SUBJECT: Consider Draft Ordinance for Cat Licensing and Proposed
Plan for Implementation
The following report presents a draft ordinance for cat licensing.
As directed, staff has developed the ordinance as provided in
Attachment "A ". If adopted, staff recommends a two stage proposal
for implementation starting with a City -wide mailing, and if
needed, a City -wide canvassing effort.
Backaround
On August 4, 1993, staff was directed to prepare an ordinance which
requires cat owners to license their pets. Three principles were
involved to justify this program: 1) to increase the rate at which
cats are reclaimed by their owners; 2) to balance the cost of cat
care at County facilities with the demand placed on the facilities
by the volume of cats handled, and; 3) to improve public safety by
requiring rabies vaccinations prior to issuing cat licenses.
Staff previously provided a variety of statistics based on 1991/92
data provided by the County Department of Animal Regulation
illustrating that the majority of Animal Regulation services stems
from the handling of cats. The required services for cats are paid
for by the general public because no licensing revenues are
received to offset the cost as is currently the case with dogs.
The most recent statistics support this justification and show that
5,020 dogs were handled and 7,082 cats were handled in 1992, as
presented in Attachment "B ".
In relation to the public health and safety issue which originates
from the spread of the rabies virus via unvaccinated cat bites,
staff has completed additional research with the State's Department
of Public Health Services, Veterinary Public Health Unit,
Infectious Disease Section. As reported in a recent study written
by the Veterinary Unit, (titled "public Health Review of Rahie I
14 cat bites were reported to the State in the past three years
which have resulted in the spread of rabies, and that a vaccination
and licensing program would greatly reduced this risk to the
public's health. There were 15,000 cat bites reported to the State
in 1992, (316 in the County), 100 cats were tested for rabies, and
500 .:ats were quarantined.
As previously reported, cats that were lost by their owners have
been recovered from the animal shelters in other jurisdictions at
a . --ate of three times the rate of previous years, after the
licensing programs have been initiated, (citing Alameda which
adopted the program in January 1993). The current rate of an
owner's recovery of a lost cat from the County shelter is 1.9%
compared to approximately 34% for all dogs. Based on Alameda's
experience, it is reasonable to anticipate that this rate would
increase to 5.7% in Moorpark, or from 126 to 404 out of 7,082 cats
handled, (using 1992 statistics), during the first year of
implementation.
Discussion
In the following discussion, staff will address the concerns
expressed by the Council at the Council meeting of August 4
regarding compliance and the use of cat licensing revenue for
educational purposes. Staff will also summarize the draft
ordinance.
Draft Ordinance
Staff prepared the draft ordinance based on the City's existing dog
license law. The proposed law only addresses licenses and rabies
vaccinations, and excludes changes when they make reference in the
existing law which pertain specifically to dogs, (such as leash
requirements and dog defecation, exemptions for seeing eye dogs).
The proposed fee for cat licenses is the same as the cost to dog
owners, with some minor clarifications to be addressed at the end
of this section.
The ordinance includes a provision for licensing cats where the cat
does not have to wear the tag. Electronic implants, (Section 2,
6 . lE . 010 . C ) when "issued by the County or its agent" excludes a cat
from wearing a tag. In the near future, the Animal Regulation
Department will be carrying scanners for the device in their patrol
vehicles (they are already being used in Simi Valley). Other
information regarding the electronic implant is mentioned on page
4, "Miscellaneous Issues ". Like dogs, if the cat is confined to a
person's house, a kennel or related enclosed structure, the
licensed animal would not have to wear a tag, (Section 2,
6.26.080.A and B).
In Section 4 paragraphs 1, 2 and 3, special attention is provided
to cat owners allowing them to ease into the new requirements
applicable under this law. All three paragraphs allow a one year
adjustment to the process.
In Section 4 paragraph 1, the ordinance waives the fine to cat
owners for not having their cat licensed during the first year of
the program. This allows a cat owner to comply with the new law
after receiving a citation, (which is therefore a warning). This
provision allows the Animal Regulation Department to enforce the
law through a hearing and /or court process if compliance is not

