CONSIDER A REPORT ON APPROVAL AUTHORITY FOR A MAJOR
MODIFICATION TO DEVELOPMENT PLAN PERMIT NO. DP -318
At the City Council meeting of December 16, 1992 Mr. Newton presented the Council
with a proposal from the Kavlico Corporation to expand their existing facility. Mr.
Newton is proposing that the Council consider allowing the Planning Commission to
be the final approving body for the Kavlico expansion project.
The Council expressed their concerns that the Planning Commission members may
change and apparently the Council felt uncomfortable having such a large project
reviewed by what could be an inexperienced planning commission. The Council then
directed staff to return this item to the Council's next regular meeting for further
discussion.
Discussion:
Staff has further researched the issue and has found the following:
o Staff will process the Kavlico application as a major modification to
Development Plan Permit No. 318;
o Resolution No. 88 -523 states that a major modification be approved or denied
by the approving authority of the parent development permit (in this case the
City Council).
CI Resolution No. 88 -523 further states that the Planning Commissions' role in
such a case is as a recommending body.

o This resolution is not based on State law or a City ordinance and therefore may
be modified as the Council directs.
o Section 15074(a) of the California Environmental Quality Act states that if there
is an advisory body they shall consider the proposed negative declaration prior
to making their recommendation. However, Section 15074(b) states that it is
the decision- making body which has approval authority of the negative
declaration.
Given the above facts it's been the City's practice to have major modifications
considerd by the final approving body (Ventura Pacific Capital Group - CPD- 89 -2). In
this case staff would consider the City Council to be the final approving body and in
the interest of time and keeping with past practices would not ask the Planning
Commission for a review and recommendation.
Recommendation:
Receive and file this report.

Dear Mayor Lawrason
and Members of The Council: •
The attached letter from Mr . Fred Kavli succinctly states the case
and purpose behind the current City effort to expedite the Company '
industrial expansion application , recognizing that occupancy is
required by September , 1993 , if we are to retain this important hj. h
technology firm in Moorpark .
Time is critical , as stated , and as has been coined in a ,%ariety
of disciplines , "timing is everything . " Moorpark is extremely fcrtun::u
to be able to share Kavlico ' s good fortune , the award of new contracts
in its domestic manufacturing operation (automobile emission control
sensors ) , by receiving 250-300 new job opportunities . In light of the
loss of the 600 employee Litton Aero Products company, relocating to
Woodland Hills . the expansion of Kavlicc is timely indeed .
To further expedite the process we request that the City Council ,
by policy direction , authorize the Planning Commission to be the final
approval authority for the Kavlico expansion [I] DP-318 , MOD-1 , by
providing for a "ONE-TIME , SINGLE CASE EXCEPTION TO RESOLUTION NO . 88-523
(attached) , SECTION 6 . g . " Justification for this action is as follows :
1 . The application to add an additional 94 , 000 S . F . business-
park building to the Kavlico complex has been deemed to be
a Modification of existing [I] DP-318 .
2. Road widening and grading is essentially complete rendering
site improvements to be primarily the extension of utilities ,
and expanded parking and landscaping as- appropriate to accomodate
the additional building .

3 . Preliminary design proposes to ensure architectural
compatibility with the existing Kavlico facility , and
the adjacent industrial/business-park area .
4 . The site is located in a previously approved industrial/
business-park area , and is specifically zoned M-1 ,
Industrial Park .
5 . There are no known environmental impacts related to the
expansion that have not already been mitigated , or cannot
now be mitigated , and the preliminary staff indication
related to pre-submittal inquiries is that the Initial
Study is anticipated to result in a CEQA determination of
"ND" , Negative Declaration .
6 . Consultation with staff has resulted in their support of
this request , subject to City Council approval .
7 . The Planning Commission has demonstrated its ability to
handle projects of this magnitude in the past , and
expedited projects recently , most notably , McDonald ' s .
8 . A minimum of one ( 1) month could be saved in the application
process by not requiring the project to reach final
conclusion at the City Council level assuming , even if
expedited , a Council hearing following the last P . C . hearing
by at least two (2) weeks , and two (2) weeks to final
adoption of the Resolution by the Council .
9 . And finally , the Council gives up nothing on the basis that
it can appeal any Planning Commission decision which does
not meet with City Council ultimate concurrence .
10 . The Moorpark Economic Development Committee is considering
and studying potential future recommendations to the City
Council regarding changing approval authorities to the lowest
possible level as a means of streamlining the process for
all projects , consistent with recently adopted General Plan
policy . This is an excellent opportunity to test the advisability
and feasibility of authorizing P . C . and Staff final decisions
in , for example , pre-approved ( zoned) , partially built- out
commercial and industrial areas .
Again , timing is extremely critical in this important case . An
additional month of processing time savings could be the very key to the
success of the proposed occupancy/operations schedule so critical to the

