SUBJECT: REQUEST FOR BIDS - FIREPLACE INSPECTIONS
BACKGROUND:
The closing date for bids to be submitted to conduct fireplace
inspections for the City was Friday, January 15, 1993. The City
received four responses to the City's request for bids to conduct
fireplace inspections; one bidder submitted a letter stating that
he decided not to bid but would like to stay on our bidding list.
DISCUSSION•
All bids were opened on January 20, 1992 at 4:15 p.m. by Jaime R.
Aguilera, Director of Community Development; witness to the bid
opening was Kathleen Mallory Phipps, Associate Planner.
Contract award is based upon the following proposal requirements:
1. Submission of resume(s)
2. Job references
3. Verification of no unfavorable comments
4. Experience
5. Cost
6. Insurance
7. Contractors license (1) (see attached RFB and addendum)
1 As outlined with the Addendum, the RFB was amended to
allow not only persons with a valid Sate Contractor's
license, but also persons with a degree in civil
engineering, architecture or certification from the
Institute of Certified Building Officials (ICBO) to
qualify as a prospective bidder.

Based upon the aforementioned proposal requirements, only one
company, RSM and Associates, met the selection criteria. However,
one company, Safety Specs, did meet part of the selection criteria
but was unable to meet the City's insurance requirements.
The RSM Companies proposal stipulates on page four (4) that it will
conduct the fireplace inspections at a cost of $120.00 per home for
the initial 250 homes and $110.00 for each additional home there
after. Of the unqualified bidders, Safety Specs indicated their
inspection fee would be $38.50 per fireplace. D -Way indicated that
the inspection fee would be $55.00 per fireplace. However, they are
a non - responsive bidder because they failed to submit the
following:
1) A resume was not submitted.
2) No insurance documentation was submitted.
3) No verification of experience was submitted.
4) No job references were submitted.
Bidders met the proposal requirements outlined within the RFB as
shown on attachment
number 1.

REQUEST FOR BIDS TO CONDUCT
FIREPLACE INSPECTIONS
FOR THE CITY OF MOORPARK

The City of Moorpark is inviting bids /proposals for qualified contractors or contracting
companys to conduct fireplace inspections for the City of Moorpark.
SCOPE OF WORK:
The City of Moorpark Department of Community Development, Building and Safety
Division is seeking a qualified firm to inspect existing fireplace units in more than two
hundred fifty (250) homes (in some cases there may be more than one fireplace per unit)
to identify possible building code violations including installations contrary to
manufacturer's specifications. The inspections and any code violations will be
documented on forms provided by the City.
The units to be inspected have been installed and access to all fireplace components
may not be possible. In the event that elements of a fireplace are inaccessible for an
inspection to be performed, the contractor /contracting company shall identify the
components of the fireplace which were unable to be inspected.
The selected contractor must exhibit a proficiency in Uniform Building Code interpretation
especially as it pertains to fireplace construction, installation, inspection or inspection only.
All inspection findings shall be submitted to the City in type written form or legible
printing. The City will spot check the inspection process at its own expense. The City will
be responsible for scheduling of fireplace inspections and property access. The City will
make an effort to schedule fireplace inspections so that the contractor /contracting
company conducts as many fireplace inspections as possible within an 8 hour period.
Scheduling may also include work on Saturdays and Sundays. The work is expected to
be completed in 45 calendar days or less.