reached within 30 days of the citation.
In Section 4 paragraph 2, the ordinance allows a cat owner to
obtain a license for cat that has been represented as altered
(currently a $7.50 fee instead of a $25 fee) by signing a statement
indicating that the surgery was performed but that no certificate
was issued on or before the effective date (the date is
intentionally left blank). However, after one year, written
verification of the surgery must be provided.
In Section 4 paragraph 3, the ordinance allows a cat owner to
obtain a one year license without proof of having obtained a rabies
vaccination until one year after the effective date of this
ordinance (the date is intentionally left blank). This allows an
owner who may not have previously received a certificate because
none was required, to obtain one before the license is renewed.
Implementation
Staff has identified a rough form of measurement to determine if
the cat and dog license laws are being complied with by citizens
based on statistics provided by County Animal Regulation and the
City of Thousand Oaks. For dogs, a rate of compliance equal to 80%
is the maximum anticipated. For cats, it is estimated that 50% of
the owners will comply. The number of dogs in Moorpark is
estimated at 19% of the population, or 4,940. The number of cats
in the City is estimated at 10% of the population, or 2,600,
(however, a graphic titled "Fido Factor" in the Los Angeles Times,
September 28, 1993, estimates that approximately 39% of the homes
have dogs and 32% of the homes have cats, part of Attachment "C").
Los Angeles County Animal Regulation estimated for Thousand Oaks
that it will take three years to gain compliance from cat owners,
after implementing a licensing program, (and they are encouraging
Thousand Oaks to do so in the near future).
To implement this program, staff recommends that at first, a City-
wide postcard be sent to all residents announcing the new law.
After an analysis of 3 months of compliance, staff will return to
the Council with a report regarding the status of the program, and
if needed, a proposal to establish a City -wide canvassing effort
will be presented.
The City -wide mailing will cost approximately $1,800, not including
staff time to prepare mailing labels, and place them on the post-
cards. It will take 240 new licenses from licensees of altered cats
and dogs to match this cost, therefore, because the number is
somewhat low, staff anticipates no need to appropriate additional
funds. As proposed, the mailer would be intended for cat and dog
owners, printed in spanish and english, and also make pet owners
aware of the new proposed fee increase that the County anticipates
implementing in January, 1994.

As proposed by County Animal Regulation staff, the County fees
(which are also Moorpark's fees), will increase in November from
$25 dollars for unaltered cats and dogs, to $27, and from $7.50 for
altered pets to $8.50 for altered cats and dogs. The Animal
Regulation staff has proposed to the Board of Supervisors to add a
fee for cat licenses to their current fee resolution in October of
this year. Animal Regulation staff has proposed that the new fees
will follow this change, but would not be effective until the first
of the new year. Higher fees may deter compliance in today's
economy.
Using the conservative statistics provided by Ventura's Animal
Regulation Department, staff would then analyze the success of the
mailing after three months, to check compliance rates. If less
than 10% of the cat owners have complied, (260), and the rate of
dog licenses does not improve, than staff will be recommending a
canvassing program to enforce the law.
In 1992, 184 hours of canvassing in Moorpark occurred with Animal
Regulation staff, (which equals approximately 1/4 of the City).
The County reports that there has never been a city -wide canvassing
effort, that available County staff is now half of that available
in 1992, and that a City -wide canvassing effort will require
approximately 620 and 700 hours. When Thousand Oaks completed a
city -wide canvassing effort earlier this year, they saw compliance
for dog licenses increase from 37% to 79 %, (the number of dogs is
estimated at 19% of the population, or 19,000, and 37% equals 7,000
dogs before canvassing to 15,000 licensed dogs after canvassing).
Based upon 2,377 current dog licenses in Moorpark, one could
estimate that of the 4,490 dogs in the City, only 53% are licensed
and that a canvassing effort would increase this closer to the 80%
level of 3,592. In a best case scenario, cat licenses would be
close to 50% compliance, or 1,300.
Staff is recommending delaying the implementation of a canvassing
program because the estimated cost may be prohibitive if compliance
does, not reach the maximum figures of 80% for dogs and 50% for
cats, and also because if the mailer is successful, it may not be
needed. Under the best case scenario, a City -wide canvassing would
cost the City $16,665, with a revenue increase of $32,007, netting
a $15,342 increase overall, (based upon a City derived canvassing
team using some Animal Regulation staff and equipment, and the
proposed 1994 fees, as shown in Attachment "C"). If the level of
compliance is only 10% for cats and 50% for dogs, the investment
would not be off -set by revenue and cost to the City could be as
high as $7,308. Therefore, to break even, the City would have to
invest approximately $16,600 and receive a compliance of 30% for
cats licenses and 75% for dogs licenses.
Attachment "D" is a schedule showing staff's anticipated calendar
for the implementation of this program. It shows that by adopting
a cat licensing ordinance now, the City's plan will match the

