Lindley, Assistant to the City Manager July 1, 1993 (CC Meeting of July 7) Consider the Draft Legislation Establishing the Ventura County Waste Management Authority jou may recall, the purpose of the Ventura County Waste jement Authority is to provide one regional agency that will ge all solid waste facilities and regional policies for its ar agencies. The Authority would make consistent and dinated policy for processing, recycling, composting, >formation, marketing, and disposal of materials. It would ce redundancy and enhance consistency in regulatory activities tywide, reduce service duplication, provide for regional and 1 compliance with state mandates, and reduce and clarify 3nsibilities for known and unknown present and future ilities. As it now stands, VRSD's solid waste :ions, assets, and liabilities will be separated from its awater functions, assets, and liabilities. All VRSD's I waste functions, assets, and liabilities will be assumed by zew Waste Management Authority and VRSD will cease to exist as .id waste agency. The Authority will not be a merger of VRSD's she County of Ventura's solid waste functions, but a brand new :y that will assume the solid waste functions of both agencies. Was a Management Authority Jul 1, 1993 Pact 2 The major changes that have developed since the Council reviewed the proposed legislation in February include the terms for par icipation in the Authority, withdrawal, membership, and voting. As originally drafted, participation was mandatory for all jur sdictions upon the establishment of the Authority. Establishment of the Authority was to take place upon an aff rmative vote of at least eight cities and the County. As it now stands, participation in the Authority is voluntary. Upon an aff rmative vote by seven cities and the County, the Authority will be stablished. Any jurisdiction that does not wish to join the Aut ority must indicate so by a majority vote of its governing body wit in thirty days after the date the Authority is formed. It is important to note that as the Legislation is currently written, a jurisdiction may be at a disadvantage if it chooses not to oin the Waste Authority. The Authority will be responsible for sol d waste planning, operations, facility development, and setting rat s for solid waste facilities, i.g., landfills and MRFs. Cur ently, the Ventura County Board of Supervisors is the final authority for these types of actions, and it makes decisions by soliciting comments from the Waste Commission. In addition, the Aut ority will act as the Local Task Force (LTF) under AB 939. As it stands now, the LTF is the Waste Commission and is responsible for approving the cities' and County's Integrated Solid Waste Man gement Plans and overseeing siting, development, and operation of tolid waste facilities. The decisions that the Authority will make will have a direct impact on all jurisdiction whether they are mem ers or not. As a member, the City would be directly involved in etting policy and facility rates. If the Council believes that it s not in the City's best interest to join the Waste Authority, it hould consider recommending language changes that would give non member agencies some participation in deciding issues that dir ctly affect them. The original proposed legislation did not have the withdrawal pro ision that is now included as Article 5 in the sixth draft. In the event that the Legislature amends this legislation at anytime in 1he future, any member agency may withdraw from the Authority. If E member agency chooses to withdraw, they will still be bound by any obligations established prior to the agency's notice of wit drawal. In addition, withdrawing agencies may only reassume flov control over their solid waste when commitments expire or in the event that they agree to provide financial assurances to supliort past commitments to solid waste facilities.
