SUBJECT: Consider Revisions to the City's Land Use Development Fee
Resolution
Pursuant to Council direction on January 8, 1992, staff is
presenting proposed revisions to the City's Land Use Development
Fee Resolution, number 91-734.
Summary
Staff's recommendation is that the Council approve an increase of
3% to the hourly rate, (from $71 per hour to $73 per hour),
consider new fee categories as presented by staff January 8,
rescind the existing Land Use Development Fee Resolution, and
replace it with the revised fee rate and processing schedule as
presented in the draft resolution as Exhibit "A."
Background
On January 8, 1992, staff presented its preliminary proposed
revisions to the City's Land Use Development Fees, ("planning
fees"). In this proposal, it was shown that the approved method,
(or formula), for developing a real time cost accounting of the
City's processing costs associated with planning fees was
implemented by staff, resulting in a proposed 3% increase in the
hourly rate.
Staff also described in its January report to Council that
consideration was being afforded to the possibility of developing
four new fee categories, and a more "user friendly" format for the
presentation of the fee schedule to the public. Each new fee that
was proposed by staff at that time was summarized for the Council.
Discussion
The January 8, 1992, staff report has been provided to both the
Chamber of Commerce and the Building Industry Association. No
feedback was received by staff from either the Chamber of Commerce

or the Building Industry Association. The new fees are presented
here only in reference to the revised planning fee schedule.
New Fees
Staff proposed the addition of four new fees to the Land Use
Development Fee schedule, ("schedule"): 1) preliminary review fee;
2) initial environmental study review fee; 3) mobile home increase
review fee (applicable to cost of living proposals only), and; 4)
traffic model use fee. Staff also proposed that the Zoning Code
8111-3.94 regarding penalties for late payments be considered.
Referring to the Exhibit "A," Attachment "A," (the "schedule"
portion of the proposed resolution), new fees can be located
according to the following reference points:
1) Preliminary Review Fee- Permit Number 111," $730;
2) Initial Environmental Review Study- Permit Number 1113.

3) Mobile Home Rent Increase Reviews, (cost of living increase
applications only)- Permit Number 1127," $219;
4) Traffic Model Use Fee- Permit Number 1128," $219.
The fee for late payments to the City is located at permit number
1112" on the "schedule." There is no specific amount indicated for
this listing, because staff will recover all hours applicable to
recovering the deposit amount that the applicant allowed to become
delinquent. Pursuant to Zoning Code 8111-3.4.9, the City may
withhold final approval of a project for an applicant's failure to
pay the City for the costs incurred on the subject application.
Format
The format of the Land Use Development Processing Fee schedule has
been modified to assist the public in reading and evaluating the
planning fee system. Deposits and flat fees have been separated,
and a summary which distinguishes between the two types of billings
is provided in a cover sheet to the "schedule." A "comment"
section has been added to the layout, rather than referring to foot
notes (contained in previous schedules). For some fees, additional
comments have been added to assist the person reading the
"schedule" to understand the permit process, (permit number 23,
Zone Clearance, has a comment referring the applicant to the
Building and Safety office for payment). The entire document has
undergone general format revisions intended by staff to make it
more "user friendly."

Recommendation
That the City Council adopt Resolution 92-`` =`j as presented in
Exhibit "A", thereby rescinding Resolution 91-734, to become
effective February 5, 1992.