licensing, and as previously mentioned, have included this language
in the proposed ordinance. In response to Council concerns, staff
researched the use of micro - chips, the number of vendors and cost
to cat owners, and the role of Animal Regulation in enforcing the
law. Ten veterinary offices were contacted including the four
located in Moorpark. The general consensus is that the cost to the
veterinarian for providing this service does not provide an
incentive for veterinarians to use the device. The veterinarian
currently receives $.50 per dog license issued as an agent for the
County, and has to maintain extensive hardware unique to the
implant procedure. Where many had initially invested in the
equipment, few use it currently, and no veterinarians in Moorpark
use it. The cost to cat owners ranged from $35 to $45 with a
reduced rate for additional pets. Most veterinarians who have the
equipment, (located in Simi Valley and Thousand Oaks), do provide
the type of micro -chip acceptable to County, and do act as "agents"
to the County for issuing licenses. This provision is therefore
provided as a convenient option to the license tag for cat owners,
and not as a cost savings.
The County is proposing a minor amendment to the Animal Regulation
code to increase the incentive to veterinarians for the issuance of
licenses. Currently, a veterinarian receives $.50 for each license
issued. The proposed amendment removes this language from the code
allowing it to be changed more frequently by resolution. In Los
Angeles County, a veterinarian receives $2.00 per license issued.
Staff is uncertain as to the amount being considered by Ventura
County at this time, but it will most likely increase the
incentive, and therefore encourage more Moorpark veterinarians to
participate and ease the ability for a City resident to obtain the
initial license.
The Council requested more information about the use of the revenue
from the proposed cat licensing fees and requested staff to explore
focussing the use of funds for educational purposes. Currently, a
$25 unaltered dog license fee results in a $10 voucher to have the
pet altered, leaving $15 dollars for the City to consider as
revenue. Currently, cat vouchers are paid by a different source of
funds, and the entire $25 fee would be returned to the City. The
current educational program provided by the County was created and
developed without anticipation of receiving cat license revenue.
As long as this program can continue, it is not necessary for cat
license revenues to contribute to it. The "Big Dog" presentation
does address cat population increases by illustrating to children
how East cats can multiply, and also places emphasis on the use of

euthanasia and destroying unwanted cats to a particular cat
"character" and its litter as part of the story. Staff can produce
materials for a more formalized public outreach program to include
paid advertisements, notices in veterinarian's offices, and
posters, but has not yet formalized a program.
Summary
The need for cat licensing has been supported by health and safety
officials, statistics from jurisdictions already using this
program, and by the local statistics which show the cost of County
cat care as surpassing all other costs to the Department of Animal
Regulation. The proposed ordinance makes several allowances for cat
owners during the first year of the program. A plan for
implementation is proposed which allows cat owners to comply, prior
to initiating a major canvassing effort and prior to the fees
increasing.
Recommendation
Tha- the City Council consider the first reading of the proposed
cat licensing ordinance presented in Attachment "A ", and approve
staff's plan for implementation with a report back to Council in
March which will address the possible need for a canvassing effort
in the spring of 1994.

ORDINANCE NO._
AN ORDINANCE OF THE CITY OF MOORPARK, CALIFORNIA,
DELETING EXISTING CHAPTER 6.16 ENTITLED "DOG
LICENSING" FROM, AND ADDING NEW CHAPTER 6.16 ENTITLED
"LICENSING OF CATS AND DOGS" TO, AND REVISING SECTION
6.20.010 AND SECTION 6.20.020 OF, THE MOORPARK
MUNICIPAL CODE.
WHEREAS, it is deemed to be in the best interest of public health,
safety and general welfare to include cats in the licensing practices of
the City, which currently pertain to dogs, in order to control the rabies
virus, to control the cat population, and to assist owners in identifying
their lost cats when they have been impounded;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MOORPARK, CALIFORNIA,
DOES HEREBY ORDAIN AS FOLLOWS:
SECTION 1. The Moorpark Municipal Code is hereby amended by
deleting Chapter 6.16, entitled "Dog Licensing ", in its entirety.
SECTION 2. The Moorpark Municipal Code is hereby amended by adding
Chapter 6.16, entitled "Licensing of Cats and Dogs ", to read as follows:
6.16.010 REQUIRED
A. Every person who owns, harbors or keeps any cat or dog over the
age of four ( 4 ) months within the corporate boundaries of the City for
thirty (30) days or longer shall maintain a current license and
license tag issued under the provisions of this chapter for each cat

