pay the City $300.00 per tree for the trees not being replaced. The replanting shall be in locations approved by the Public Works Director and shall consist of not smaller that 15 gallon trees. The trees shall be guaranteed for one year from the time of acceptance of maintenance by the city. The appeal period will end on Friday November 18, 1994. The condition of approval will require that half of the trees previously removed be replaced with 15 gallon trees. If no appeal has been filed, the Director's decision will stand. Pursuant to Resolution No. 523, the Director has the authority to approve Minor Modifications. This matter is being presented to the City Council pursuant to Council policy. Should the City Council or any interested party wish to appeal the Director's decision, the next available hearing date would be December 7, 1994. Recommendation: Receive and file the report. Action: Conditional Approval California Environmental Quality Act (CEQA) Compliance: This Department has reviewed the project to ascertain if there will be a significant effect on the environment. It has been determined that this project is categorically exempt from CEQA requirements as a Class 1 exemption for minor alterations. Ordinance Compliance: Based upon the information and findings developed by staff, it has been determined that this application, with the attached conditions, meets the requirements of Moorpark Ordinance Code Section 8111 -2.1.2 - Permit Standards, in that: a. The Minor Modification is consistent with the intent and provisions of the City's General Plan and the City's Zoning Ordinance; b. The Minor Modification is compatible with the character of surrounding development; C. The Modification is not detrimental to the public interest, health, safety, convenience, or welfare. Appeals: As stated in Section 8111 -8, within 16 calendar days after the permit has been approved, conditionally approved or denied, any aggrieved person may file an appeal of the approval, conditional approval or denial with the Community Development Department who shall set a hearing date before the City Council to review the matter at the earliest convenient date. The above approval is made subject to the following condition.
