Rubin, Solid Waste Coordinator DATE: October 12, 1993 (CC Meeting of 10/20/93) ITEM F ', -AN, CAL C Duns I Me, �1 3 CTI p/ Odom Gy SUBJECT: CONSIDER RESOLUTION 93- 9$D APPROVING THE SUBMITTAL OF A GRANT APPLICATION FOR A USED OIL RECYCLING PROGRAM, AND AUTHORIZE THE CITY MANAGER TO EXECUTE THE AGREEMENT AND REQUESTS FOR PAYMENT. 411 Y The City Council is being asked to consider adoption of a resolution approving the submittal of the City's application to the California Integrated Waste Management Board ( CIWMB) for the used oil recycling block grant, and authorize the City Manager to execute any agreements, contracts, and requests for payments. BACKGROUND The main purpose of this grant program is to provide funding to local governments who want to establish used oil collection programs that encourage recycling or appropriate disposal of used oil. To be eligible, one used oil collection center for every 100,000 residents must be certified by the CIWMB or plan to be certified by December 31, 1994. To receive a block grant, the City must develop a local used oil collection program that includes a description of how it will meet eligibility criteria and a budget for how the grant funds will be spent. A local used oil collection program may include any activity(s) that the City believes will enhance recycling or the appropriate disposal of used oil within their jurisdiction. A City must demonstrate that it already has a certified collection center, or will have a certified center in the future and may be awarded a grant on a conditional basis. A City may also meet grant eligibility requirements by participating with another jurisdiction that has certified centers. A business applies to the CIWMB to become a certified collection center. The certified centers accept, at no charge, a maximum of 20 gallons of used lubricating oil from a person, per day. A certified center must offer a $0.04 per quart recycling incentive to "walk -in" clients, or accept "donations" of used oil. Reimbursement need not be given for oil changes done by the certified center. On a quarterly basis, the certified center invoices the CIWMB for the amount of incentive funding given to the public to receive reimbursement. The certified center must also post on -site signs provided by the CIWMB, and advertise at least twice a year through the local media. Honorable City Council Used Oil Recycling Grant October 20, 1993 Page 2 The certification program also includes subsidies from the CIWMB to dispose of contaminated oil - up to $5,000 in disposal costs for one shipment per year. A portion of the grant funding may be used towards the costs for disposal of additional contaminated shipments if necessary. Most used oil collection contractors offer free disposal (recycling) of clean used oil. Staff contacted all Moorpark auto repair businesses to solicit interest in the certification process for used oil collection. Because three businesses have expressed interest in becoming certified, but have not obtained certification, the City would be applying for grant funding on a "conditional" eligibility basis. Conditional eligibility means that cities must demonstrate that their proposed local used oil collection program /center will allow them to achieve full eligibility by the end of the grant term - December 1994. Grant funding will be based on a per capita basis - $0.317 per resident - determined by the Department of Finance population statistics. According to their statistics the population for the City is 26,700, amounting to $8,463.90 available in funding. It is the City's discretion to use the grant funds as deemed appropriate. All or partial funds could be used to purchase equipment for the certified center(s), such as oil containment drums, oil filter crushing mechanisms, and oil contamination testing equipment. Staff estimates that the cost for equipment is approximately $3,000. Additionally, the remaining grant funding may be used towards partial costs for contaminated oil disposal, overhead costs, and public information. Staff proposes to use only the grant funding to support the certified center(s). If there is a need to expand the program, staff will return to Council for direction. Payment for additional costs incurred to the certified center(s), such as additional contaminated disposal costs, as well as costs to continue the program in later years, will be negotiated between the City and the certified center(s). The regulations do not stipulate who retains ownership of the equipment purchased for a certified center. It is staff's intent to develop an agreement with the certified center(s), addressing ownership and maintenance of the equipment, and costs for contaminated disposal in later years. The City may stipulate that the certified center(s) may use the equipment as long as it Honorable City Council Used Oil Recycling Grant October 20, 1993 Page 3 maintains certification, otherwise the equipment will return to the City, until another location becomes certified. The grant application must contain an approved resolution from each City's governing body authorizing submittal of the application and identify the individual authorized to executive any agreements, contracts, and requests for payments. The Public Works, Facilities, and Solid Waste Committee (Mayor Pro Tem Montgomery and Councilmember Wozniak) considered this item at their September 20, 1993 meeting, and concurred with staff to recommend submittal of a grant application to the CIWMB. The CIWMB will accept applications for the grant program until 4:00 p.m. on October 29, 1993. RECONKENDATION The Public Works, Facilities, and Solid Waste Committee (Mayor Pro Tem Montgomery and Councilmember Wozniak) and Staff recommend that the City Council: 1) Adopt Resolution 93- approving the submittal of a grant application for a used oil recycling program; and 2) Authorize the City Manager to execute the agreement and requests for payment.