CONSULTANT REQUIREMENTS:
The contractor /contracting company selected must meet the following criteria:
1. A minimum of three (3) years of licensed experience in fireplace installation,
construction, inspection, or inspection only.
2. An appropriate and valid State Contractor's license.
3. Verification that no uncomplimentary statements have been made to the
appropriate Better Business Bureau, State Contractor's Board, or a Chamber of
Commerce by aggrieved customers or employers; or written documentation that
any such uncomplimentary statements have been remedied to the satisfaction of
the agency initiating or receiving the complaint.
4. A minimum of three (3) job references. Reference from current and /or previous
employers or customers, including name, title, work address, and telephone
numbers of the persons whom the contractor /contracting company has worked
(works) closely with on each job reference.
The selected contractor /contracting company will provide his /her own office space,
telephone, clerical support, supplies, and his /her own vehicle for any required field work.
PROPOSAL REQUIREMENTS:
All interested contractors /contracting companies must submit five (5) sealed copies of
their bid for procurement of the City Fireplace Inspection Service to:

A bid being submitted shall include all of the following:
1. Resumes of person(s) who will perform the inspection and any other persons who
may conduct minor review as needed to complete a fireplace inspection.

2. A description of the proposed process the contractor /contracting company will use
in order to conduct fireplace inspections; said process should be consistent with
the scope of work outlined on the previous page.
3. The cost to the City for conducting inspections. Said cost shall be given assuming
the entire contract will involve 250 homes. Further, said information shall include
a per inspection cost for each home over the original estimate for 250 homes.
4. An acknowledgement that billing will be paid on the City's schedule. Bills must be
received by the City no less than 15 calendar days prior to the first (1 st) and third
(3rd) Wednesdays of each month. Further, that the City will pay 90% of all billing
invoices. The final 10% will be paid 30 days after project completion.
5. Insurance:
Contractor /contracting companies shall secure from a good and responsible
company or companies doing insurance business in the State of California, pay
for, and maintain in full force and effect for the duration of the contract the policies
of insurance required by this Section and shall furnish to the City Clerk of the City
certificates of said insurance on or before the commencement of the terms of the
contract. Notwithstanding any inconsistent statements in any of said policies or any
subsequent endorsement attached thereto, the protection offered by the policies
shall:
(a) Bear an endorsement or shall have attached a rider whereby it is provided
that, in the event of expiration, cancellation, or amendment of the policy for
any reason whatsoever, the City Clerk shall be notified by registered mail,
postage prepaid, return receipt required, not less than (30) days hefore the
expiration, cancellation, or amendment is effective.
(b) Provide general public liability, including automobile liability and property
damage insurance in an amount not less than Two Million dollars
(2,000,000.00) per occurrence and annual aggregate.
(c) Provide professional liability insurance in an amount not less than One
Million Dollars ($1,000,000.00) per occurrence and annual aggregate. In the
event the amount of professional liability insurance provided to another
public agency client of the contractor /contracting company is more than
One Million Dollars ($1,000,000.00), this same coverage shall be extended
to the City so long as it can be provided at no additional cost to the
contractor /contracting company. The contractor /contracting company shall
give the City thirty (30) days written notice of intent to provide professional

liability insurance in excess of One Million Dollars ($1,000,000.00) to another
public agency client and offer the same coverage to the City at the City's
expense.
(d) The contractor /contracting company shall provide workers' compensation
insurance as required by the California Labor Code. If any class of
employees engaged by the contractor /contracting company in work under
this Agreement is not protected by workers' compensation law, the
contractor /contracting company shall provide adequate insurance for the
protection of such employees to the satisfaction of the City.
(e) The contractor /contracting company shall provide comprehensive liability
insurance in which the City is the named insured or is named as an
additional insured.
6. Indemnification:
The contractor /contracting company hereby agrees to indemnify, defend with
counsel (selected or approved by the City) and hold harmless the City and its
officers, employees, servants, and agents from and against any and all claims,
liability, loss, damage, cost, and expense whether or not litigation be commenced,
of whatever nature or type by reason of:
(a) Any injury or death to any person or damage to any property sustained or
alleged to have been sustained as a result of the work, or the performance
hereof, contemplated hereby by the contractor /contracting company, or any
defect in material, equipment, or workmanship that becomes evident within
one year after the date of project completion.
(b) Any other act or omission of the contractor /contracting company who is at
any time engaged in the course of work or in the repair, replacement or
restoration of any portion of the work made necessary by any defect in
material or workmanship including, but not limited to, subcontractors,
laborers, materialism, and suppliers.
(c) Any breach or default of the contractor /contracting company in the
performance of its obligations herein described within this RFB.
Discretion shall be given to the City as to acceptance of a bid submittal which has not
submitted all of the required information, as outlined in the aforementioned Section titled,
"Proposal Requirements." Unauthorized conditions, limitations, incompleteness, or
provisions attached to a proposal will render it irregular and may cause its rejection.

