'• _ TO : THE HONORABLE CITY COUNCIL // 7I FROM: DIRK LOVETT, ASSISTANT CITY ENGINEER . 71 'k� ?'(/' !�`1 DATE : JANUARY 6, 1993 SUBJECT : APPROVAL OF THE FINAL MAP FOR MISSION BELL PLAZA, TRACT 4757-1 (VENTURA PACIFIC CAPITAL) . BACKGROUND INFORMATION The subject tract is located on Los Angeles Ave. , west of Moorpark Ave. , in the City of Moorpark. A location map is attached for your reference (Exhibit A) . The tentative map (Exhibit B) was approved by the City Council on October 2 , 1991 . The final map (Exhibit C) represents a land division of 10 .77 acres for commercial purposes (The tentative map was an 11. 51 acre division of land) . Both maps are attached. A minor adjustment was made to the phased boundaries of the final map. This adjustment and the addition of two remainder parcels were necessitated when the adjoining developer (MacCleod) delayed beginning their portion of the commercial project. The modifications shown on the final map involve creating two remainder parcels and modifying portions of the westerly tract boundary. Each modification is explained below and is shown on the final map. Remainder Parcel A ( . 07 acres) is located where future parking and accessways, from the MacCleod phase, are proposed to span the existing property line. Creating Remainder Parcel A will allow transfer of the parcel for future construction on the MacCleod phase. Remainder Parcel A has also been modified for the construction of the K-Mart sign. It should be noted that Ventura Pacific Capital Group has already prepared an agreement to this effect . Remainder Parcel B ( . 08 acres) is located where the adjoining MacCleod structures will physically be connected to the proposed K- Mart structure. Since the MacCleod structure is not being immediately built there was a necessity to leave this remainder portion of property for future transfer to MacCleod. PAUL W. LAWRASON JR. Mayor Mayor Pro Tern Councllmemoer Councilmember Councilmember • Portions of the westerly tract boundary of Tract 4757-1 have been modified from the tentative map. These modifications were also necessitated by the adjoining developers decision to delay future construction. The tract boundary modifications occur on the west tract boundary and involve leaving the existing property line, between Ventura Pacific Capital and Macleod, in place. The original intent was to modify the line to include buildings crossing the property line. Access dedications for the interim construction of K-Mart were granted across City owned right of way (Gisler Rd. ) by the City Council at their July 1, 1992 meeting. These easements will allow access around the northwest corner of the K-Mart building and access to Los Angeles Avenue, on the southwest, until the Macleod project begins. With respect to Remainder Parcels, the rules governing access to a remainder parcel is similar to those used for any other type of lot . It is not anticipated that any access difficulties for the remainder parcels will arise. In discussions with the developer, staff has determined the modifications to the final map were not intended to evade any state or local subdivision ordinance. The remainder parcels can be conditioned upon future development of the Macleod tract, as prescribed by the Subdivision Map Act. If the Macleod Map does not record, sufficient access, as referenced above, has already been provided the K-Mart site. It is staff ' s opinion that the final map, as presented for approval, significantly conforms to the intent of the approved tentative map. All conditions of approval for the tentative tract map have been fully satisfied. Included in this submittal are the following items (on file in the office of the City clerk) : 1 . Motorist 3SM77744500 RECOMMENDED ACTION 1 . Authorize the Mayor and City Clerk to sign the Title Sheet and record Final Map 4757-1 . 2. Direct the applicant to prepare an agreement, to be signed by the City prior recordation of Map 4757-1, providing for; The merger of remainder parcel "B" to lot 1 of Tract 4757-1 within three (3 ) years of recordation of Final Map 4757-1 OR the transfer of remainder parcel "B" to the property owners of Tentative Tract 4757-2, should Final Map 4757-2 be approved by the City for recordation, whichever occurs first . Said agreement shall be recorded in conjunction with the final map for Tract 4757-1 .
