Associates Relating Thereto
BACKGROUND
In March of 1991, the City retained the services of Charles Abbott
Associates to perform the duties of City Engineer. Coincidental
with that action, the City Council amended the Agreement with
Willdan Associates, appointing that firm to perform the duties of
City Engineer with respect to certain identified projects (see the
attached Exhibit "A" of the Agreement).
One of the projects to be performed by Willdan Associates is the
Tierra Rejada Widening Project. In an effort to save time and
money, the project design already prepared by Valcon Engineering is
being used as the basis for developing a final design package.
This effort would be carried out through the combined efforts of
Willdan Associates and Valcon Engineering working as their
subcontractor.
DISCUSSION
A. Project Scope
The proposed project provides for the realignment and
reconstruction of Tierra Rejada Road from a point approximately
six hundred feet west of Spring Road, easterly to Moorpark Road.
The scope of work is generally described as follows:
1. Included -- The project will includes the following:
• construction of a four -lane divided highway;
• construction of pavement width sufficient to allow for
Bike Lanes on both sides of the street [Note: This work
is to be funded by an SB -821 State Grant];

• relocation of all utilities by the utility company /
district in concert with the City's contract;
• construction of an unimproved (no raised curbs) median
east of Spring Rd.
• construction of a raised median (with curbs) west of
Spring Road including utility stub -outs;
• construction of Spring Road improvements sufficient to
allow for adequate transitions; and,
• construction of curb & gutter ( & possibly sidewalk) on the
north side of the Tierra Rejada Rd. west of Spring Rd.
(Embassy frontage).
2. Possible Additions -- The City is looking into the
possibility of adding to the Scope of Work the construction
of curb, gutter & sidewalk on the south side of Tierra Rejada
Road west of Spring Road.
3. Not Included -- The Watt Company, after initially
considering participation in the project, has rejected
funding construction of curb, gutter & sidewalk along the
frontage of their property [south side of Tierra Rejada Road
the entire length of the project].
B. Insurance Coverage
Valcon Engineering possesses insurance coverage for general
public liability and property damage in the amount of
$1,000,000. Their insurance coverage for professional liability
is limited to $500,000. It is proposed that the coverage for
this latter category of risk, as it pertains to the Tierra
Rejada Widening Project, be increased to a $1,000,000 through
purchase of a rider to their policy. The cost of such a rider
is estimated to be $3,832. The design fee for the subject
project will be increased by said amount to cover the cost of
this additional insurance coverage.
C. Design Cost
1. Cost to Date: The total mount of design related costs
incurred by the City to date are as follows:

2. Additional Design Effort:
• Tierra Rejada Road -- Attached as Exhibit "B" is an
outline of the additional design effort required for that
portion of the work on Tierra Rejada Road. The total cost
for this additional work is $66,363.
• Spring Road -- Attached as Exhibit "C" is an outline of
the additional design work required for the required
improvements on Spring Road. The total cost for this
additional work is $12,122 (if soils test and survey is
not required the cost will be only $9,978).
3. Total Design Cost: A re -cap of the total project design
costs are as follows:

With the purchase of the above described insurance rider, the
amount of the insurance coverage retained by Valcon Engineering for

D. Amendment

RECOMMENDATION
Staff recommends that the City Council take the following actions:
1. Approve the attached Amendment to the Agreement for Engineering
Services (Willdan) revising the insurance requirements for the
subject project.
2. Approve an increase in the design fee in an amount Not To Exceed
$100,000 for the design services required to complete the design
for the subject project.
3. Authorize the City Manager to approve all actions and authorize
specific items of work related to the design of said project.

Subject: Tierra Rejada Road Widening
Dear Steve:
Enclosed is the work authorization to provide Public Works project administration services
for the Tierra Rejada Road Widening Project. We have also enclosed a breakdown of
Valcon's fee to final the plans.
Please be advised, in order to meet the April deadline for start of construction, we should
advertise for bids in mid to late January. Currently, there are several issues that need to
be undertaken with utility companies for construction of their facilities and coordination of
this project. In order to meet this deadline, it is imperative that we continue our work as
shown in the authorization. To date, we have expended approximately $4,600 of the
enclosed Extra Work Authorization for utility coordination and miscellaneous meetings just
to keep the project moving.
We will be submitting our design fees for preparation of plans for the Spring Road
transition widening under a separate cover within a couple of days.
Also enclosed is a letter from Valcon on obtaining $1 million in Professional Liability
insurance as opposed to the current limit of $500,000. The additional cost to provide this
insurance coverage is $1,032.

