SUBJECT: Consider Approval of a Project to Construct a Property
Wall on the North Side of Los Angeles Avenue west of
Shasta Avenue (Lopez)
BACKGROUND
In 1990 the City contracted for the construction of a street
widening project on Los Angeles Avenue between Park Lane and Shasta
Avenue. One of the elements of that project was the construction
of an eight feet (81) high block wall on the residential property
at the northeast corner of Los Angeles Avenue and Shasta Avenue to
replace an existing six feet (61) high blockwall which had to be
relocated.
During and immediately after the construction of that project,
staff was in discussions with the owner of the residential property
at the northwest corner of Los Angeles Avenue and Shasta Avenue.
No agreement was reached with the owner of that property regarding
City participation in the cost of the construction of a block wall
on that property.
DISCUSSION
A. Proposed Block Wall Construction
Mr. and Mrs. Lee Lopez own the property at the northwest corner
of Los Angeles Avenue and Shasta Avenue (Exhibit 1). The Lopez
family have approached the City once more with concerns about
the noise and vibration generated by truck traffic on Los
Angeles Avenue. They have proposed that they and the City share
in the cost of constructing a block wall on their south property
line. This improvement would be similar to the blockwall
constructed by the City's road widening project in 1990 on the
property located at the northeast corner of Los Angeles avenue
and Shasta Avenue. The proposed block wall would be located on
the north side of Los Angeles Avenue just west of Shasta Avenue.

B. Committee Review and Negotiations
Staff has met with Mr. and Mrs. Lopez several times to discuss
the details of this proposed project. The various concerns and
terms of agreement were brought before the Public Works,
Facilities and Solid Waste Committee (Concilmember Montgomery
and Councilmember Wozniak) on several occasions. The project
outlined below has been reviewed and approved by that Committee.
C. Lopez Participation
Mr. and Mrs. Lopez solicited and received proposals from two
firms for the construction of a six feet (61) high block wall,
using either standard block or beige slumpstone. Those bids are
summarized as follows:

It was mutually agreed that the wall should be constructed with
slumpstone blocks. Mr. Lopez requested that the City consider
approval of a project which limits his financial contribution to
one -half of the low bid for a six feet high slumpstone wall,
said amount being $2,300.
D. Upgraded Project
It was the view of the Committee that the wall should be eight
feet (81) high to be more compatible with the eight feet (81)
high block wall already constructed on the east side of Shasta
Avenue. This upgrade, including the additional design costs,
was offered.by the City at no additional cost to Mr. Lopez in
exchange for the landscape easement described below.
E. Landscape Easement
In exchange for the upgraded improvements described above, Mr.
and Mrs. Lopez have agreed to grant to the City a five feet (5' )
wide landscape easement along the south property line of the
subject property, plus an additional diagonal area at the
southeast corner of the property, as shown on the attached
diagram (Exhibit 2).

With the granting of this easement, the blockwall will be
located five feet (51) north of the sidewalk allowing for the
installation of landscaping between the wall and the sidewalk.
This landscaping is in addition to that soon to be installed
between the sidewalk and the curb by the parkway improvement
project soon to go out to bid. In addition, the diagonal area
at the corner will allow for the placement of an entry treatment
to the Shasta neighborhood.
Subject the City Council approval, it was agreed that the
parkway landscaping improvements in this area would be installed
and maintained by the City. The extension of the above
mentioned parkway improvements into the subject easement can be
done at any time subsequent to the construction of the subject
block wall.
F. Vacant Lot
Mr. and Mrs. Lopez reside at the property identified as parcel
six (6) on Exhibit 1. They also own the vacant lot at the
northwest corner of Shasta Avenue and Los Angeles Avenue which
is identified as parcel eight (8) on said Exhibit. Mr. and Mrs.
Lopez have requested that the City confirm that the proposed
project and the conveyance of the requested landscape easement
will not adversely impact the future ability of the property
owner to construct a residential dwelling on parcel eight (8).
The diagram attached as Exhibit 2 shows the "footprint" of the
maximum "buildable" area on parcel eight (8). If approved by
the City Council, such confirmation will be provided to the
property owner.
G. Other Terms
Other miscellaneous terms of agreement are listed as follows:
The project will include the removal of the existing chain
link fence along the south property line.
• The project will provide for the preservation of certain
mature trees located near the new location of the wall;
The construction of the project will be administered by the
City as a public project with a letter Agreement stipulating
the time for payment by Mr. Lopez.

H. Summary of Project Description
A re -cap of the tasks required to implement this project are as
follows:
• City shall provide to the property owner certain written
assurances as to the future construction of a residential
structure on the property;
• City shall prepare an engineered design for an eight feet
(81) high block wall;
• City shall prepare a landscape easement as describe above;
• The property owner shall execute the landscape easement;
• The City shall cause the landscape easement to be recorded;
• The City shall prepare an engineered design (plans and
specifications) for an eight feet (81) high blockwall;
• The City shall seek and obtain an Encroachment Permit from
Caltrans;
• The City shall administer a project for the construction of
the subject block wall and landscaping.
I. Fiscal Impact
Staff estimates that the cost of this project to the City will
be approximately $10,000, plus the cost of the landscaping. If
approved it is recommended that the project be funded from the
L A AOC. In addition, it is requested that the project be
funded in the amount of $12,000 to cover the cost of installing
the landscaping, plus contingencies. It is the goal of staff to
add this work to project to install landscaping in this area
which will be going out to bid in the near future. If this
opportunity is missed, the project will be constructed under a
separate project.

RECONNENDATION (Roll Call Vote)
Staff and the Public Works, Facilities and Solid Waste Committee
recommend that the City Council take the following actions:
1. Approve the Shasta Wall Project as described in this report;
2. Approve an appropriation of funds from the L A AOC Fund, and
amend the FY 1993/94 Budget by adding the subject project for an
amount of $12,000;
3. Direct staff to proceed with the engineering work required to
prepare the project design and easement deeds; and,
4. Direct staff to present the required easement deed(s) to the
City Council for acceptance upon the receipt of executed
documents.
5. Upon completion of the design and receipt of the Caltrans
Encroachment Permit, authorize staff to add this work to a
contract for like work or advertise said project for receipt of
bids.
