Gilbert, Director of Public Works DATE: December 29, 1992 (Council Meeting 1 -6 -93) Ct ACTION: SUBJECT: Consider Bids for the Construction of the Community Building and Gymnasium at Arroyo Vista Community Park. OVERVIEW This presents the bid results for the subject project and recommends award of a contract for proposed construction. DISCUSSION A. Background On November 30, 1992, the City received and opened bids for the subject project. On December 2, 1992, the City Council reject all bids and directed staff to re- advertise the project with certain changes. B. Revised Scope of Work As recommended by the Public Works, Facilities and Solid Waste Committee (Mayor Pro tem Montgomery and Councilmember Wozniak), it is anticipated that the City Council will direct staff to make certain changes to the project scope prior to re- advertising. Those changes are summarized as follows: 1. Add Deduct Alternates -- All of the Add / Deduct Alternates previously included in the bid documents were eliminated. 2. Deleted Items -- Most of the Add /Deduct Alternates remain as a part of the Scope of Work. The items deleted from the Scope of Work are as follows: Ref. Cost Estimate -- It is estimated that the value of the items which have been deleted from the Scope of Work ( approximately $70,000) will be off -set by the estimated value of the items added. In addition, based on the bids previously submitted, the architect has revised his construction cost estimate to $1,750,000. C. Fire Sprinklers It was recently brought City's architect that requires the buildings t #24 was added to the Bid construction of a fire Contractor. D. Bid Results to the attention of the City and the the Ventura County Fire Department o have Fire Sprinklers. Add Alternate Documents providing for the design and suppression sprinkler system by the Attached as Exhibit 1 is a listing of the bid results. Wesley Thomas Enterprises, Inc. submitted the lowest bid. This firm also submitted a bid for the November 23 bid opening. They then requested that they be allowed to withdraw their bid due to a clerical error. Section 5105 of the Public Contracts Code states that "A bidder who claims a mistake ... shall be prohibited from participating in further bidding on the project which the mistake was claimed ...." In the opinion of staff, this statue requires the City to disqualify Wesley Thomas Enterprises, Inc. Jevon Construction Company submitted the next lowest bid. The bidding documents require all bonds to be executed by an admitted surety insurer. The bid bond submitted by this firm did not comply with this requirement. In the opinion of staff, the bid submitted by Jevon Construction Company should be declared unresponsive. Presuming the City Council agrees with the above findings, the apparent low bidder is Allee Construction Company, Inc. with a bid amount of $1,921,000.00 `rp \rpt \avph -&d2 Consider Bids Arroyo Vista Park January 6, 1993 Page 4 E. Qualifications The bid documents included information to assist the City in evaluating the bidders' qualification to undertake and complete the project in a satisfactory manner. Staff has reviewed the information included in the proposal, made inquiries into the reference provided and has determined that AIIee Construction Company, Inc. is qualified to construct the project. F. Committee Review On Monday, December 28, 1992, the Public Works, Facilities and Solid Waste Committee met to review the bids. It was the opinion of the Committee that the amount bid by the apparent low bidder, Allee Construction Company, Inc., exceeds the funds available for the project. The Committee further recommends that the bids be rejected and the project be abandoned.
