Aguilera, Director of Community Developmeit Kathleen Mallory Phipps, Associate PlannerfenO DATE: January 28, 1993 (CC meeting of February 3, 1993) SUBJECT: MCDONALD'S CORPORATION, CPD 92-2, LDM 92-1, ZC 92-4 MINOR MODIFICATION NUMBER ONE (1) BACKGROUND: On November 4 , 1992 , the City Council approved Zone Change 92-4 for the construction of a McDonald' s restaurant on the northeast corner of Spring Road and Los Angeles Avenue. The Planning Commission was the approval body for the Commercial Planned Development (CPD) and Land Division Map (LDM) ; approval for the CPD and LDM was conditional upon Council approval of Zone Change 92-4 . The purpose of this staff report is to inform the Council of the Director' s decision to allow a modification to CPD condition number 95a pertaining to the amount of landscaping to be provided as a landscaping buffer adjacent to the curb on New Los Angeles Avenue. DISCUSSION: Conditions 95a - language: A portion of Commercial Planned Development 92-2 , Condition of Approval number 95a requires that McDonald' s Corporation construct "a no less than five (5) foot landscaped area adjacent to the curb" , see attachment number 1. Land Dedication: Los Angeles Avenue: After dedication of land to Caltrans to obtain an ultimate street width of 118 feet on New Los Angeles Avenue, eight feet of land will remain on New Los Angeles Avenue for the placement of the required sidewalk and landscaping buffer adjacent to the curb (see condition number 95a, attached) . KMP-01-06-93(10:39am)A:\MCDMIMOD.I The Honorable City Council January 25, 1993 Page 2 To require McDonald's to install a five foot landscaped buffer adjacent to the curb on New Los Angeles Avenue would result in re- negotiation of the amount of land to be purchased because an additional two feet of land would be required to be purchased. This would result in a modification to the proposed property lines which could, potentially, lead to total project re-design. The City may achieve the desired landscaping buffer by requiring the installation of three feet of landscaping adjacent to the curb on New Los Angeles Avenue instead of the five feet required by condition number 95a. The installation of three feet of landscaping adjacent to the curb on New Los Angeles Avenue would be consistent with the landscaping adjacent to the curb in front of the Moorpark Pines apartment site, east of the McDonald' s project site and would accomplish the City' s goals of a landscaping buffer without burdening McDonald's Corporation with a lot line adjustment process. Spring Road: Consistent with the existing landscaping north of the McDonald ' s site, McDonald's Corporation will install a five foot landscaped buffer adjacent to the curb on Spring Road. The existing sidewalk on Spring Road will be removed and a new five foot wide sidewalk will be installed on the McDonald' s property utilizing an easement for said purpose. McDonald' s Corporation is not contesting the amount of landscaping required adjacent to the curb on Spring Road. Director' s Decision: Staff has reviewed the proposed modification and conditions of approval and has determined that granting of this modification will be consistent with the existing landscaping buffer east of the subject site on New Los Angeles Avenue. The Director of Community Development has reviewed the proposed Minor Modification request and intends to approve the Minor Modification. The Director intends to approve the request on Tuesday, January 19, 1993 with the appeal period ending on Thursday, February 4 , 1993 . If no appeal is made, the Director ' s decision will stand. Pursuant to Resolution No. 88-523 , the Director has the authority to approve a Minor Modification. This matter is being presented to the City Council as a courtesy. Should the Council or any interested party wish to appeal the Director ' s decision the next available public hearing date would be February 17, 1993 . The developer shall offer for dedication to the City of Moorpark the access rights adjacent to New Los Angeles Avenue and Spring Road except for the approved access driveways as delineated on the approved Tentative Map. 94 . The applicant shall submit to the City of Moorpark for review and approval, street improvement plans prepared by a Registered Civil Engineer; shall enter into an agreement with the City of Moorpark to complete the improvements; and shall post sufficient surety guaranteeing the construction of the improvements. Any right-of-way acquisition necessary to complete the required improvements will be acquired by the subdivider at his expense. The Agreement shall be prepared by the City and shall be signed by all parties of interest. 41, New Los Angeles Avenue adjacent to LDM 92-1 shall be widened north of the centerline generally in accordance with Ventura Co. Standard Plate B2-A, and as shown on the approved Site Plan submitted for final approval by the City. The improvement shall include concrete curb and gutter, sidewalk, street lights, striping and signing, paving, medians, traffic signal modification including but not limited to traffic signal pole relocation, controller re-phasing, traffic control, and any necessary transitions to the satisfaction of the City Engineer. All driveway locations shall be approved by the City Engineer and the Director of Community Development. The subdivider shall dedicate any necessary right-of-way to make all of the require improvements which shall be consistent with the approval Landscape Plan. The sidewalks along New Los Angeles Avenue shall be no less than 5 feet wide and separated from the back of the curb by no less than 5 feet of landscaping. The exact location of the sidewalk and the landscaping of the area between the sidewalk and back of the curb shall be per the final approved Landscape Plan. A public access and maintenance easement shall be given to the City for all sidewalk that extends onto the developer ' s property. 95b. Sidewalks shall be installed on Spring Road along the frontage of LDM 92-1. This sidewalk shall be no less than 5 feet wide and separated from the back of the curb by no less than 5 feet of landscaping.
