Richards, Director of Community Developmen DATE: December 23, 1991 (CC meeting of January 8, 1992) SUBJECT: ULTRA LOW FLUSH REBATE PROGRAM - VENTURA COUNTY WATERWORKS DISTRICT NO. 1 Background The State requires all buildings constructed after January 1, 1992 to install water closets which use no more than 1.6 gallons per flush (gpf). On February 6, 1990, the County Board of Supervisors (Board) amended the Ventura County Building Code and Uniform Plumbing Code (1988) Chapter 9, Section 914 requiring ultra -low water consumption fixtures and devices in all new construction. On June 5, 1990, the District's Rules and Regulations were revised to include ultra -low toilets and Regulations were revised to include ultra -low volume toilets with 1.6 gpf or less. Ordinance No. 132 was adopted by the City Council on October 17, 1991 amending the Municipal Code by adding Sections 8.02.030 and 8.02.040 requiring low water consumption fixtures and devices. The Water Resources and Development Department of the County of Ventura Public Works Agency is proposing participation in a water rebate program along with Calleguas Municipal Water District (CMWD) and Metropolitan Water District (MWD). Discussion This program will provide financial incentives to residents to replace their existing high volume toilets with ultra -low flush (ULF) toilets. A rebate of $100.00 per toilet retrofitted will be offered. The program is anticipated to continue for two years beginning December 1991. The ULF rebate program will be a financial partnership between MWD, CMWD and the District. Only existing single family residential units will be eligible for the rebate program. Customers will be required to purchase and install am approved ULF toilet, as list on the attached "List of Approved ULF Toilets for Calleguas' retrofit Program ". DR ?ARK. CALIFORNIA c:. Mavor Mayor Pro Tern Councilmember Councilmember Councilmember I The program will be implemented through a consultant retained by the CMWD who will establish an office within the CMWD service area. Among other responsibilities, the consultant will verify the installation of ULF toilets and will install a low flow shower head. CMWD is working with E.J. Harrison and Sons and S.P. Milling regarding the recycling of the replaced toilets. The County Board of Supervisors approved the Urban Water Conservation Memorandum of Understanding (MOU) on July 30, 1991. The State Water Conservation Coalition's Urban Conservation Task Force generated this MOU as a vehicle for achieving water conservation on a State -wide basis. The MOU establishes an ongoing voluntary commitment for urban water suppliers to use Urban Water Conservation Best Management Practices (BMP). Under the BMP process, urban water suppliers would implement proven water conservation measures like the ULF retrofit program. The Board's action on July 30, 1991 approved the ULF retrofit program. On December 17, 1991, the Board approved an agreement with CMWD for the ULF Program and waived the County Building and Safety fee and permit requirement for the toilet fixtures replaced under the rebate program. In a letter dated December 17, 1991 to the City -- Manager, R.R. Pakala (Manager of the Water and Sanitation Services Division of the water Resources and Development Department of the County of Ventura), indicated that the City of Ventura has waived the permit requirement and the City of Camarillo will be recommending to the City Council that the permit requirement be waived. The County is requesting that the City either: 1) Waive the Building Permit requirement for the customers participating in this program, or 2) Accept the verification by the Consultant hired by Calleguas Municipal Water District, to satisfy the Building and Safety requirements. The County has requested that the City make a decision on this matter prior to the Waterworks District informing the customers of the details of the Program which will be during the second week of January 1992. A concern of the City's Building Official relates to potential liability of the City by allowing another inspector do an inspection of the toilet installation other than from the City. This issue could be alleviated by obtaining a hold harmless agreement from the County. 12:23:91 111:09amA: \FLUSH.PGM 2 Recommendation 1. Waive the requirement for a permit and fee for replacing high volume toilets in single family residences with ultra -low toilets under the condition that the County and /or Calleguas Municipal Water District provides a hold harmless agreement with the City. 2. Authorize the City Manager to sign the agreement subject to language approval by the City attorney. There are no administrative funds identified for this year or subsequent years, and so choosing a project that entails this cost has to evaluated carefully. The County proposed a quick solution to the problem of having a short timeframe to work under without administrative support -- expanding the Section 8 rental assistance program. This proposal would allow several families to be removed from the waiting list at the Area Housing Authority, utilizing the existing administration. A transmittal of the City's concerns regarding HOME funds will accompany the CHAS comments proposed by staff because the County has inserted the HOME rental assistance data into the CHAS. Discussion The Section 8 proposal for the use of HOME funds during 1992/93 does raise some serious concerns. It is staff's understanding that there may be a lag time of two to three months between the transfer of a client from the HOME sponsored program to the regular Section 8 program. This delay could potentially cause hardships for those who must wait for the transfer of funding to be completed. Subsequent years of receiving HOME funds will involve the matching funds requirement which will most likely discourage the entitlement group from considering this type of assistance in the future. Therefore, Section 8 support would only be provided for one year. Negative aspects of the Section 8 proposal have led staff to believe that the best use for the HOME funds is new construction. This is because new construction is more likely to be a long term solution for the need of affordable housing, rather than a temporary solution. Unfortunately, there are many details that have to be addressed in order to move a new construction project along quickly. Local considerations addressed two potential projects which could move quickly enough to be eligible for funding low and moderate income housing opportunities. One consideration was a possible first time home buyer program for the 27 unit condominium project on Charles Street, but this is not an eligible use because the construction began before the federal environmental standards were considered, and the design of the housing units is above the "luxury standards!' developed by HUD for the use of federal funds. A second consideration is a housing assistance plan, but the managing agency requires 250 of the grant for administration, and this is not feasible. City Council Page 3 December 23, 1991 One city has identified a potential immediate need for the HOME funds. New affordable rental units in Camarillo are in a position to be developed now, but this only requires approximately $300,000. No word has been received from the County as to whether they agree with Camarillo's project as being feasible, and if so, what would become of the balance of funds. Because there are no immediate potential uses identified by staff for the use of funds in Moorpark, staff is prepared to encourage the County to fund projects like Camarillo's before supporting temporary programs like the Section 8 rental assistance. With Council's concurrence, staff will proceed by drafting a letter which expresses this position on the City's behalf. Recommendation That the Council support staff's comments with any modifications regarding the proposed use of HOME funds to the County, and request that an alternative use for the funds be considered before further consideration is given to the original proposed use of funds, (support of the Section 8 rental assistance program).