retention of this business , assuming ultimate approval of the project . To
that end , Kavlico has committed to an above average , quality , application
submittal proposing a project which will meet or exceed minimum City
standards .
Your consideration of this matter as an urgency item will be very
much appreciated by Kavlico and the professional project team assembled
by Mr . Kavli to complete the Company ' s critical objective of occupancy/
in-operation by September , 1993 .

Dear Mayor Lawrason:
I have an immediate requirement for building an expansion facility on my property immediately
to the south of Kavlico's present location.
The award of new contracts to Kavlico has created an urgent need for additional manufacturing
space. Along with these additional facilities will come an estimated 250- 300 new job
opportunities for members of our community.
I am requesting the support of the City Council, the Planning Commission,City Staff, and
yourself in expediting our project which has an extremely aggressive schedule. This project is
important in retaining jobs for the community and for the county.
I am pleased with the present support demonstrated by staff and their willingness to work with
us in meeting this schedule. With everyone's continued efforts,we will be successful in
completing this project during the third quarter of 1993 and expanding Kavlico's employment
opportunities in Moorpark.

RESOLUTION NO. 88-523
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DIRECTING THAT CERTAIN PERMIT APPROVAL PROCESSES BE
PREFORMED BY CERTAIN CITY OFFICIALS; AND THE REPEALING OF
RESOLUTION NO. 86-276.
Whereas Resolution No. 86-276 prescribes the city offices that
approves various permits; and
Whereas, the City Council as well as the staff have recommended
changes to said approval authority;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA, DOES RESOLVE AS FOLLOWS:
Section 1. Resolution No. 86-276, entitled:
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MOORPARK,
CALIFORNIA PRESCRIBE THAT CERTAIN PERMIT APPROVAL PROCESS BE
PREFORMED BY CERTAIN CITY OFFICIALS AND THE REPEALING OF ALL
RESOLUTIONS IN CONFLICT THEREWITH.
adopted February 18, 1986 is hereby rescinded.
Section 2. Where the Planning Commission is authorized to
C approve or disapprove an entitlement herein, such decision is appealable to
the City Council. Where the Director of Community Development is
authorized to approve or disapprove an entitlement and subsequently to the
City Council.
Section 3. A request for a Modification to an entitlement
herein shall be deemed a "Minor Modification" , as determined by the
Director of Community Development, when such a modification does not alter
the intent of the determining body. All other modifications are deemed
"Major Modifications".
Section 4. Major Modifications shall be approved or
disapproved by the official of body granting the original approval or an
appeal thereof, and shall be processed in the same manner as the original
approval.
Section 5. Where the City Council is the body with approving
or disapproving authority, the action shall first be processed through the
Planning Commission for its recommendation.
Section 6. Approval or disapproval shall be performed by the
following City offices of Officials:
a. General Plan Adoption - City Council
\ b. General Plan Amendment - City Council

c. Ordinance Adoption/Amendment - City Council
d. Zone Change - City Council
e. Residential Planned Development Permits - Planning
Commission for proposals of four units or less;
City Council for proposals of for more than four
units.
f. Commercial Planned Development Permits - Planning
Commission for proposals of less than 20,000 square
feet of gross floor area; City Council for
proposals of 20,000 square feet or more of gross
floor area.
g. Industrial Planned Development Permits - Planning
Commission for proposals containing less than
20,000 square feet of gross floor area for all
buildings involved; City Council for proposals of
20,000 square feet or more of gross floor area for
all buildings involved.
All new construction, regardless of gross floor
area size that is within three hundred feet (300' )
of a residential zone or use shall require City
Council approval.
h. Administrative Clearance - Director of Community
Development.
i. Director Conditional Use Permit - Planning
Commission.
j . Planning Commission Condition Use Permit - Planning
Commission.
k. Tentative and Final Tract Map - City Council.
