All items listed are heard and acted upon by the City Council unless otherwise noted. 1. CALL TO ORDER: Mayor Parvin called the meeting to order at 7:24 p.m. 2. PLEDGE OF ALLEGIANCE Dave Klotzle, City Engineer/Public Works Director, led the Pledge of Allegiance. 3. ROLL CALL: Present: Councilmembers Mikos, Millhouse, Pollock (arrived at 7:32 p.m.), Van Dam, and Mayor Parvin. Staff Present: Steven Kueny, City Manager; Deborah Traffenstedt, Assistant City Manager; Ron Ahlers, Finance Director; David Bobardt, Community Development Director; David Klotzle, City Engineer/Public Works Director; Jeremy Laurentowski, Parks and Recreation Director; Captain Wade, Sheriff's Department; and Maureen Benson, City Clerk. 4. PROCLAMATIONS AND COMMENDATIONS: None. 5. PUBLIC COMMENT: Kim Ramseyer, a resident of Home Acres, spoke in regard to contacting Caltrans to declassify Los Angeles Avenue as a State Route in order to allow the City to re-route trucks. She also spoke about increasing City revenue with innovative and fun venues to attract more people to spend money within the City, especially on High Street. 6. ANNOUNCEMENTS, FUTURE AGENDA ITEMS, AND REPORTS ON MEETINGS/CONFERENCES ATTENDED BY COUNCILMEMBERS AND MAYOR: Councilmember Millhouse announced September is National Rail Safety Month and cautioned everyone to use care to remain safe at rail crossings. Councilmember Mikos announced having attended the gala opening of "Annie Get Your Gun" at the High Street Arts Center. She encouraged attendance. Mayor Parvin announced Walnut Acres Park located on Second Street opened to the public on September 11 and a grand opening is planned for the near future. She thanked Jeremy Laurentowski, Parks and Recreation Director and his staff for this newest addition to Moorpark's parks system. Mayor Parvin announced there will be an Arroyo cleanup on Coastal Cleanup Day September 19, originating at Villa Campesina Park. Mayor Parvin announced the City will hold an electronic waste disposal and secure paper shredding event at the Moorpark Police Services Center on Fitch Avenue on September 19. Mayor Parvin announced September 20 is Free Landfill Day for Moorpark residents at the Simi Valley Landfill. Mayor Parvin announced "Author Talk" will take place on September 21 at the Moorpark City Library where Moorpark resident and author, Nick Marinoff will share money saving tips for students and their families from his new book "Take a `Loan' Off Your Shoulders: 14 Simple Tricks for Graduating Debt-Free". Mayor Parvin announced Golden Grades Tutoring is back at the Library on Mondays with Moorpark High School students offering FREE tutoring for all grade levels in ALL subjects. Mayor Parvin announced the Sheriffs Office, in support of the Drug Enforcement Administration's (DEA) 10th annual National Prescription Drug Take-Back Day, will be opening patrol stations on Saturday, September 26, 2015 from 10:00 a.m. to 2:00 p.m., to collect expired and unused medication. Mayor Parvin announced Moorpark Country Days Parade and Street Fair is Saturday, October 3 from 10:30 to 3:00 p.m. on High Street. Mayor Parvin announced the Moorpark Mammoth Run sponsored by the Rotary Club of Moorpark and the City of Moorpark will take place on Sunday, October 4. All proceeds benefit local charities. Consider Resolution Updating Permit Application Review and Processing Fees and Deposits to Include Flat Fees for the Cost of Police Department Review of Certain Permits and to Adjust Appeal Fees, and Rescinding Resolution No. 2015-3382, and Finding This Action Exempt from the California Environmental Quality Act. Staff Recommendation: 1) Open the public hearing, accept public testimony, and close the public hearing; and 2) Adopt Resolution No. 2015-3436. ROLL CALL VOTE REQUIRED Mr. Bobardt gave the staff report. Mayor Parvin opened the public hearing. There were no speakers. Mayor Parvin closed the public hearing. MOTION: Councilmember Millhouse moved and Councilmember Pollock seconded a motion to adopt Resolution No. 2015-3436, updating Permit Application Review and Processing Fees and Deposits to include flat fees for the cost of Police Department review of certain permits and to adjust Appeal Fees, and rescinding Resolution No. 2015-3382; and finding this action exempt from the California Environmental Quality Act. The motion carried by unanimous roll call vote. B. Consider Public Hearing and Recommendation to the Save Open Space and Agricultural Resources (SOAR) Board on an Update to the Moorpark City Urban Restriction Boundary (Moorpark CURB). Staff Recommendation: 1) Open the public hearing; accept public testimony, and close the public hearing; and 2) Direct staff to prepare a letter for the Mayor's signature to the SOAR Board expressing the support of the City Council for an updated Moorpark CURB as presented in the agenda report. Mr. Bobardt gave the staff report. Mayor Parvin opened the public hearing. David Sasek, Director of Water and Sanitation for Ventura County Waterworks District 1 , 6767 Spring Road, Moorpark, requested the Council take into consideration the Moorpark Desalter Project, which is proposed to be constructed on one of the parcels under discussion for inclusion in the adjustment to the Moorpark CURB. He provided a letter to the City Clerk addressed to the Council requesting any future project be conditioned to support the Desalter project. Minutes of the City Council/Successor Agency Moorpark, California Pace 4 September 16, 2015 Dawn Mortara, a Moorpark resident and proponent of SOAR, spoke in support of expanding the Moorpark CURB, as more development will be required. Thomas Duck, a Moorpark resident, spoke in opposition to expanding the Moorpark CURB and requested the Council drop this proposal and leave farm land and open space alone. Kim Ramseyer, a resident of Home Acres, spoke in opposition to the proposal