SUBJECT: Consider Meeting with the Solid Waste Haulers for the
Purpose of Discussing Contract Changes.

Recently the City of Simi Valley renegotiated their contract for
solid waste, recyclables, and green waste collection. Simi Valley
utilizes two of Moorpark's primary haulers - Anderson Rubbish and
G.I. Rubbish. A copy of this contract has been previously provided
to the City Council.
The Public Works, Facilities, and Solid Waste Committee (Mayor Pro
Tem Montgomery and Councilmember Wozniak) had the opportunity to
review the Simi Valley contract, and have identified items that the
Council may want to consider for inclusion in the City's franchise
agreements. The highlights of the Simi Valley Agreement with G.I.
Rubbish and Anderson Rubbish are as follows:
• Term - 10 years commencing on September 1, 1993 and expiring
August 31, 2003.
• No increase in the current residential discard collection rate
for implementation of the yard waste or automated discard
program. Rates will be adjusted based on a formula which
computes adjustments in the CPI and landfill rates.
• Provides for one annual curbside collection of up to two bulky
items, commencing January 1, 1994.
• Provides for the franchising and rate regulation of all
commercial discards, effective January 1, 1994.
• Provides for the implementation of a citywide weekly yard
waste collection program by July 1, 1994. Resident supplies
container designated by a hauler provided sticker. Residents
may use up to two ( 2 ) 45 gallon containers. If residents need
to set -out more than two containers per week, they can at a
cost of $5.00 /month for a minimum of two (2) additional
containers.

Beginning February 1, 1995, residents will no longer be
furnished new or replacement recycling containers by the City
- they will use a sticker for designation.
Provides for the implementation of a citywide residential
automated discard collection system by July 1, 1995. Each
resident will receive one 60 gallon collector - provided
container, an additional 60 gallon container may be used at a
$5.00 per month fee.
• Requires the collectors to guarantee the City's compliance
with AB 939 goals and indemnifies the City against AB 939
f ines .
The Moorpark agreements for solid waste collection are due to
expire within the next two years. The Commercial agreement expires
June 30, 1994, and the Residential agreement expires June 30, 1995.
In a letter dated September 2, 1993, the haulers - G. I. Rubbish and
Anderson Rubbish requested to meet with the Public Works,
Facilities, and Solid Waste Committee to initiate discussions about
programs and other items we may wish to consider in our contacts.
In light of the request from the haulers and the City's desire to
implement additional waste reduction programs (specifically green
waste collection), the Committee and Staff believe that a meeting
with the haulers will be advantageous.
RECOMMENDATION
The Public Works, Facilities, and Solid Waste Committee (Mayor Pro
Tem Montgomery and Councilmember Wozniak) and Staff recommend that
the City Council direct the Committee to meet with the haulers for
the purpose of discussing potential Solid Waste contract changes,
and to provide any further specific direction desired by the City
Council.

As you may be aware, G.I. Rubbish and Anderson Disposal Service have just completed
negotiations with the City of Simi Valley for an exclusive agreement for the
collection of residential, multifamily, and commercial discards. The agreement was
approved at the August 23rd Simi Valley Council Meeting.
We have spent many months working with Simi Valley City Staff negotiating this
agreement. We are very pleased with the results-of this comprehensive agreement,
which are equitable and beneficial to all parties concerned. The agreement includes
the provision that the hauler's are responsible for attaining the goals of AB 939.
We are willing to accept this responsibility given a long -term agreement which allows
us to invest in the necessary equipment and programs to attain such goals.
With Council's 'approval G.I. Rubbish and Anderson Disposal Service, respectfully
request to present a similar agreement to that adopted by the City of Simi Valley,
for your review and consideration. The proposed agreement will take into account
Moorpark's specific waste stream disposal needs and diversion issues. We also
request to schedule a meeting with the Council members of the Public Works,
Facilities, and Solid Waste Committee, to further discuss the issues and waste
reduction programs presented in the proposed agreement.
We feel that it is important to initiate discussions for a comprehensive agreement at
this time, due to the upcoming Moorpark rate review proceedings, the need for a
city -wide greenwaste program, and impending goals of AB 939.
We realize that the franchise agreements for commercial and residential service are
due to expire on June 30, 1994 and June 30, 1995, respectively. Because of the
length of time involved in the contract negotiations with Simi Valley, and currently
with the City of Thousand Oaks, we felt that it would behoove us to initiate the
process at this time to ensure that all issues are :discussed in detail, and allow us
to properly plan for future waste reduction programs.