DELIVERY OF BIDS:
Bids shall be enclosed in a sealed envelope plainly marked on the outside, "FIREPLACE
INSPECTION BID - DO NOT OPEN WITH REGULAR MAIL. Proposals may be mailed or
delivered by messenger. However, it is the bidder's responsibility to ensure delivery of
the bid to the City by no later than 5:00 p.m. on January 15, 1992. Late bids will not be
considered.
SELECTION PROCESS:
The City will select a contractor /contracting company pursuant to the following process:
1. All bids and bidders' qualifications will be carefully reviewed.
2. Interviews may be conducted with those contractors /contraction companies judged
to have the best qualifications and experience by the City for the project.
3. The City Council will award a contract to the contractor /contracting company.
AWARD OF CONTRACT.
The award of the contract, if made, will be to the lowest overall responsible bidder as
determined solely by the City. Additionally, the City reserves the right to reject any or all
bids, to waive and irregularity, and to take the bids under advisement for a period of sixty
(60) days, all as may be required to provide for the best interests of the City. In no event
will an award of a contract be made until all necessary investigations are made as to the
responsibility and qualifications of the bidder to whom the award is contemplated.
The contract will specify among other issues, that the contract may be unilaterally
terminated within 24 hours after the City has given notice.
SELECTION DATE:
The City Council intends to consider award of a contract in February of 1993.

Please be advised that the Request for Bids (RFB) dated December 7,
1992 is hereby amended.
The section of the RFB entitled CONSULTANT REQUIREMENTS. page two
item number two of the RFB, is amended as follows:

GENTLEMEN:
Submitted herewith is our estimated cost of the Fireplace Inspection
services as they are required Department of Community Development, Building and
Safety Division, in the City of Moorpark. We are basing this proposal on the normal
amount of inspection associated with projects of this nature. A brief synopsis is given
below:
1. Fireplace Inspection: Our office will provide inspections of existing fireplace
units in more than two hundred fifty (250) homes. (we understand that there may
be more than one fireplace per unit) Our inspections will identify possible building
code violations including installations contrary to manufacturer's specifications. The
inspections and any code violations will be documented on forms provided by the City.
We will provide a written report that will detail the violations noted on each fireplace
unit. A copy of our inspection report is enclosed for your review.
FIREPLACE INSPECTION

GRAND TOTAL: $14,450.00
Based on the number of fireplace units presented above our total cost will be
$14,450.00. It should be noted that you will be billed only for the actual fireplace
units inspected. We will identify any or all areas not accessible for inspection. These
will be noted on our written report. Copies of each report will be supplied to the City
for your distribution. We understand that the City will be responsible for scheduling
of fireplace inspections. We also understand that the work is expected to be completed
in 45 calendar days or less. Contractor will not be liable for cancellations due to
homeowner, weather delays, or unforseen complications not within our control.
The work will be done in a professional manner.
Quality materials will be used to reseal external areas. All firestops and draftstops
will be replaced after inspection.
Also, the above rates are applicable to June 1, 1993. The rates after that time will
be increased by 10% annually for all work not reasonably completed.