or dog.
B. The license tag shall be attached to a substantial collar or
harness which shall be worn at all times by the cat or dog for which
the tag was issued, except as provided in Section 6.16.010 (C) or
Section 6.16.080 of this chapter.
C. Cats with electronic identification, in the form of microchip
implants or other forms of permanent identification approved and
issued by the City or its agent, shall not be required to wear a
collar and tag. All other licensing requirements of this chapter
shall apply to such cat.
D. Every person who violates any of the provisions of this section
is guilty of an infraction.
E. Any dog found without a current license tag may be taken up and
impounded by the pound master or any peace officer. Any cat found
without a current license tag or without electronic identification or
for which there is no current license may be taken up and impounded
by the pound master or any peace officer.
6.16.020 APPLICATION
A. The license and license tag or electronic identification required
by this chapter may be obtained by displaying an acceptable rabies

>>accination certificate, furnishing the information required herein,
and paying the proper fee to the City or its agent. Such information
shall include the name, sex, breed, age and color of the dog or cat
for which the application is made, and the address and, when
available, the telephone number of the person owning, harboring or
keeping the dog or cat. The official receiving such information shall
record it on the receipt to be given for payment of the license fee.
E'. A rabies vaccination certificate, to be acceptable, must show
that the vaccination has at least one (1) year to run before its
expiration date. A vaccination of the chick - embryo type expires
thirty (30) months after it is administered and a vaccination of the
nerve- tissue type expires eighteen (18) months after it is
administered. The expiration date of the rabies vaccination shall be
recorded on the receipt.
6.16.030 LICENSING PERIOD
Tne license period for any license issued pursuant to this chapter
small be the period of time specified on the license application
pursuant to which such license is issued. The license period
specified on any given license application shall be whatever period
the pound master may select for that particular license application;
provided, however, that such period shall not be less than one (1)
year nor more than two (2) years from the date the license is issued;
and provided further, that such period shall not extend beyond the

expiration date of the applicable rabies vaccination. A license shall
expire, and such license and corresponding license tag shall cease to
he current, upon the expiration of the applicable license period.
6.16. ()40 FEE
A. The fee for the license required by this chapter shall be as
prescribed by resolution of the board of supervisors of the County of
Ventura.
Fl. The fee prescribed for a dog or cat which has been spayed or
neutered, as verified by a veterinarian's certificate, shall be no
more than fifty percent (50 %) of the fee for a dog or cat of the same
sex which has not been spayed or neutered.
6.16.050 EXEMPTION FROM FEE.
A dog license shall be issue free of charge in the following
instances:
A. When the license is for a dog which will be used as a guide dog
for a blind person. An affidavit attesting to the fact that the dog
w:Lll be used as a guide dog shall be given to the official issuing the

:3. When the license is for a dog which has been honorably discharged
from the armed services of the United States. Such discharge shall
be established by showing the official issuing the license the
discharge papers issued for such dog.
6.16.060 DUE DATE AND PENALTIES
It. The information and fee required by this chapter are due on the
thirtieth (30th) day after the day on which (1) the previous license,
j any, expires, (2) the dog or cat is acquired by the person owning,
harboring or keeping it, (3) the dog or cat is brought into the City,
or (4) the dog or cat attains the age of four (4) months, whichever
shall last occur.
B. Any person who obtains a license after the due date shall pay,
in addition to the license fee, a late license penalty in an amount
equal to one hundred percent (1000) of the license fee which would be
applicable if the license period was one (1) year, regardless of the
actual license period for which such license is issued. Such penalty
shall be in addition to any other penalty or sanction which may be
imposed pursuant to this chapter for failure to have a license.
6.16.0'10 TAG -- ISSUANCE
Upon receipt of the required information, accompanied by payment of
the proper fee and display of an acceptable rabies vaccination

certificate, a dog or cat shall be licensed, a written receipt shall
oe issued to the applicant, and a metal license tag shall be mailed
�o the applicant's address, or the electronic identification shall be
inserted into the cat. Each license tag or electronic identification
shall be serially numbered and identified with the words "Ventura
County" and shall be marked with the year in which it is issued.
6.16.080 TAG -- EXEMPTION
The license tag need not be worn by the dog or cat when the dog or cat
is:
P.. Securely confined in a cage or vehicle; or
E. Within an enclosure sufficient to securely confine the dog or cat
to the premises of an animal hospital, a licensed dog or cat kennel,
cr a state chartered benevolent organization for the care of animals,
or of the person owning, harboring or controlling the dog or cat; or
C. Participating in, or training for, a sporting event, field trial,
obedience class, or dog or cat show or when the dog is herding
livestock, provided such dog or cat is not running at large.

