Consider Resolution Establishing a Permit Only
Parking Program
is presents the subject Resolution with revisions offered
the Transportation and Streets Committee (Councilmember
zniak and Councilmember Hunter) and the City Council.
. Authority
On August 4, questions were raised regarding the authority
cited for the establishment of Permit only parking. The
language set forth in Section 22507 of the California
Vehicle Code allows local authorities to establish parking
restrictions on any designated street, during all or
certain hours of the day, with provisions for the issuance
of PERMITS to the residents on such streets, conferring to
same preferential parking privileges. These restrictions
may be applied to all vehicles or to just vehicles more
than six feet in height. The proposed resolution would
apply to all vehicles. A copy of Section 22507 is
attached as Exhibit W.
. Resolution
Attached as Exhibit B is a draft resolution establishing
this program. The draft resolution addresses the
following points:
• areas to be subject to the program shall be designated
by separate resolution(s);
• Permits may be issued exempting certain vehicles form
the program;
rmit Only Parking
ge 2
• Policies, procedures and guidelines shall be developed
and maintained by the City Manager for the
establishment of such zones and the issuance of
permits; and,
• said policies and procedures shall include certain
minimum standards set forth in the resolution.
. Policies and Guidelines
Attached as Exhibit C is a draft of the Policies and
Procedures for the administration of this program, which
include the revisions offered by the City Council. These
policies and procedures set forth guidelines related to 1)
the designation of a given area as a PERMIT ONLY parking
zone, and 2) the issuance of permits exempting certain
vehicles from the overnight parking prohibition.
i. Administration
The Parking Permit Program previously established for
University Drive and for the area across the street from
Peach Hill Park, allow the City Manager to develop,
maintain and revise a set of procedures for the
administration of those programs. It is recommended that
the City Manager be granted like authority for this
program as well.
taff recommends that the City Council take the following
ctions:
Adopt the attached Resolution (Exhibit 'B') establishing
a PERMIT ONLY parking program.
. Approve the Policies and Procedures for the program
attached as Exhibit C.
. Authorize the City Manager is revise and amend said
procedures as may be necessary to properly administer this
program in a manner consistent with the policies set forth
in the Resolution.