T ERRA REJADA ROAD WIDENING PROJECT
PUBLIC WORK PROJECT' ADMINISTRATION
The following is an amended authorization pursuant to Authorization No. 91 -04
"Note No. 3 ". This authorization supercedes all work in Authorization No. 91 -04.
TOTAL COST
A. Project restart including one (1) meeting with City staff and
Valcon Associates and one (1) meeting with Valcon to
coordinate previous work compieted, status with current
requirements of project, and determine which alternatives
the City desires to incorporate into the final design. $675.00
B. Meeting with City staff; Ramseyer & Associates, and Valcon
to incorporate Science Drive intersection improvements,
discuss off -site disposal areas, and intersection
improvements at Spring Road, Science Drive and Moorpark
Road. Pursuant to this meeting, Valcon will revise the plans
to locate the Spring Road signal to ultimate location,
provide ultimate grade on the north side and prepare
revised disposal site plan from Ramseyer working drawings. $736.00
C. Coordinate with the five (5) original utility companies that
have facilities within the project. These utilities are as
follows:
1. Southern California Edison
2. Shell Pipeline Company
3. Camrosa Water District
4. Southern California Gas Company
5. Pacific Bell
Coordinate with new utility companies not originally
anticipated to have facilities within the project:
1. Ventura County Waterworks District No. 1
Coordination will include:
a. Request status of final relocation design,
material procurement, and scheduling of work
crews. This work is limited to one letter and
one follow -up phone call for each utility
company.

service during construction of the road and the
new utility lines. This work is limited to one
meeting and one letter for each utility

C. Include Camrosa waterline as an alternate bid
item in the project. Incorporate their plans
and specifications into the overall bid package.
d. Receive and review final utility relocation
plans.
e. Provide utility companies with project plans
for review of possible underground conflict.
Request documentation of utility company
satisfactory review. This work is limited to
one letter and one follow -up phone call per
utility company.
f. Conduct an on -site meeting with Edison to
coordinate proposed street light facilities.
Prepare Notice to Proceed letter for Edison to
begin design of street light electrical.
g. Coordinate utility companies to provide stub -
outs at future Science Drive for Carlsberg
project.
h. One (1) meeting with all utility company
representatives to coordinate all time
schedules for their work based on a. through f. $5,520.00
D. Provide additive alternative bids for complete road closure
and one -way traffic as follows:
1. Access from intersection of Tierra Rejada and Spring
Roads to the freeway from 7:00 am to 9:00 am.
2. Access from the freeway to the intersection of Tierra
Rejada and Spring Road from 4:00 pm to 6:00 pm.
Note: This alternate will provide access only at the
time intervals as shown. The roadway within project
limits will be closed at all other times, including
nights and weekends. This alternate would only
provide a dirt road with flagmen and traffic control
set up.

Prepare performance specification with specific
requirements for traffic control, safety and temporary road $2,208.00
material for the contractor to prepare plans to facilitate this
temporary closure. This plan would be submitted and
approved by the City prior to the commencement of
construction.
E. Review all current easement documents and reversion to
acreage for all properties along the project frontage to
ensure adequate construction easements and /or right -of -way
provided for the project.
F. Review Negative Declaration to ensure project meets all
requirements for environmental clearance. $368.00
G. Constructability review of revised construction plans, cross
sections and phasing plan with updated revisions for Science
Drive intersection, deletion of curb and gutter on the south
side, full median improvements, revised disposal site, and
Spring Road northeast comer paveout to ultimate width and

H. Update current specification package bid schedule and
engineer's cost estimate (1989) since last estimate
incorporating all changes for D aLd G above. Check design