The project proposal consists of inspecting existing fireplace units in more
than 250 homes for the purpose of verifying their compliance with
applicable codes and standards adopted by the City of Moorpark.
It is the intent of this proposal to inspect all of the fireplaces in the 250 or
more homes identified by the City of Moorpark for the purpose of
verifying compliance with the following codes and standards:
• Uniform Building Code, Applicable Edition
• Uniform Mechanical Code, Applicable Edition
• Product Manufacture's Specification and Installation
Guide - Standards
• State Building Code (Title 24, Part 2), Applicable Edition,
regulatinp, enerev conservation
• City of Moorpark's local amendments, if any, to the
above mandated codes
The initial and primary inspection of all fireplaces under this proposal will
be done by a 2 member team consisting of experienced inspectors (Richard
Paddock and Loren Florine). The RSM & Associates' inspection team will
rely on City staff to arrange for and provide timely entry permission and
access to view the affected fireplaces.
In the event an inspection reveals a code violation or deviation from
manufacturers specification /standard, the City will be notified
immediately in order that corrective measures can be pursued by others
with as little inconvenience as possible to the homeowner /occupants. (Any
and all corrective work required are not a part of this bid proposal). The
RSM & Associates team members will provide their own vehicles, ladder,
flashlight and tools /equipment necessary to make the inspection without
removing any building, architectural, or fireplace component. Fireplaces
that are inaccessible due to building, architectural or fireplace components
being in the way, will be noted accordingly.
In order to assure a thorough and timely inspection and report transmittal,
the firm of RSM & Associates will have its principal plan /code
professional(s) assist in verifying compliance with applicable codes and
standards.
The following items from the City will be necessary to expedite the
inspection and report writing process:
1. Information (permit records) of all City authorized construction
related to the affected homes and /or fireplaces.
2. Information on the product manufacturer and installation
standards /specifications related to each fireplace.
3. List of timely scheduling and permission to conduct the
necessary inspection of all affected fireplaces.
4. A developed program of making all fireplaces accessible for
inspection, repair, and secure against inclement weather.
5. Appropriate City forms to record all inspection findings and
develop corresponding reports.
Once the Notice to Proceed is issued, the designated members of the
inspection team will review City records for information related to the
specific homes and fireplaces scheduled for the day's inspection. It is
anticipated that the team will be able to visit 2 homes (and conduct the
necessary inspection) per hour. Based on a 6 hour /day inspection
schedule, the 2 men team would be able to inspect 12 homes /day. The
rest of a typical 8 hour day or 2 hours (8 hours -6 hours of inspection) is
anticipated to be utilized for research of City records, code requirements,
manufacturer's specification and installation standards, in addition to
compiling reports.
Working
at the above rate,
it is anticipated that the 250 homes would
be
inspected
within 22 days.
Allowing an additional 8 days for revisits
to
initially
inaccessible home
sites and /or fireplace components, review
of

actual construction versus code requirements /installation standards -
specifications, and report writing, it is estimated that the entire project will
take 30 working days or a maximum of 40 calendar days to complete. The
preceding work schedule allows for an additional 66 homes or a total of
316 homes to be inspected within the allotted 45 maximum calendar days
cited in the scope of work.
Fee to provide the complete inspection service, as outlined under the scope
of work, is as follows:
Number of hours necessary to inspect 250 homes;
250/2 = 125 hours
Initial inspection cost of 250 homes; 125 hours x $120 /hr. _ $15,000.00
Vehicle use expense cost; = 400.00
Office supply, support cost; = 1,200.00
Project overhead- administrative cost; = 4,400.00
Additional insurance coverage cost; = 8,000.00
Total Cost to Inspect 250 Homes = 250 homes x $120/home = $30,000.00
Cost to inspect each additional home over and above 250 . . . _$ 110.00
Proof of insurance, naming the City as insured, will be forwarded to the
City Clerk upon execution of the contract.
RSM will bill the City at the rate of $120.00 for each of the initial 250
homes inspected and $110.00 for each additional home thereafter. The
City will be invoiced at the following schedule: a.) partial payment - after
the 1st 125 -130 homes have been initially inspected, and b.) partial
payment - after the remaining 250 (or less) homes have been initially
inspected, and c.) final payment - after all homes have been inspected and
the project has been completed. The City may withhold 10% of all
payment due for a period of 30 days after project completion.

