C TION: MEMORANDUM The Honorable City Council Jaime Aguilera, Director of Community Development Paul Porter, Senior Planner September 28, 1993 (CC meeting of October 6, 1993) SUBJECT: CONSIDER NEMO FROM THE PLANNING COMMISSION REGARDING HILLSIDE ORDINANCE PRIORITY AND INSTRUCT STAFF APPROPRIATELY Background At the Planning Commission meeting of September 20, 1993, the Planning Commission recommended that the City Council direct staff to draft a Hillside Ordinance and that the drafting of this ordinance be given a high priority. The Planning Commission believes that adoption of a Hillside Ordinance should be completed prior to any specific plans entitlements reaching the Planning Commission for review. The concern on the part of the Planning Commission is that at the present time the City does not have the proper tools at its disposal in order to critique projects which propose to severely grade the City's hillside areas and that without an ordinance in place, the City may provide differential treatment to individual developments due to a lack of standard requirements. Discussion This matter was discussed by the Community Development Committee at their meeting on September 19, 1993. The Committee recommended that this matter be placed on the Council Agenda and that the Council direct staff to write a draft Hillside Ordinance which would be reviewed by the Community Development Committee prior to it being reviewed by the City Council and the Planning Commission. The Community Development Committee recognizes that much work has been done in the past. Ordinances from other cities have been collected and meetings of the Planning Commission and City Council have provided comments. The Community Development Committee also understands that staff is familiar with the concept and with the various alternatives. It is the Committee's view that allowing staff to formulate a set of regulations, then having the Community Development Committee and the City Council critique the product is the most expeditious and effective way in which to proceed. CC 1 F,C it ON' , By Recommendations: 1. That staff be directed to draft a Hillside Ordinance as a top priority. 2. That the process utilized to review the proposed ordinance be as follows: a. That the Community Development Committee review the ordinance as prepared by staff. b. That the City Council review the ordinance as an action discussion item and subsequently instruct the Planning Commission to hold a public hearing to review the ordinance. C. That the Planning Commission hold a public hearing to review the ordinance and make appropriate recommendations to the City Council. d. That the City Council hold a public hearing to review the ordinance prior to adoption. 3. That staff notify all specific plan applicants and other developers who have exhibited an interest in developing the hillside areas be notified that the proposed ordinance may affect their project or property.
