HomeMy WebLinkAboutAGENDA REPORT 1994 1116 CC REG ITEM 08OITEM go D• ' MEMORANDUM TO: The Honorable City Council FROM: Jaime Aguilera, Director of Community Developme Paul Porter, Senior Planner DATE: November 2, 1994 (CC meeting on November 16, 1994) SUBJECT: MINOR MODIFICATION NO. 1 TO IPD 93 -1 (G &S PARTNERSHIP) On December 1, 1993, the City Council adopted Resolution No. 93 -988 approving Lot Line Adjustment No. 93 -8 to consolidate three existing parcels into two parcels by eliminating one of the lot lines and an Industrial Planned Development Permit to construct two industrial concrete tilt -up warehouse buildings as follows: Site area: BUILDING AREA: 19.3 acres Building One 253,780 s.f. Building two 152,500 s.f. Total 406,280 s.f. G and S Partnership applied for Minor Modification No. 1 to IPD 93- 1 on November 2, 1994 to delete graffiti coating. Condition No. 100 of Industrial Planned Development No. 93 -1 reads as follows: 108. The applicant shall paint the exterior of the buildings with anti - graffiti paint. The applicant indicates that although anti - graffiti coating can be applied over the existing paint colors, that over time (due to the elements), the coating wears off and is no longer effective. The applicant has requested that the requirement for the anti - graffiti paint be waived based upon the following remedial measures provided by Mail Marketing Corporation: 1. 75 % of the perimeter of the site is secured with a security fence (ie., chain link and /or slump stone). 2. Mail Marketing Corporation has their own loss prevention department and will be providing 24 -hour, 7 -day a week guard service. 3. The entire site is monitored by a CCTV System. PP11:03:94 112:25pM :\AJfiN 01.Cc 1 00087 Discussion The Director of Community Development has reviewed the applicant's request to delete the requirement for anti - graffiti paint and has approved the Minor Modification to delete condition of Approval No. 108 based on the applicant's remedial measures and also that the Condition of Approval No. 67 of IPD 93 -1 requires that: The applicant and his successors, heirs, and assigns shall remove any graffiti within five (5) days from written notification by the City of Moorpark. All such graffiti removal shall be accomplished to the satisfaction of the Director of Community Development. The Director of Community Development reviewed the proposed Minor Modification request and approved it on November 2, 1994 with the appeal period ending on Friday November 18, 1994. If no appeal is filed, the Director's decision will stand. Pursuant to Resolution No. 523, the Director has the authority to approve Minor Modifications. This matter is being presented to the City Council pursuant to Council policy. Should the City Council or any interested party wish to appeal the Director's decision, the next available hearing date would be December 7, 1994. Recommendation: Receive and file the report. Assessor's Parcel Nos.: 512 -24 -7, 15 and 17. For approval of: Deletion of Condition No. 108 of IPD 93 -1 which states as follows: 108. The applicant shall paint the exterior of the buildings with anti - graffiti paint. California Environmental Quality Act (CEQA) Compliance: This Department has reviewed the project to ascertain if there will be a significant effect on the environment. It has been determined that this project is categorically exempt from CEQA requirements as a Class 1 exemption for minor alterations. Ordinance Compliance: Based upon the information and findings developed by staff, it has been determined that this application, with the attached conditions, meets the requirements of Moorpark Ordinance Code Section 8111 -2.1.2 - Permit Standards, in that: a. The Minor Modification is consistent with the intent and provisions of the City's General Plan and the City's Zoning Ordinance; b. The Minor Modification is compatible with the character of surrounding development; C. The Modification is not detrimental to the public interest, health, safety, convenience, or welfare. Appeals: As stated in Section 8111 -8, within 16 calendar days after the permit has been approved, conditionally approved or denied, any aggrieved person may file an appeal of the approval, conditional approval or denial with the Community Development Department who shall set a hearing date before the City Council to review the matter at the earliest convenient date.