Richard S. Miyahira & Associates, Inc., is a code and development consultant firm established in
November, 1983, to provide services in the area of code administration and enforcement to clients in the
public and private sector. The firm currently consists of three professionals plus a number of technical and
office support staff. The principal, Richard Miyahira has been active in the professional field of code
administration and plan review since 1970, as the Assistant Director and Administrator of Building and
Safety for a rapidly growing city in California.
In late 1983, the principal, Richard Miyahira formed a consultant firm that has provided extensive plan
review and code administration services for cities and counties in Southern California. The firm has also
provided (or is providing) plan review services for the Counties of San Luis Obispo and Santa Barbara,
Cities of Ojai, Simi Valley, Santa Ana, Pismo Beach, Arroyo Grande, Grover City, and Ventura. The
total construction valuation of projects plan checked by Richard S. Miyahira and Associates, Inc., since
1983 is in excess of $950,000,000.
The firm of Richard S. Miyahira & Associates, Inc., has plan checked large oil refinery projects,
($46,000,000 or more in valuation; San Luis Obispo County), major high -rise buildings ($20,000,000 or
more in valuation; El Segundo), and a major hotel addition/alteration project ($35,000,000 valuation; City
of Ojai). Richard S. Miyahira & Associates, Inc. also developed a Seismic Safety Ordinance/Program for
the City of Culver City. The firm has acted as consultant to the Cities of Culver City, Redondo Beach,
Pismo and Simi Valley in the area of Building and Safety Administrative and Enforcement Services.
The associates of the firm are also highly respected and recognized as leaders in the filed of engineering
and building codes. The principal and associates maintain an active role in the following organizations:
• International Conference of Building Officials • California Building Officials
• National Academy of Code Administrators • American Institute of Architects
• National Society of Professional Engineers • American Society of Civil Engineers
• Structural Engineers Association of Southern California

Building Permit Plan Review Services
Professional services for the review of construction plans and documents for the purpose of verifying their
compliance with the development codes and standards adopted by the local governmental agency, i.e.:
Uniform Building Code, National Electrical Code, Uniform Plumbing Code, Uniform Mechanical Code,
State Title 24, Uniform Fire Code, Uniform Building Security Code.
All of the participating professionals listed in the brochure are former building department employees or
plan checkers with a combined total of over seventy years of experience in professional design and local
agency code enforcement service.
Plan review and coordination are at this time performed in the Camarillo office. Review and
documentation for the average plan review process takes approximately five to seven working days. Large
($6,000,000 yAluatigiLor more) or unusual plans may take longer; however, every effort will be made by
Richard S. Miyahira & Associates, Inc., to complete the initial review of these projects within twelve
working days. Subsequent reviews (back check) to verify corrections are anticipated to take 3 to 5
working days.
Building Department Administration
When the absence of permanent personnel during interim periods creates a void in the city's ability to
effectively administer the day -to -day operations of its Building and Safety Department, Richard S.
Miyahim & Associates, Inc., is capable of heading the department in a consulting role by helping to write
adoption ordinances and resolutions as required to incorporate model codes into local law, assisting in the
preparation of the operating budget, staff training and scheduling, and a variety of other professional
services.

Structure Safety Surveys
Local jurisdictions throughout California are finding the need to assess, survey, and analyze existing
structures for seismic safety. Coalinga, Sylmar, Whittier, and the recent Loma Prieta seismic events
demonstrate the vulnerability of many different building types, especially the older unreinforced masonry
structures located in many cities throughout the state. Richard S. Miyahira & Associates, Inc., assisted the
City of Culver City in developing and adopting a seismic hazard mitigation ordinance (adopted January,
1987) to meet the requirement of SB 547.
Richard S. Miyahira & Associates, Inc., would survey and analyze for seismic resistance capacity those
existing structures identified by the jurisdiction and/or building owner. Recommendations for corrective
measure and a probable cost estimate for said repairs would be provided as well.