6.16.090 TAG -- REPLACEMENT
If a license tag issued under the provisions of this chapter is lost,
a duplicate tag may be obtained from the City or its agent upon paying
it fee in the amount prescribed by resolution of the board of
supervisors of the County of Ventura and by either surrendering the
receipt obtained for the lost license tag or certifying under penalty
of perjury that a tag was obtained and that the receipt cannot be
round.
6.16.100 TRANSFERABILITY
In the event that there is a change in ownership of a dog or cat
licensed pursuant to this chapter during the license period for which
such license is issued, the new owner may have the current license
transferred to his name upon payment of a transfer fee in the amount
prescribed by resolution of the board of supervisors of the County of
Ventura and the surrender of the license receipt.
6.16.110 PROHIBITED CONDUCT
Every person who counterfeits a dog or cat license tag, or who
attaches a license tag issued under the provisions of this chapter to
any dog or cat other than the one for which such tag was issued, or
who obtains a dog or cat license and, in doing so, states as true any
material matter which he knows to be false, is guilty of an

infraction.
SECTION 3. The Moorpark Municipal Code is hereby amended by
revising Section 6.20.010 and 6.20.020 to read as follows:
6.20.010 VACCINATION -- REQUIRED.
A. Every person owning, harboring or keeping a dog or cat shall,
within thirty (30) days after such dog or cat obtains the age of four
(4) months, cause it to be vaccinated by a licensed veterinarian with
Cl vaccine of a type approved by the State Department of Health
Services as being suitable for use in declared rabies areas and listed
in the current copy of the Compendium of United States Licensed Animal
Rabies Vaccines.
B. Every person who violates the provisions of this section is
guilty of a misdemeanor /infraction.
6.20.020 VACCINATION -- PROCEDURES.
A. The poundmaster shall provide facilities for the rabies
vaccination of dogs and cats or shall arrange for such vaccination at
clinics operated by private veterinary groups or associations. He
shall provide blank forms for the vaccination certificates required
by this chapter. Failure to display a valid vaccination certificate
upon reasonable demand by the poundmaster is prima facie evidence of

non- vaccination. No charge in excess of the actual cost therefor
shall be made for vaccination at such facilities or clinics.
:3. The vaccination required hereunder may be obtained either at such
:facilities or clinics or from a licensed veterinarian of the owner's
choice.
SECTION 4. Notwithstanding any provision of Section 2 of this
ordinance:
I. Citations for violations of Chapter 6.16 which pertain to cats
shall not be issued prior to

or her cat may obtain an altered cat license by signing a
statement indicating that the surgery was performed but a
certificate was not issued by the veterinarian on or before

3. Any person who does not have a rabies vaccination certificate
for his or her cat may obtain a one year license without proof
of vaccination on or before Thereafter, a
valid rabies vaccination certificate must be presented in
accordance with Section 6.16.020 of Chapter 6.16.

SECTION 5. If any section, subsection, sentence, clause, phrase
or word of this Ordinance is for any reason held to be invalid or
unconstitutional by a court of competent jurisdiction, such decision shall
not affect the validity or constitutionality of the remaining portions of
this Ordinance. The City Council hereby declares that it would have passed
and adopted this Ordinance and each and all portions thereof, irrespective
of the fact that any one or more of said portions may be declared invalid
or unconstitutional.
SECTION 6. The City Clerk shall certify to the passage and
adoption of this Ordinance by the City Council; shall enter the same in the
book of original ordinances of the City; shall make a minute of the passage
and adoption thereof in the records of the proceedings of the City Council
at which the same is passed and adopted; and shall, within fifteen (15)
days after the passage and adoption thereof, cause the same to be published
in the Moorpark News Mirror, a weekly newspaper of general circulation, as
defined in Section 6008 of the Government Code, for the City of Moorpark,
and which is hereby designated for that purpose.

The following information is based on information statistics
provided by tle County of Ventura Animal Regulation Department, using current fee amounts.
Although there is insufficient staffing at the County
to provide a canvassing effort, a progran could be designed
using a special combination of labor from Moorpark College,
combined with training an supervision from the County.
