C . 799 9g c ON d� AGENDA REPORT �s�� City of Moorpark TO: Honorable City Council A''/ PROM: Jaime Aguilera, Director of Community Development/` Prepared by Craig Malin, Assistant Planner DATE: June 25, 1993 (CC meeting 7/7/92) SUBJECT: DP 362 Minor Modification No. 1 (Dong) BACKGROUND Development Plan No. 362 was approved by the Planning Commission (Resolution No. PC 87-138) on May 18, 1987 for the construction of a 23,040 sq.ft. industrial office building. On June 7, 1993 Zoning Clearance 93-141 was approved to remodel the interior of the building for a new tenant. DISCUSSION This request for a Minor Modification is for the construction of a 630 sq.ft. outdoor patio cover, concrete patio slab, additional landscaping, relocation of the existing trash enclosure and reduction in the number of parking spaces. This patio will be used by employees as a lunch and break area. and has a proposed setback of 10 ' from the western property line and 16 ' from the northern property line, meeting all setback requirements. The cover will be constructed of wood, with a lattice type roof, and be whitewashed to match the color of the existing building. The patio slab, trash enclosure and landscaping are exempt from setback requirements. As constructed, the building has 74 parking spaces provided. Construction of the patio will eliminate three parking spaces. Although three spaces will be eliminated, the building requires only 71 spaces, consequently, all parking requirements are met. The existing trash enclosure will be relocated to the northern side of the parking aisle. This location will not be visible from New Los Angeles Avenue. Honorable City Council June 25, 1993 (CC meeting 7/7/92) Page 2 Staff will condition that recycling bins be added, the new trash enclosure be painted a color that matches the existing building and that City's Rubbish and Recycling Requirements (set forth in the Conditions of Approval) be met. Staff will also condition that the proposed chain link fence surrounding the patio area be replaced with a wrought iron fence. In addition, clinging vines must be added to the patio cover to improve it's appearance. This proposal has been reviewed by the Director of Community Development, who has approved the application. Pursuant to Resolution No. 88-523 , the Director has the authority to approve Minor Modifications. This matter is being presented to the Council as a courtesy. Should the Council, or any other party, desire to appeal the Director's decision, a public hearing should be scheduled. The next available hearing date is August 4, 1993. If the Council takes no action, then the Director's decision will stand. STAFF RECOMMENDATION Receive and file this report. As shown on Exhibit "A" . The land involved is Assessor's Parcel No. : 512-0-240-105, in the M-1 zone. Categorically exempt from CEQA requirements as a Class 3, Exemption for Minor Alterations. California Environmental Quality Act (CEQA) Compliance: This Department has reviewed the project to ascertain if there will be a significant effect on the environment. It has been determined that this project is categorically exempt from CEQA requirements as a Class 3 exemption for minor alterations. Ordinance Compliance: Based upon the information and findings developed by staff, it has been determined that this application, with the attached conditions, meets the requirements of Moorpark Ordinance Code Section 8111-2. 1.2 - Permit Standards, in that; a. The Minor Modification is consistent with the intent and provisions of the City's General Plan and of Division 8, Chapters 1 and 2 of the City Ordinance Code; b. The Minor Modification is compatible with the character of surrounding development; c. The proposed Minor Modification would not be obnoxious or harmful, or impair the utility of neighboring property or uses; d. The Modification would not be detrimental to the public interest, health, safety, convenience, or welfare; and e. Zoning Clearance and Building Permit: Upon the expiration of the 15 day appeal period and upon completion of the "prior to zoning clearance" conditions, a Zone Clearance may be obtained from the Community Development Department. The number, size, color of the bins required, and the space allocation for areas of disposal with enclosures shall be approved by the Director of Community Development and the City employee responsible for recycling/solid waste management programs. a. Rubbish disposal areas shall include adequate, accessible and convenient areas for collecting and loading recyclable materials. The dimensions of the recycling area shall accommodate containers consistent with current methods of collection in the area in which the project is located. b. Adequate number of bins or containers shall be provided to allow for the collection and loading a recyclable materials generated by the development. For commercial (general, office, or retail) or industrial developments, space allotment for 2 three cubic yard bins (107" x 84 or 168" x 53.5") , or a space allotment for one 40 cubic yard bin (288" x 120" ) and one 3 cubic yard bin (84" x 53.5) . The intended use for this space is to hold two side-by- side 3 cubic yard containers (one for refuse, one for recyclables) , or one 40 cubic yard bin for refuse and one 3 cubic yard for recyclables. c. The design of the refuse disposal areas shall be compatible in design with the development and the surrounding area. d. Disposal areas shall be protected from weather conditions which might render collected recyclable materials unmarketable. e. Driveways or travel aisles shall provide unobstructed access for collection vehicles and personnel, and provide the minimum vertical clearance of 30 feet, or other specified clearance required by the collection methods and vehicles utilized by the hauler.June 29, 1993 f. A sign, approved by the Director of Community Development, clearly identifying all recycling and solid waste collection and loading areas, and the materials accepted therein shall be posted adjacent to all points of access to the recycling areas. Refuse disposal areas shall not be located in any area required by the Municipal Code to be constructed or maintained as unencumbered, according to fire and other applicable building and/or public safety laws. h. Recycling area (s) shall be located so they are convenient and adjacent to regular refuse collection areas. i . Enclosure. The design of the refuse enclosure shall be subject to the approval of the Director of Community Development, prior to the issuance of a zoning clearance. All rubbish disposal areas shall be screened with a six foot high, solid wall enclosure with metal gates. Pipe guards shall be eliminated around typical rubbish bin enclosures. 1. In cases where space for 2 three cubic yard bins is required (107" x 84 or 168" x 53 . 5") , the opening of any bin enclosure must be at least 84 inches (the size of a three cubic yard bin) . This requirement applies to the amount of space exposed when the gate is fully opened. 2. Each refuse\recycling enclosure shall have gates and should be designed with cane bolts to secure the gates when in the open position. 3 . Space allocation for rubbish and recycling enclosures shall be designed in a manner that complies with the equal access requirements of Title 24 of the American with Disabilities Act. 2) The proposed chain link fence surrounding the patio area will be replaced with a wrought iron fence. 3) The patio cover shall be painted a color which matches the existing building. 4) Clinging vines shall planted which will cover the lattice work on top of the patio cover and the supporting posts.