and predicted the area will need to keep farm land in order to grow more food for the expanding population. She stated this proposed expansion should go to the voters. Linda Shishino-Cruz, a Moorpark resident, spoke in opposition to the proposal and stated any changes should go to the voters. Sharon Noel, spoke in opposition to the proposal and in favor of protecting SOAR, upholding its principles to protect the quality of life in Moorpark. Krista Pederson, a Moorpark resident, spoke in opposition to the proposal, citing an increase in traffic; and requested solutions to the existing congestion on the roadways in Moorpark. Robert Impellizzeri, a Moorpark resident, spoke in opposition to the proposal and spoke about increased traffic making an extremely dangerous roadway even more problematic. Jean Tufts, a resident of Home Acres, spoke in opposition to the proposal citing Ventura County's reputation as the most desirable place to live in the country due to its open space and farm lands. As an original proponent of SOAR, she opposed any more houses in Moorpark. David Ross, a Moorpark resident commented on the challenges of farmers and the increased demands a growing population will have on resources. He recommended increased recreational uses be considered especially along the Arroyo; and a need to make plans in consideration of the Desalter project so it does not compete with development. In response to Mayor Parvin, Ms. Benson read two Written Statement cards from Mayta Welnak and Stephanie Staie, both in opposition to the proposal. Mayor Parvin closed the public hearing. Minutes of the City Council/Successor Agency Moorpark, California Page 5 September 16, 2015 A discussion followed among the Councilmembers and staff which focused on: 1) Impacts from the proposed development of the movie studio on property across from the site; 2) The size of, and area required for the desalter wells on the parcel; 3) The State of California's housing requirements for future population growth; 4) Allowing a future Council the flexibility to decide the potential development of the proposed increase in the Moorpark CURB; 5) Considering lengthening the time to implement the change to the CURB from 5 years to 10 years after the expiration of the existing SOAR Ordinance; 6) Recognizing SOAR is not about "no growth", but about "responsible growth"; 7) Evidence of the Council's good stewardship by recent purchases of land to be dedicated as open space; and 8) Keeping the status quo and dropping the proposal. MOTION: Councilmember Millhouse moved and Councilmember Pollock seconded a motion to direct staff to not prepare a letter of support as suggested in the agenda reportt . The motion carried by unanimous voice vote. 9. PRESENTATION/ACTION/DISCUSSION: A. Consider Resolution Initiating Proceedings to Annex, and Resolution of Intent to Annex Tract 5463 (Toll Land XX LP) to Landscaping and Lighting Maintenance Assessment District 01-02, Preliminarily Approve the Engineer's Report and Provide Notice of Public Hearing on October 7, 2015. Staff Recommendation: 1) Accept and approve the Petition and Waiver from Toll Land XX LP requesting the annexation of Tract 5463 into Assessment District AD 01-02; 2) Adopt Resolution No. 2015-3437 initiating proceedings to annex Tract 5463 into Assessment District AD 01- 02; and 3) Adopt Resolution No. 2015-3438 of intent to annex Tract 5463 into AD 01-02, preliminarily approve the Engineer's Report and provide notice of a public hearing on October 7, 2015 Mr. Klotzle gave the staff report. Consider Extending Suspension of Enforcement of Recreational Vehicle and Trailer Parking and Storage Standards on Private Property in Minutes of the City Council/Successor Agency Moorpark, California Page 6 September 16, 2015 Residential Zones. Staff Recommendation: Direct staff to continue suspension of code compliance efforts at enforcing provisions of Section 17.32.120 of the Moorpark Municipal Code through November 30, 2015. Mr. Bobardt gave the staff report. There were no speakers. Consider Minutes of Regular City Council/Successor Agency Meeting of September 2, 2015. Staff Recommendation: Approve the minutes. C. Consider Warrant Register for Fiscal Year 2014/15 — September 16, 2015. Staff Recommendation: Approve the warrant register. D. Consider Resolution Amending the Conflict of Interest Code of the City of Moorpark and Rescinding Resolution No. 2014-3346. Staff Recommendation: Adopt Resolution No. 2015-3439, rescinding Resolution No. 2014-3346. E. Consider Amendment No. 2 to Agreement with Berry General Engineering Contractors Inc. for Parking Lot Improvements at Various City Parks and Facilities and Resolution Amending the Fiscal Year 2015/16 Budget to Fund the Parking Lot Improvements. Staff Recommendation: 1) Approve Amendment No. 2 and authorize the City Manager to sign Amendment No. 2, subject to final language approval by the City Manager; and 2) Adopt Resolution No. 2015-3440. ROLL CALL VOTE REQUIRED F. Consider Resolution Amending the Fiscal Year 2015/16 Budget to Hire a Professional Recruitment Firm for Recruitment Services Company. Staff Recommendation: Adopt Resolution No. 2015-3441, amending the FY 2015/16 Budget for recruitment of two positions. Consider Ordinance No 435, an Ordinance of the City of Moorpark, California, Amending Title 15, Buildings and Construction, of the Moorpark Municipal Code, by Adding Chapter 15.21 — Small Residential Rooftop Solar Energy Systems, and Determination That the Creation of an Expedited, Streamlined Permitting Process for Small Residential Rooftop Solar Energy Systems Is Exempt from the Provisions of the California Environmental Quality Act. Staff Recommendation: Waive full reading, declare Ordinance No. 435 read for the second time, and adopted as read. ROLL CALL VOTE REQUIRED Ms. Benson read the title of Ordinance No. 435.