N. Prepare scope of work for construction survey, soils

At the request of the City, Willdan agrees to employ Valcon Engineering, Inc., as a
subconsultant on this project. Willdan has expressed its concerns that said subconsultant
performed design work on the project as a consultant to a private developer and not under
the supervision or control of Willdan and that the documents prepared by Valcon
Engineering, Inc., have been provided by the City to Willdan to be used by Willdan in
connection with its services under this work order. The result is that a clear separation of
potential liability as between Willdan and Valcon Engineering, Inc., cannot be made. In
recognition of these circumstances; the City h,--s agreed to a limitation of Willdan's liability
on this project. For the purposes of the project covered by this work order, and this work
order only, the Agreement for Engineering Services between the City of Moorpark and
Willdan Associates dated March 3, 1992, is amended by adding the following paragraph at
the end of Section III.E.:
"Notwithstanding any provisions herein :o the contrary, for the purpose of that
certain project known as the "Tierra Rejada Road Widening Project ", the
liability of Willdan is limited to the lesser of: damages suffered by City which
are proximately caused by the negligent acts, errors or omissions of Willdan's
subconsultant, Valcon Engineering, Inc_, or the amount of $500,000.00."
This amendment applies only to this project a 3 shall not be applicable to any other project
performed under the Agreement for Engineer "Ilg Services. Except as provided in this work
order, all other provisions of the Agreement for Engineering Services shall remain in full
force and effect.

Subject: Spring Road Improvements
Dear Steve:
Enclosed is the work authorization to provide design services for the improvements on
Spring Road in conjunction with the Tierra Rejada Road Widening Project.. We have
included a sketch of our preliminary street alignment for your review. In the preliminary
design concept we have proposed an extension of the curb line adjacent to the Embassy
Project to tie into existing improvements at Christian Barnett Drive. Sidewalks can be easily
added within right -of -way; however, the original concept with the Embassy project was for
a meandering sidewalk. Street lights are not currently included within this project.
Pavement transitions along the east side of Spring Road will join the revised curb return on
Tierra Rejada Road and transition to provide the lane configuration shown on the
preliminary design concept plan. There appears to be a discrepancy in the lane
configurations called for in the Carlesberg Traffic Study; however, we have assumed that
study will eventually conform to the lane configurations shown. Utility stubouts onto the
Embassy parcel will be the responsibility of future development.
The design for Spring Road will be completed by mid January and incorporated into the
Tierra Rejada Road Widening Project.
It should be noted that the costs as proposed includes outside consulting costs of $2,400 for
surveying and $2,445 for soils testing. Both of these costs can be reduced substantially if
sufficient information is available in the City files for the Embassy project and for Tract
2865 -4, north of the Embassy project.

The objective of this design task is to prepare construction plans of a section of Spring Road
for insertion into the Terra Rejada Road Widening Project The plan preparation will
incorporate information mined on the original mupproved and unsigned plans prepared
for the Embassy project. Field verification of the skis q topo and e*ting improvements,

Spring Road a vements will include pavement transitions along the east side of Spring
Road. The intersection of Spring at Marra Rejada will inchrde one right turn lane and one
left -turn lane, a painted median, one northbound lase and a trand&ning of the pavement
from the curb return to the 30-fact wide pavement between Tierra Rejada and Christian
Barret Drive. The out side of Spring Road will be graded to provide for an 8 -foot shoulder
and a drainage swale. Pavement width will transition from the 78 feet required at Tierra
Rejada to join the existing pavement south of Christian Barret Drive (two lanes of traffic).
Drainage along the east side of the project wM be maintained in a graded earthen ditch.

Amendment to Agreement for City Engineering Services
At its regularly scheduled meeting of December 16, 1992, the
Moorpark City Council approved an amendment to the Agreement for
City Engineering Services with Willdan Associates, dated March 6,
1991.
All provisions and requirements of said Agreement shall remain in
full force and effect except as follows:
Section III G of the Agreement is amended to read:
" G. Consistent with the provisions of this Article, the
ENGINEER shall provide general public liability, property
damage and professional liability insurance in an amount
not less than Two Million Dollars ($2,000,000) per
occurrence and annual aggregate. The limits of insurance
coverage for general public liability, property damage and
professional liability for work related to the design and
other services for the Tierra Rejada Widening Project
shall be limited to One Million Dollars ($1,000,000).
